SWATTING gets doofus a year in jail

Complex reports that 22-year-old Matthew Tollis earned himself a year in jail for several SWATTING episodes. SWATTING is the practice of calling the police to report an emergency that would require the police to roll up on a target with SWAT teams or another extreme reaction. I only know of one member of TAH who was SWATTED – someone, you can speculate who, called the police and said that this member was suicidal and had a gun. Luckily, the police were in possession of their complete faculties and didn’t go all SWAT on that TAH member. But back to young Matthew;

This summer, Matthew Tollis pled guilty to faking a bomb threat as part of a group known as “Team Crucifix or Die” or TCOD. According to the Department of Justice, Tollis was involved in six fake emergency calls in 2014, including one that shut down the University of Connecticut for three hours as police searched for explosives. Last week, a judge sentenced him to 12 months and one day in prison, plus three years of supervised release and 300 hours of community service.

US Attorney Deirdre Daly released a statement regarding Tollis’ sentence: “Swatting is not a schoolboy prank, it’s a federal crime. It is our hope that this prosecution and the knowledge that this defendant will serve time in prison and live with a felony conviction for the remainder of his life will deter others from engaging in this immature, dangerous and criminal behavior.”

As the article points out, SWATTING is usually targeted towards individuals’ homes making the practice more dangerous. If I have been SWATTED, I’m not aware of it, but then I’ve told the local State Police and Sheriff about our members’ experience with his own police force. I do, however, know of other telephonic pranks that plague our friends, and that noose is tightening on the responsible persons. It’s good to see prosecutors getting serious about it, too, but a year and a day seems a little light to me.

Actually, the year and a day traces to English common law. Statutes designate crimes as misdemeanors and felonies, without regard to sentence exposure. I know that in some states, parole or early release eligibility depends upon sentence length, as does whether someone does his time in a county jail or a state prison. (Yeah, I know this was the feds.) Whatever. A felony is a felony is a felony. And that makes our boy here a felon or, as I prefer to call him, a Democrat.

Federal law also specifically defines a felony as a crime with a maximum sentence of in excess of one year – see 18 USC 3156 and 18 USC 3559(a)(5).

The first citation to the Code defines felony “As used in sections 3141–3150 of this chapter” only. Thus, a sentence of a year and a day does not render a crime a felony outside of and for purposes of construing, those sections. The second citation—the better one– covers crimes generally and assigns the designation of felony and misdemeanor in those circumstances where the designation is not otherwise provided. Thus, it remains incorrect to say that a federal crime is necessarily a felony if the sentence exceeds a year.

And any organizations and persons who were the victims of (this or any other asshat’s) SWATTing, should be able to file civil and criminal charges for damages, libel, slander, etc. Clean these asshats down to their whitey-tighties, and then burn the whitey-tighties.

Not a joke, just because YOU, Mr and Mrs Asshat, are offended by someone practicing their rights. There have been too many stories of broken doors, people shot and killed, due to SWATTing.

Ah, in some jurisdictions and depending on the totality of the circumstances, it is!

Several (increasing numbers) cases have been tried on charges of terrorism, waste of government rersources, serious bodily injury and or death because of this practice.

I’m trying to remember what was included in what we called “Payday Procedures” in the 82nd in the ’60s. I know us 2LTs had to give scintillating presentations that I think were called Command Info. They included current events, Chaplain, etc.

I also recall the agony of paying the troopers. In garrison was one thing but then to go out to Sicily and find Snuffy in a Fox Hole. And then there was the time that Finance gave me the payroll for an Infantry BN and mine was a Signal BN where troopers got pro pay and I came up short on $.

Speaking of the disgraced and disbarred one I saw some old info from 2004 where he was on a forum with other Photographers posting about how they had been scammed.
Apparently someone in England had seen the “greatness” of Birdbath’s photography skills and offered him a large sum of money to come photograph their wedding.
They sent Birdbath a check to cover his airline fare to England.
The Catch was that the wedding planner/ accountant had sent a check that was 4000 bucks over the ammount it was supposed to be and They asked Birdbath to send the Surplus ammount to anothere address in the Czech Republic to pay another person who was doing a service for the wedding.
Bernath claims that though he did buy a Ticket to England, he never sent money to the Czech Republic, so he only lost 200 bucks that he had to pay to change the flight dates.The check sent by the scammer had bounced of course.
But that he initially fell for this speaks volumes of his arrogance in thinking he was such a good photographer that people from another continent would fly him over for their wedding.
If he did get scammed for the 4,000 bucks he would never admit it.

Not only do I have concern for the people who get SWATted, I have sympathy for the police involved. On top of all the other stresses they face in those operations, can you imagine the nightmare of going in wondering if the situation is even REAL or not?

I am not up to speed on sentence lengths, Felony/misdemeanor designations, but know from several sources that if a sentence is for 1 year, that the prisoner may stay in the county jail, and get good time. In at least one state, a sentence of a year and a day means both, that the offender will be sent to a state or federal lock up, and that there will be no good time offered. Unlike what some dopes think, I have not been faced with any such variables, even staying squeaky clean, having a Concealed Carry permit and other nice thingys in my wallet, that would be unable to get with any negative contact with Law Enforcement.
Even if this swatter is only given a misdemeanor, that year and a day will leave a mark.

In my state, any state time 2 1/2 yrs or less gets you county time and 2 1/2 or more you get to spend your days with the state DOC.

I don’t know about the BOP to give accurate answers.

Felony is a minimum of “one year + 1 day”.

Any class of misdemeanor of below a felony would be said to be, “up to 1 year”.

Violations and infractions are typically 30 days or less.
