Woman sentenced in road rage death of Zacharias Buob

About a year ago, we wrote about the tragic death of Chief Petty Officer Zach Buob, a 20-year veteran of the Navy, in a road rage incident. Darla Renee Jackson, 27, ran him down while he was riding his motorcycle in California. The LA Times reports that she was sentenced Friday;

Calling her behavior “outrageously reckless,” a judge on Friday sentenced a young woman to six years in prison for chasing a motorcyclist on two San Diego County freeways and causing the crash that killed him…Jackson, who was driving a Nissan Altima, pursued Buob at speeds reaching up to 90 mph and crashed into his motorcycle when the traffic slowed in front of them. Buob was thrown to the ground.

She ran over him as she swerved her car to avoid the fallen motorcycle. Buob died later at a hospital.

“Whatever the purpose, she chased. She sped. She followed too closely. and she hunted him down,” Deputy District Atty. Laura Evans said during the sentencing hearing.

Prison overcrowding occurs when fewer bodies are going out the backdoor than are coming through the front door. The attitude used to be, “Tough shit” but the courts got involved and started ordering prisons and jails not to double cell inmates if the cells weren’t designed for two, and to stop putting inmates on cots in the dayrooms and whatnot.

I did also. 1991. I was riding a Kawasaki 450 that was on its last legs. Didn’t have enough power to get out of its own way. Two assholes in a full size Blazer tried to run me down. I was chased down several streets through west central Phoenix. I finally got away after making several quick turns and going down an ally they could not follow. Same year got hit in the head (helmet) from a thrown rock while traveling down the freeway. Had to buy a new helmet as it crushed the one I was wearing. Later another driver threw an 8 inch square 1/2″ thick metal plate at me (same freeway different day). I got my foot up and bounced it off the sole of the boot.

Six years for premeditated murder is a joke.

She plead guilty to voluntary manslaughter in January. The state did not offer her a sentencing deal. The plea was made in order for her to avoid a murder conviction. After the plea was accepted, the judge told her that she could receive 11 years but that he would probably give her up to six years. And that’s what she got, although, by her emotional outburst at sentencing, it’s clear she thought she was going to receive less. Now, in California, all buit violent felons who are good boys and girls in prison, serve half their sentences nowadays. In her case, however, she has to serve 85% b/c voluntary manslaughter is a violent felony. Somebody else can do the math. Don’t forget to subtract the time she has been incarcerated awaiting trial. That counts as part of the six years she received.

Booked into jail without bail on 2 June 2015 (23 months ago)

85% of 72 months is 61 months.

61 minus 23 is 38.

So maybe all 38 months behind bars? Not likely. Out in 24 at the most.

The DA offered her the deal and she took it because she was forced in to a corner – face 15 to life or take the overcharged deal of intentional manslaughter and face a max of 11 and at least have some end date. She ended up taking their deal and admitting to something she didn’t do just so she would be home with her baby. She really had no choice with a Navy biased jury that is tainted by the biased media and and with the majority of evidence being too scientific for the average person to understand. Even the judge said is was an accident and at most gross vehicular manslaughter, but the judge has no say in the charges or the DA deals. Darla Jackson was maliciously prosecuted because Zach was in the Navy and everyone thought he was some great Spec Ops seal. No, he was only support and drove a little boat and many sailors can do that. Quit worshipping him because he was in the Navy. Many sailors enlist and go on many deployments and after 20 years end up being a CPO, but those other sailors don’t go out attacking random motorists like Zach did, road raging before he even got on the road. Before you make a judgement call, know the facts of the case and understand what Zach was doing while he was not acting Navy. He could have attacked you, your spouse, your mother, your kids. Even the judge lost it when he based the six year prison term on his feelings and not on the facts and evidence, trying to avoid a riot in the court hall. This was such BS because there were only pansies left in the hall. Zach Buob was the freeway terrorist and he attacked multiple motorists. Buob started the chain of events that led to his death. Were I a detective anywhere in her area, I would be looking extra-carefully at any unsolved “knocked down or ran over a biker/pedestrian/pet” and cross checking with any known repairs to her vehicle, etc.

I have long said that if you really want to kill someone, but you don’t want to go to prison for the rest of your life, use your car.

If Darla Renee Jackson had pulled out a gun and shot Zach Buob dead in front of dozens of witnesses, she would almost certainly be looking forward to at minimum decades behind bars, maybe forever. (Even in California). But, instead, she used her car, so she will probably be a free woman not long after her 30th birthday.

Zach Buob, meanwhile, will still be dead.

From what I read it looks like the lady instigated the incident by speeding up to him on the interstate and deliberately cutting him off on the left lane.

I don’t know why but there seems to be this mentality that some drivers hate and are a-holes towards motorcycle riders. Why? I doubt this lady would have cut off a member of the Hells Angels or Mongols!

Having ridden motorcycles for 25+ years, I think part of it is that motorcycles (especially sportbikes) are generally faster than most cars (unless you’re driving a $1 million+ super-exotic). And some people (mostly young males, but all demographics are represented) really, really don’t like the idea that someone else is faster than they are. So they behave with unhinged aggression towards motorcyclists.

In the interest of full disclosure, I must note that some motorcyclists (again, mostly but not exclusively young males) ride like total douchebags, which gives a bad impression of motorcyclists in general.

Which is still no excuse for murdering somebody.

Everyone is understandably pissed at the lousy six years she got. She was exposed to 11. The state didn’t promise her anything. She admitted that she voluntarily did what she did, which was to drive an estimated 93 mph on an off ramp, and when the motorcyclist ahead of her slowed for stopped traffic ahead, she didn’t, slamming into and killing him. That’s what she did. That’s what she admitted to doing back in January. Fast forward to sentencing and she gets six years. No one has said a word about the judge. No one has asked just who he is. Even the newspaper acct leads with reference to “a judge,” although it later identifies him. The local TV news and other sources don’t ID the judge. Why is that? Why is it that unless a judge is accused of political incorrectness, he is so rarely identified?

I would imagine one of the reasons Zach was out road raging was because his dad had just done a hit and run himself and now has a criminal record in Santa Clara county. I think Zach was mad about his dad hitting that young couple and then leaving his license plate behind at the scene. Zach was going to show him how to do hit and runs and get away with it so Zach took it out on San Diego motorists.

POS doesn’t even rate the vaunted TAH “Cocksucker” tag. I had a harrowing escape and evade.in Chicago about 15 years ago when out training on my racing bike (bicycle). Some jocko and his drunk buddy though it would be funny to open the passenger door as they passed me almost knocking me into a parked car. They were shocked when I caught up to them 10 blocks later at a stoplight and dumped the contents of my waterbottle full of electrolyte drink in thedrivers lap. Needless to say “It was ON!” …. after several alleyways , blown stop signs and my heart rate at about 300bpm , yje douchebags shot out of the alley into the street right in front of a cop and just missed T-boning him.The cop hit his lights and I got the eff outta there as they had murder in their eyes and hopefully went to jail.

You need one of the handier and lighter bike accessories, the compact .380. Like a carbon fiber bike – polymer frame, a bit harsh in operation, but in the end very functional. Let’s be honest – you’re probably carting around extra pounds yourself like most of us so a pound extra is no big deal.

Two or three lessons here from what I see, one we need to start executing more violent criminals so the prisons aren’t so overcrowded while also eliminating private prisons.

The second lesson is that sometimes you can get killed for kicking the door of a car while trying to make a point…or more accurately, sometimes you can get killed for the slightest thing so choose the moments you want to engage someone else carefully. Especially while riding your motorcycle…sometimes you flip someone off, curse at them, whatever and they kill you in that moment. As much as we all think we’re prepared to defend ourselves the reality is that most of us don’t always recognize the exact moment we might need to be prepared to do that because we’re not aware that the person we’re engaging has decided to become a fucking maniac. I’m willing to bet Mr. Buob didn’t realize that cutting in line would get him killed that day. I’m not saying he did anything wrong, When a mom decides to chase and kill someone over some damage to a door, or a guy shoots some kids over some loud music, or a soccer mom chases someone with her gun out in her car over some words you begin to realize that our cars make us something other than what we think we are. I don’t know for sure what happened that day but something happens to us in our cars we become something ugly for the most part and that is a volatile and potentially dangerous thing at all times.

I suppose the third lesson is one we already know, our legal system and our ideas of justice are a fucking joke. A really, really bad joke in very poor taste.

You make excellent points – I ride every day for the most part unless it’s raining or snowing. I do have a very low tolerance for stupidity from cars. I have gotten caught up in the heat of the moment when almost ran over, thankfully the idiot in the car wouldn’t stop or I would probably have went to jail. Finally i gave him the salute and pulled away. I think about my fellow Chief and what he did that day in no way was punishable by death. Some people just hate motorcycles maybe it is envy or a negative experience with a rider but there is no reason ever to use your car as a weapon. 6 years is not enough.

I’ve rolled on plenty of motorcycle T/Cs over the years, VOV, and you’re absolutely right. Very rarely does a rider walk away. More often than not, we’re trying to figure out which piece goes where. Most of the ones I’ve seen have been accidental, which just goes to support your point that riding two wheels with a motor is risky enough without getting into a pissing contest with some idiot who heavily outguns you in terms of gross vehicle weight.

Legally Murder I would have been tough to prove. Murder II in California would have been easy in this case. She would have been a guest of the State for 15 years minimum if they had gone to trial.

That is why she plead out. Most DAs are going to do whatever they can to avoid a trial. If they know they have slam dunk most of the time they simply offer the next lower offense as a deal. This is why we have so many people in prison who are drug dealers for example but are “only” in for possession charges. Six years may not be right but is not abnormal.
