Mike Sleeper; Proof and Reproof

The Augusta Chronicle’s editorial board addresses the Mike Sleeper phony Ranger problem today. It seems that Sleeper has decided to go the lawyer route and he’s hired one, William Cassara, who claims to specialize in correcting military records;

Cassara told us he has found that Sleeper’s military records are indeed incomplete. He says he’s received verbal confirmation that Sleeper attended Airborne School and is working to get written confirmation of that, as well as confirmation that Sleeper served with the 75th Ranger Regiment at Fort Benning.

Cassara says Sleeper went through the Ranger Indoctrination Program in late 1985/early 1986.

“I know from his follow-up assignment at Hunter Army Airfield,” Cassara told us, “he obviously was Ranger-qualified or else he wouldn’t have had that assignment. But again, it’s not in his records.”

It could take months to get it cleared up, he said.

“Once I get all of that documentation, we will petition the Army Board for the Correction of Military Records to correct his records to reflect those two schools. That process takes about a year.”

The public will know much sooner than that, Cassara promised.

Let me help Cassara out – I think Sleeper did indeed go to the Basic Airborne Course, and then went to the 1st Bn Rangers at Hunter Army Airfield in Savannah, GA, and then he terminated his jump status because the Rangers were too hard for Mikey. When he did that, it’s as if he never attended BAC in his records. Sleeper was never Ranger-qualified, like hundreds of youngsters who are assigned to the regiment, but they have not yet attended Ranger School.

The lawyer is just helping Sleeper kick the can down the road hoping everyone forgets that his client is a liar. If there was actual proof that Sleeper isn’t lying about his military experience, we’d be looking at it right now. Question me about something I’ve said about my career and I’ll show you documentation. If I don’t have proof of something, I just don’t talk about it.

The main bugaboo at this point is how long this has dragged on – which has only cast doubt on Sleeper. But his lawyer says he gets calls all the time from vets who served in the 1970s and ’80s “that their military records are pretty devoid of any real detailed information about their service.”

That is what seems so weird to me…From the time I was a private I kept every piece of paper the Army gave me.

Why? Because the people who get paid to maintain records are notorious for losing them and demanding you replace them.

I still have my cert in a document protector in a three ring binder on a shelf…but there’s also a photocopy in the SRB and an entry on a page 4. Point of humor…they gave me Army Rank instead of Navy rank, but the social is correct, so I never tried to correct it.

All the places these things go and it never came up and he never checked it? If he was going to Ranger school, wouldn’t Basic Airborne, be on the pre-assignmemt checklist? Ya just gonna throw guys out of the bird without knowing they’re qualified?

When I first came in, there was a provision to go to Ranger School without wings. They few the legs in to the phases from what I understand. They did away with that right after I came in, so that’s all conjecture. Maybe a graduate from that time (mid 90s) can chime in with better info.

The Navy Recruiter told me to keep every bit of paper the Navy gave me. I took that advice to heart.

Long story short, keeping all of the papers that the Navy gave me earned me a $900 check for back perdiem 2 1/2 years after a TAD because disbursing had been using the wrong rate. I still had the old TAD orders tucked into a file cabinet at home.

I was told the same when I first enlisted and did that through my 26 year career… but, I did know a few people that were booted out of the service and destroyed files they were given.

MIKE SLEEPER probably did what many other shitbag Soldier/Sailor/Airman/Marine/Coastie have done before – but, now with the issue of STOLEN VALOR hanging over his head, he’s shelling out money to “correct” his missing records. If he had kept his records given to him during is service, half of his problem would be solved (and his checking account would be a little bit fatter).

Military support lawyers are making big money these days. Lots of bureaucratic bullshit, lots of efforts to correct records, lots of people separated for any and every excuse, etc.

In this case, the lawyer is just doing what the client wants, though I bet he’s told his client how tough it’ll be without actual documentation, certificates of completion, even an LES with jump pay on it, etc.

You mean to tell me the Army misplaced not one, but two 1059’s? For every school you attend and complete, there’s a 1059. Doesn’t matter the school. So what they’re saying is, the Army lost not one, but two 1059’s, from the mid-80’s? He just noticed this, over 20+ years later? Not to mention, there isn’t a swinging dick in the world who has completed Ranger school, who doesn’t have that certificate framed and hanging on their wall. It’s only one of the toughest schools in the Army.

See my reply to Ex-ph2 above. There are lots of them that specialize in just military/veteran support and make a damn good living at it. A friend of mine is in a law firm that does it, buku money.

You shouldn’t be surprised how often military personnel get screwed and have to get a civilian lawyer to help them because otherwise they’ll be destroyed. The “go to JAG for legal support” option usually entails a young officer who got stuck with the duty and can quote the regulations, but has you and about 100 other clients to support that week and can’t go above and beyond like a paid lawyer can.

Before anyone goes too far on lawyer whacking, Cassara is a) Expert in these matters, a former JAG w/ extensive experience, and b) a paid advocate. Frankly, I like the way he put things to the Chronicle, not making declarations of client victimization and making general statements that are, if not 100% true, then sufficiently ambiguous (e.g., that GDs are not that uncommon) to be taken however the reader wants. In the end, Cassara will likely be left putting all of the emphasis on certain items all ready established, as Jonn points out, and instilling doubt about the contentious items. The editorialist has all ready suggested that this will be a case in which both parties are right. I don’t agree with that. If Sleeper ever said he was a tabbed Ranger, he either was or he was not. Both sides cannot be right about that.

I’d add that this guy probably helps lots of veterans with their military records issues that we don’t hear about. He’s getting paid by Sleeper to do the job so he’ll do it as best he can.

Some of these lawyers even put in extra time to help depending on the client and their income status, without getting paid for it.

Cassara is a legit and ethical military lawyer that has helped countless Joes on BS Sharp/EO charges/complaints and has argued numerous cases in front of CAAF (Court of Appeals for the Armed Forces). This isn’t some shitheel that set up a office in a minimall and charges Joes 5k to spend a hour doing a plea deal on pissing hot. If there’s a legit discrepancy in the records, he’ll find it and he won’t weasel around doing it.

There are times when they receive an application from someone claiming a Purple Heart from Vietnam with no supporting documents filed with the application, and they piece together an extensive chronology, regulatory explanations, and sometimes award relief to the applicant. The Airborne School and Ranger claims are the easiest to confirm, as those folks at Benning keep extensive records.

Punishment is discretionary, not formulaic, despite the numerous sentencing guidelines that one can find. Mitigation is just that when it comes to sentencing and includes those things that are favorable to the defendant and would, the defense hopes, influence a judge to go easy on the sentence. Cassara’s message is, ‘Hey, like this guy, you, too, may be guilty as sin, but that doesn’t mean all is lost.’ He’s running a business, after all, and talking up how many, if any, of his clients went to Leavenworth isn’t good for business. In Sleeper’s case, there appears to be no risk of criminal prosecution, so mitigation isn’t a factor.

Some of these comments about DD 214’s made me curious about my own so I just checked my last one and under Basic Education and Training, it’s missing Basic Airborne Training, RTO and Lineman School, Driver and Mechanic Training, as well as all my expert weapons qualification badges on rifle, pistol, BAR, Light Machine Gun, Bazooka, Recoiless Rifle and M-79 grenade launcher.

You should have the Parachutist Badge listed in your awards and decorations, but Airborne won’t be listed in education. The regulation forbids listing “combat skills” there, as the purpose is for job placement and counseling.

If he’d just said ‘I was trained and qualified as an airborne Soldier and had the honor and privilege of being assigned to an Army Ranger unit but I was not a Ranger – I didn’t attempt Ranger training.

Later I voluntarily gave up my jump status. Things were getting too tough for me so I chose a different path in life. I’ll always be grateful for my days as a Soldier.’
