Kyle Dinkheller’s murderer’s execution is a “go”

Andy11M sends us a link to Reuters which reports that Andrew Brannan, the Vietnam veteran we talked about the other day will be executed on schedule tonight;

The execution of Andrew Brannan, 66, by lethal injection is set for 7 p.m. on Tuesday. He is slated to be the first person executed in the United States in 2015, the Death Penalty Information Center said.

Brannan’s lawyers asked the Georgia Board of Pardons and Paroles to commute his sentence to life without parole because he was suffering from a combat-related mental disorder when he killed Laurens County Deputy Sheriff Kyle Dinkheller, 22, during a traffic stop in 1998.

The board said in a statement it denied the clemency request after thoroughly reviewing it and hearing testimony on Monday.

Brannan still has appeals pending in Georgia courts. By law, Georgia’s governor does not have the power to grant last-minute clemency to a death row inmate.

The inmate’s lawyers do not dispute he shot Dinkheller nine times during a traffic stop in an encounter caught on tape by the deputy’s patrol car camera.

But they urged the parole board to consider the physical and mental toll of his combat duty in Vietnam.

I’m not a big advocate for the death penalty, but this guy deserves it if anyone does. PTS doesn’t make veterans act like fools. I don’t doubt that this peckerwood has mental problems, but they’re not related to his experiences in combat.

Not anymore, Florida had to retire “Old Sparky”, they use injection now. I think more States need to use hanging once again, Oregon still does if I’m correct. Either way, GOOD RIDDANCE, BRANNAN!!

Sparky is used by Alabama, Arkansas, Florida, Kentucky, South Carolina, and Virginia. Oklahoma and Tennessee use it if Lethal Injection isn’t available.

This is sad. Sad for the officer and his family. I believe the first time the officer shouted, “put the gun down” and Brannan did not comply, the officer should have begun firing until the threat was abated. God bless this officer’s family and I hope Andrew Brannan has the miserable time in hell he deserves.

I’m priority group 1 with the VA. I do get medication from them. Whenever I run low, I “make the decision” to “reorder.” If that knucklehead wasn’t on his meds, it was because he made the decision to do something other than get those meds. Sorry, no excuse there.

This isn’t one that he could blame PTS on. Based on his hot-headed attitude, his control and anger problems, and and other issues, he made a series of decisions that lead him to this point.

This guy doesn’t get a pass for his past service. The key is that he decided to do something he had to know was wrong. He made a series of bad decisions that lead to him speeding, then he continued to make a series of bad decisions during the traffic stop.

Sorry, the fact that he’s a Vietnam Veteran, at this point, isn’t material. The guy made a decision, a tragic one, and he must pay the price.

I wonder if he still qualifies for US Veteran’s funeral and burial benefits, I.e. burial in a Veteran’s cemetery? I heard about a bill a few years ago calling for denial of that if the Veteran commits a felony after their discharge or retirement, anyone know if they ever passed it?

Under 38 U.S.C. § 2411, interment or memorialization in a VA national cemetery or in Arlington National Cemetery is prohibited if a person is convicted of a Federal or State capital crime, for which a sentence of imprisonment for life or the death penalty may be imposed and the conviction is final. Federal officials may not inter in Veterans cemeteries persons who are shown by clear and convincing evidence to have committed a Federal or State capital crime but were unavailable for trial due to death or flight to avoid prosecution. Federally funded State veterans cemeteries must also adhere to this law. This prohibition is also extended to furnishing a Presidential Memorial Certificate, a burial flag, and a headstone or marker.

Not only did I work for 30 years with Veterans suffering from PTSD, I’ve had it myself for over 40+ years. I know all of y’all know this but I just have to add my 2 cents. There is no way possible PTSD caused this POS/SOB to do this. I’m glad he’s dead and there will be no place on the Fiddlers Green for him. They don’t have one in Hell. Postscript: Deputy Dinkheller’s killer’s final statement before he was executed included this: “I extend my condolences to the Dinkheller family, especially Kyle’s parents and his wife and his two children.” The SOB even screwed that up. One doesn’t extend condolences to the family of a man one intentionally kills.
