Mick sends us the news from Fox News that former Congresswoman Corrine Brown was found guilty in a Florida courtroom of 18 fraud and tax evasion charges. She was found not guilty of four charges.

Brown served as a Florida representative in the U.S. House of Representatives from 1993 until 2017. She was defeated in her 2016 primary race.

“Congresswoman Brown and her chief of staff are alleged to have used the congresswoman’s official position to solicit over $800,000 in donations to a supposed charitable organization, only to use that organization as a personal slush fund,” Assistant U.S. Attorney General Leslie Caldwell, chief of the Justice Department’s criminal division, said in a statement earlier this year.

The Florida Times reports that she will remain free while awaiting sentencing.

Jurors were told the brash 70-year-old Democratic icon, who spent 24 years in Congress before losing reelection last year, received $141,000 in untraceable cash over several years through sources including the sham charity One Door for Education and her Friends of Corrine Brown campaign committee.

An FBI accountant testified Brown, who earned around $175,000 a year as a member of Congress with a pension from the Florida Legislature, spent an average of $1,438 per month more than her reported income.

I don’t expect her to get any jail time.

she could write a book all she wants, but according to Fed Law, she cannot make any money from it. IIRC, felons cannot wrote about their crimes and publish them, and then earn money from the publication of the work. The money earned would be garnished until her thievery of said funds was paid back in full. I could be wrong. No, you’re correct about the law and all. But I do believe due to the huge loophole in the Son of Sam law, if it’s considered a “victimless crime” they may profit from the sale. I’m not sure how it would work in this case. I just watched something about that law today and thought the loophole was crap. Not many “victimless” crimes I can think of, or else why would it be illegal? Someone is always hurt in some way some shape or another by a crime.

Let’s say after taxes she had $113,000 left per year. Divided by 12 months = $9416.00. Add the $1,438.00 more she spent per month and that = roughly $10,854 per month this public servant spent on expenses. Did I get that right? I don’t know about you, but someone with that much cash certainly does NOT represent me. I am almost positive it was more than that cause you know, politicians have all kinds of side incomes.

I think the number I saw was somewhere around 60%? of Congressional members are millionaires.

I doubt all of them were millionaires before they got into Congress. John McCain was definitely not one, he was a Naval Aviator before he was elected to the Senate. He owns 6 houses now. He’s not the only one with multiple houses. Our favorite popular “Socialist” owns 3 houses while also wanting to give other people, other people’s money for “free”, just not his own.

Considering the numbers I would say the media coverage has been fairly balanced as far as attention to convicted politicians. Right wing sources tend to give conservative convictions a pass in the news as well. After reading that, I got curious. So I decided to check this claim by Berkeley-boi out. The claim seems logically inconsistent – seems to me it’s hard for coverage to be “fairly balanced” if one side side of the political spectrum (which constitutes the vast majority of the media outlets) is skewing their stories one way and the other side )a small minority) is skewing their stories in the opposite direction. So I decided to ignore the first part of this inconsistent claim and instead focused on second part: his assertion that “right wing” news outlets “give Republicans a pass” and “play up” legal issues by Democrats. To do that, I looked at the list he provided above. I then took the 8 Federal Executive-branch and Legislative-branch officials on that list who got in legal trouble during the last Administration – and checked out how their legal troubles were treated by Fox News. That’s one that Berkeley-boi presumably would consider a “right-wing source”. I excluded the lone Federal judge that appears on that part of the list because Federal judges are IMO likely treated differently in the press than elected officials or Executive-branch political appointees (who appear to get similar treatment). It’s also kinda hard to compare the difference in treatment given to different political parties when you only have a sample of one in a particular category. (smile) Here’s what I found. He was sentenced to 8 years and served 7, so yes Mizz Gata can carry her ass to jail as well.
She was found guilty on 18 counts all told.
mail and wire fraud are 20 years per count
Tax evasion is 3 years per and hiding income is 5 years.
Even if they only sentence her once for each crime, that’s 28 years.
Given sentencing Guidelines that HAVE to be followed I don’t she her walking.

JAOD has a point. If I recall correctly, Federal sentencing guidelines are generally followed closely by Federal judges. (One of our lawyer commenters, please correct me if I’m wrong.) If those guidelines say she gets time, then she’ll almost certainly get time.

I’m guessing any time required under Federal sentencing guidelines will be concurrent vice consecutive – but one can hope.

Addendum: did a bit of additional quick checking, and it appears to me that what Brown did qualifies as a Level 10 fraud (it involved a sham charity and was for between $120k and $200k). If so, as I read them the sentencing guidelines seem to say 6-12 months time is appropriate for someone with no prior criminal history. Not a lawyer, so it’s entirely possible I screwed up the application of the guidelines.

Either way, the phrase “convicted felon Corrine Brown” has a nice ring to it.

I agree that Cunningham was treated correctly. As a matter of fact he is still getting his military pension garnished and pretty sure he completely lost his congressional pension. He is living somewhere in Arkansas now I believe. I read some blurb where he was trying to get a permit to own a firearm and the judge told him ” fuck no, you are just another felon”.
