Mesa shooter arrested

So this fellow Ryan Giroux went on a shooting spee yesterday in Mesa, Arizona killing one and wounding 5 others, according to Yahoo News;

According to court records, Giroux was sentenced in July 2007 to seven and half years in Arizona state prison after pleading guilty to attempted aggravated assault. Details of that case weren’t immediately known.

He served a little more than six years in prison before being paroled in October 2013. But according to Maricopa County records, Giroux violated a condition of his release a year ago and was placed back on probation through October 2016.

So, he’s another one who gun control didn’t work for – he is a felon and not allowed to own a gun or have one in his possession. That’s not much comfort to the grieving family, though, I’m sure.

The shooting spree began at about 8:40 a.m. MT at the Tri-City Inn, where three people were shot — one of them fatally — after an argument, police said. The gunman then ran to a nearby restaurant, where one East Valley student was shot. He then stole a car — a gray Honda Accord — and attempted a pair of separate home invasions, where he shot two people, police said.

But, yeah, I’m glad he’s not a military veteran, I’m pretty sure that those tattoos would have precluded any military service. But it is probably easier for a criminal to buy a gun in a darkened parking lot than it is for a law abiding citizen to buy one in a gun show.

He has, as you might guess, an extensive criminal record, from burglary to attempting to get his hands on a police officer’s firearm. He has been arrested in three states (AZ, CA, WA) and has twice served prison terms, both in AZ. He was a very bad boy in prison, too, being charged with possessing drugs, contraband, and assault. He is evil incarnate.

Why? How? Dollars to donuts, his criminal justice system trail includes all of the following:

1) Nolle prosses;
2) Plea bargains;
3) Probation in lieu of prison;
4) Failure of the state to criminally (not administratively) charge him and try him for the drugs and weapons possession in prison;
5) Failure of the courts to impose maximum, consecutive sentences; and
6) Release before his maximum, legal sentence dates were reached.

I took a look at his record too (open source information). You are correct, I believe he is a bad boy. And has at least 8 infractions/guilty’s while in prison including: what seems to be assault, manf a weapon, etc. Like you said, what the hell was he doing out on the street in possession of a weapon.

If he served his time and got out, there’s nothing anyone can really do until he breaks the law again (as he very apparently did in this case.)

It’s a case of knowing something bad is going to happen, and not being able to legally do a thing about it until it occurs. Unfortunately. That’s why I made the comment about the death penalty above — and he just may get that this time. He’ll die in prison, but at least he won’t get out again.

He violated parole, so the state had the option of putting his ass back in prison, to finish his original sentence, it sounds like they just decided to extend his parole, even though he’d given them reason to know that he wouldn’t behave.

Yep. It is common for a defendant to receive a split sentence, with prison, followed by a period of probation. Thus, he is either mandatorily or by discretion of the parole board, released before his sentence expires, and, on that release date, his probation begins. Thus, he can violate the terms of his parole and those of his probation at one and the same time. This was not the sort of fellow who would have cottoned to being supervised and he probably violated quickly. The question is whether his parole and probation officer acted quickly.

My comment was in reply to PN, not Ex. I suffer from Postfastitis, apparently. You’re correct, 2/17, this POS should have been shuffled off to prison when he violated. Now, someone’s family pays for the parole and probation board’s fuckup.

I Wish I could post a update to this story here, this happened right up the road from me. This kind of crap seems to happen here quit a bit up north in Phoenix and kingman. This was on our news all morning yesterday. Crap is crazy
