Kyle Dinkheller’s murderer faces execution
That’s the video of Sheriff Deputy Kyle Dinkheller when he was murdered on Jan. 12, 1998 by Andrew H. Brannanon a country road in Georgia when Brannanon was pulled over for driving at about 100 miles per hour. Now, Brannanon is due to be executed on Tuesday for his actions. But, his lawyer is trying to get a stay to the execution on the grounds that he suffers from “PTSD” from his service in Vietnam, according to the Washington Post;
His lawyers, L. Joseph Loveland Jr. and Brian S. Kammer, said in a recent petition to the Georgia Board Of Pardons And Paroles that the jury who found Brannan guilty in 2000 never heard all the facts of the veteran’s combat-related post-traumatic stress disorder and other mental illnesses.

“Andrew’s combat experience forever altered his personality and his life,” his lawyers say in the most recent petition. “Although he initially re-entered civilian life, he soon began to manifest signs of serious mental illness, which grew worse over time.”

“The terrible toll of combat is not an excuse for violent criminal conduct, but it is entirely appropriate for the Board to consider these facts in assessing the retribution that society demands
for the criminal conduct that is triggered by mental illness resulting from combat,” the petition says.
I’m pretty sure that the defense will have trouble finding a specialist in the realm of post-traumatic stress which will classify the behavior I saw in that video a result of that disorder. In fact, anyone who hides behind their military service as an explanation for their bad behavior, as Brannanon did when he yelled that he is a “goddamn Vietnam combat veteran,” probably suffers from something not related to that service.
Clearly, he wasn’t suffering from flashbacks or anything related to his service while he was doing his little dance routine. The Post tries to make it look as if the deputy escalated the situation, but it was all that murderer’s fault – the deputy showed great restraint, which cost him his life.

This video is a staple at police academies and federal training centers. It never gets easier to watch or hear. It does however drive the point home, you always have to be mentally prepared for combat.

That’s the US News and World Report sub-headline in its 9 January 2015 article about the pending execution. Notice that the killer has a name and is a person, but the murdered officer is nameless, merely a thing, “a cop.” Well, the officer was a good man, a son, a Dad, and a husband. His name was Kyle Dinkheller.

Was that video admitted as evidence at the murderer’s trial? If yes, they when is the murderer still breathing after 16 years? The first trial judge should have instructed the bailiff to take the defendant outside and put a bullet through his head like a dangerous dog. If that video is in evidence cannot conceive of a reason that murderer is still alive.

When I was at McLellan getting my 31B MOS in 2006? That video was shown in a class on Escalation of Force.
If I also remember, correct me if I am prong please, That was the Deputy ‘ s first day on the job, and he also did not attend any police academy of any sort prior to the beginning of the job.
In other words, no experience at all. Zip, Nada, None, and sent out on the road alone on his very first day.

If that’s true, then there needs to be someone from the police hierarchy that should be on death row with Brannanon. Talk about foolish, dumb and callous!
Truthfully though, I find it hard to understand that any police agency would throw new recruits out on the road so quickly.
Oh, the Sheriff got shit canned as a result of this but was politically connected he never faced criminal charges.

We saw that same video for EOF back in 2003 on my first enlistment as AFSF (SP for all you old farts). They had a completely different explanation.
However, it was not until 2008, that I heard the actual story from one of my NCOs that was a Deputy in the same department when it happened. He was not a new deputy. He had been recently reprimanded for pulling his weapon too frequently by the Sheriff. The sheriff going so far as to say he would be fired if it happened again. So when this situation happened, apparently the deputy was reluctant to pull his weapon as his job was on the line. Unfortunately for him, it cost him his life

Deputy Dinkheller was 22 years old at the time he was killed. Whether he had in his mind a superior’s warning not to pull his weapon is neither here nor there. He did pull it, he did shoot it, he did hit his target once in the abdomen. Unfortunately, he was outgunned by a much more experienced opponent.
You bring up a good point, and a personal pet peeve of mine. No officer should ride alone, ever. Not in this day and age. Two per car should be an iron-clad rule. And yes, it costs money, and yes, it means more in taxes…so be it. I would rather pay that price, than to watch even one cop die like this.

The WAPO article pretty well covers that. I’m sure his lawyer covered his service during the trial. The article says he served as a 1LT Field Artillery Forward Observer from Jun to Dec 1970 in Nam and even has excerpts from his OER’s. Regardless of that, he still needs to walk the Green Mile and shake hands with Old Sparky.
Out of respect to the Viet Nam Veteran’s community, I will not call this killer a Viet Nam Veteran. He may have served in Viet Nam, but I won’t insult heroic Vietnam veterans like Roger Donlon and James Stockdale by associating him with them in ANY way, shape, or form.
While I appreciate the thought and sentiment, IF he’s a Vietnam Veteran, then he’s a Vietnam Veteran. We don’t have to hide the truth or revise history, as the Left does. What is unconscionable and altogether objectionable is the connecting of his decades-ago service (if any) to his murdering Deputy Dinkheller.

I hate hearing the PTSD “defense” that shitbirds like Brannanon use – he deserves what ever means of execution that the state of Georgia has for murder.

Senior, from what I read, Georgia’s current method of execution is by lethal injection. I guess he’d have to be in South Carolina, Tennessee or Florida to ride the lightning.

I would strip him of all benefits from the service and give him a retroactive DD. His name should be stricken from the book of life! I sure hope this animal never had children. If we are making suggestions on how to take care of this POS, mine is by firing squad, shooting him in the same places, with the same caliber and the same amount of rounds as he used on the DS.

I remember reading a news report MANY years ago about a decorated Viet Nam combat veteran being executed in Nevada.
He REFUSED to allow his decoration (a Bronze Star) or his war record to be used as a defense for his crime.
I just now read the full WASHINGTON POST news report.
According to that report, Andrew H. Brannanon is a genuine, officially documented combat veteran of the Viet Nam War, where he was a commissioned officer and forward artillery observer in the United States Army, serving there at the same time I was.
Further, he was diagnosed, and repeatedly hospitalized by the Veterans Administration for both Post Traumatic Stress Disorder and Bi-Polar Disorder, YEARS prior to this murder.
But, guys I’ve known who had PTSD symptoms generally AVOID hostile confrontations.
And, as one commenter pointed out, Andrew H. Brannanon obviously KNEW what he did was a crime, because he fled the scene.
I wonder why the deputy sheriff didn’t take cover and open fire on Andrew H. Brannanon earlier, before Andrew H. Brannanon began firing with his weapon?
And who is that other individual in the cab of the pickup truck, and what’s their story?
I don’t give a shit if he was at Gettysburg or crossed the Potomac with Washington. If he gets special treatment because of PTSD then he was impaired by it to the extent he should not have had a weapon. If people will not be held fully accountable for the actions because of PTSD then they are too impaired to own a gun. You cant have it both ways.
Cause of Death: Bullet through the right eye. He walked up to this critically wounded officer, stood over him, pointed a rifle at his head and blew his brains out.
He does not deserve to go to sleep with a needle. We used to celebrate killing people like this by drinking a toast out of their skull after we killed them. Ahhh….the good ole days.

Hopefully it will take 45 minutes to kill this waste of a human being. He gave up all rights to claim any military status and disabilities the moment he murdered Deputy Kyle Dinkheller.
Now then, I agree that every one deserves a fair and just trial, but the video evidence above proves Brannanon killed this deputy in cold blood, why the hell are there all these appeals costing US millions? How about the lawyers that are trying to save his worthless ass be made to pay for them.
I remember when my dad was a Judge and he told me that it costs much less to keep a pile of excreta like Brannanon locked up for life sans parole than it does to execute them thanks to the bargeloads of legal fees and court costs during the appeals process.
Who else do we know that is so quick to tell everyone how much of a real deal Vietnam Vet he is? They kind of look similar too.
This morning at 9 o’clock the Georgia State Board of Pardons and Paroles convened the killer’s final state appeal–and no decision has yet been published. The board is empowered to grant clemency, changing execution to life w/o parole. It’s a five-member panel, a simple majority controls, and each vote is confidential. I find it curious that the decision remains unpublished–if, indeed, a decision was rendered. The killer’s date with death is tomorrow at 7 p.m.
UPDATE: The Georgia State Board of Pardons and Paroles voted this evening to DENY the appeal of Deputy Dinkheller’s killer. The only thing that is legally left for the killer to avoid death tomorrow evening is an emergency appeal to the US Supreme Court.
