Friday morning feel good stories
Ladonna Wasschsmann and her husband, in Wichita Falls, Texas, saw a thief stealing from their neighbor’s home. He went and got his shotgun and fired a warning shot and ordered the thief to the ground. Instead, the criminal made a dash for his truck and took off down a dead end street and got stuck. Another neighbor pulled his car in behind the thief so he couldn’t escape until the police arrived.
In Louisville, Kentucky, two teenagers tried a home robbery in broad daylight. When they broke in, they were confronted by the family dogs which the teens promptly killed. The homeowner then shot the pair of criminals. Police found one at the scene and the other a few blocks away, unfortunately it appears that both of them will survive.
A woman was the house guest of a friend in Eastlake, Ohio, when she heard someone pounding on the door of the home. Then she heard male voices in the house, so she took her handgun to investigate. The sight of the firearm sent the three burglars on the run. The woman got the license plate number of their car and the police have arrested them.

Good day at the plate for armed citizens: 6 total perps, all 6 in custody, and two with brand-new high-speed heavy metal body piercings. That’s 6-for-6 with 2 extra-base hits.
Damn shame about the dogs, though. Hope that adds another felony count to the charges against the two Lousiville low-lifes.

Too bad the Louisville homeowner didn’t apply that one extra “double tap” round to each of the teens as retribution for killing the dogs. It would have been justice well served if they had ended up at the morgue instead of the ER. I’d have even paid for the extra rounds out of my own pocket.
Criminals busting in wanting other people’s property. Some got what they were looking for – bullets are property too…
I’ve always felt that warning shots should be center of mass. It warns the accomplice quite nicely.
No doubt that’s generally true, but “immediate use of deadly force” as a response to “stealing from the neighbor’s house”…is not something I’d want to have to defend. Mr. Wasschsman took the safer route, and Mrs. Wasschsman gets to have him home at night while their life savings stay in the bank.
Not a problem in Texas though.
Texas penal code 9.42
A person is justified in using deadly force against another to protect land or tangible, movable property:
(1) if he would be justified in using force against the other under Section 9.41; and
(2) when and to the degree he reasonably believes the deadly force is immediately necessary:
(A) to prevent the other’s imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime; or
(B) to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property; and
(3) he reasonably believes that:
(A) the land or property cannot be protected or recovered by any other means; or
(B) the use of force other than deadly force to protect or recover the land or property would expose the actor or another to a substantial risk of death or serious bodily injury.
Okay, then! Thank you for the information.
Though, happily, in this case the deadly force wasn’t “immediately necessary” — as lesser means were sufficient to the purpose.
Read it again. Simply to stop them from getting away qualifies.
With that said, I don’t know if it would be the wisest decision. Surely you would be tied up in some lawyer fees, time, life interruption, local drama, etc.
But you would at least start out with the law in your favor “if” you chose to use deadly force to protect personal property. Tough call. I hope I never have to make the decision.
Google “Joe Horn.” Very interesting case regarding this law. But his life has been all kinds of disruption since then.
