A cautionary tale; 65-year-old David Allen Pettersen of Madelia, Minnesota fired his .45 caliber pistol at several young burglars as they fled his property. 19-year-old Nicolas Thomas Embertson was killed in the gunfire. Petterson faces manslaughter charges as a result.
A homeowner in Richmond, Virginia interrupted a home invasion and burglary by shooting the thief in the arm.
Charles W. Casford, 33, a bar owner in DePue, Illinois, caught Jackie L. Popp, 42, looting the cash register after hours. Casford shot the thief in the leg when he charged Casford. According to the article, Popp has a fairly extensive criminal record.

3 criminal efforts, and each handled with guns. In two instances the bad guys were shot and wounded during the commission of the crime. In the third, the homeowner shot at the bad guys as they were driving away. That homeowner faces manslaughter charges. We can use our firearms to defend ourselves, but if we use them to retaliate, shooting them as they are going away, we are not “in the right”. Owning a weapon is not enough. We must know when to use it, and when to holster it.

Yep, manslaughter, for the dumbass here in Minnesota, is the proper call. If they are fleeing, you must let them go, no matter how pissed or scared you are, or how much of a criminal the perp is.
Yeah, even in Texas shooting them while they are un-assing the AO is frowned upon. I’ve always went with “if they’re running away from you, their pants are already full, and there is no threat”. Even if they are still inside, it just saves ammo (and paperwork, lawyer money, and your ears).
Although I can’t see any sane jury convicting this guy. Especially if the newly assuming-room-temperature individual has a record.
I am no lawyer, nor do I play one on TV, but my understanding of the law here in Texas is that if you reasonably believe the thief is getting away with something of yours which is irreplaceable on your current income then the use of deadly force is defensible.
Given the circumstances of the guy in Minnesota, no Texas jury would be expected to convict, hence probably no reasonable DA would indict.
Generally speaking, as in almost all states, defense of the loss of personal property is not justification for the use of deadly force. It’s based on the concept that human life outweighs the right to possess personal property. The use of deadly force when the “enemy” is retreating is only OK in warfare (if you have commonsense ROE).
I’m not a lawyer either, rgr769. But I think Greybeard may well be right under TX law- providing the crime occurred during hours of darkness.

I watched “Eldorado” on Netflix last night and the character “Bull” played by Arthur Hunnicutt as the deputy kept warning about “indian tricks” where the perp would pretend to leave or run away only to hide in waiting or circle back.
Just sayin.
Love that movie.
I remember the scene. The bad guys fled, but had set up an ambush. That’s when Bull had his bad feeling. The good guys were deputies, so they were obliged to follow. The Minnesotan, on the other hand, was watching 3 losers flee in a car. All he had to do was not follow. Big difference.
But the next time I’m following some bad guys down an alley in a small Western town, I’ll remember Bull’s advice… 😉
