Dan Choi still on trial
Chief Tango sends us a link to the news that Dan Choi, former lieutenant who once punched a platoon sergeant in the chest and couldn’t get promoted past 1st lieutenant after years in the Army and the Guard is still going through the process of being tried for handcuffing himself to the White House fence three times in 2010, while wearing his uniform after he was discharged. And of course, he says it’s not his fault, that it’s some grand scheme to keep him out of the military. From Scoop;
Three years after Choi’s handcuffing protests, the US Federal Attorney’s Office refuses to dismiss the charges against him. The prosecution is being pursued by Assistant US Attorney, Angela S. George.
Generally, White House protestors are arrested and required to pay $100 fine to a municipal court, the equivalent of a parking ticket in the District of Columbia. Instead, in this case, the US Attorney’s Office is invoking a seldom-used federal level criminal charge called “Failure to Obey”.
Lt Choi retorts:
“The charge is baseless. It assumes traffic was blocked, but there is no traffic to block on 1600 Pennsylvania Avenue. The main reason for this charge is to prevent me from re-joining the military, to paint me as simply disobedient. It prevents my rejoining (the military) in a vindictive waste of resources. I stand trial to assert my rights and the rights of all to be treated equally under the law.”
Yeah, well, anyone who has been at the White House knows that the Park Police keep folks moving, especially during protests and rallies. Handcuffing yourself to the fence kind of impedes “moving along” and he did it three times. Even when I was just at the White House to photograph the filthy hippies, I was told to keep moving…and I did.
Of course, he’s a big drama queen, and wants people to think he’s being treated differently, but, ya know, it’s about time that these judges and prosecutors started punishing these protesters instead of letting them be criminals with no repercussions.
ADDED: By the way, Choi refused a plea deal two years ago – I just remembered that.

He punched an E-7 in the chest, he spent six years as a lieutenant, he was offered a plea deal in this case and turned it down and now he’s complaining that no one is letting him go free. If that picture of him being dragged down the street like a child in his uniform doesn’t piss you off, I doubt you were ever in uniform yourself. And since you said you were leaving, I helped you keep your word.

ArtySgtq: His rights are not being violated here. No one has a right to chain themselves to the White House fence. Not you, not me, not anybody. This man is a professional crybaby. He won his silly crusade to repeal DADT, which was a perfectly fine policy, and he’s still whining. He should never be let back in. He’s undisciplined and he has a track record of disobeying orders and assaulting people. He has psychological issues out in the yin-yang. He doesn’t deserve a commission in the US military.

Also, if that picture is of (La) Choi, isn’t he wearing the wrong belt with his ACU’s? I thought that the only belt authorized is a tan rigger’s belt…..oh well. As for the rest his asshattery, punching a PSG isn’t going to endear you to your fellow soldiers. I was just appointed a PL and know that my PSG and squad leaders are critical to my success as an officer.
After Punching a PSG in the chest I am surprised he still has any teeth !!
@9: Either the PSG was so stunned that an Officer punched him that he didn’t bother reacting, or there were enough people to hold him back from administering a curb stomping.

You ain’t lyin’. Most E-7’s I know would have cleaned his clock. I remember reading about this guy before but can’t remember if he received any punishment for that assault. It is funny seeing him get dragged down the street though. He should be denied re-entry into the Army just based on that picture alone. Definitely bringing discredit to the uniform and isn’t there a regulation against wearing a uniform to a protest or political demonstration? He should have left well enough alone and taken the plea deal he was offered. Now, all of his stupidity will be part of the public record!

As I recall LT Choi also refused to deploy with his unit to Iraq. I think this guy’s been taking crazy pills for years. He “probably” got into West Point with recommendation from Shinseki and no one there wanted to kick him out because he was linked to a 4-star. Not saying it is true, but I wouldn’t be surprised.
Maybe he was pissed, so locked himself to the fence because being a West Pointer and from Hawaii like Shinseki, “Barry” (As he was called at Punahou) was supposed to give him a high paying high level job where he didn’t have to do anything but complain about how things suck in his department?

I hadn’t heard that. I just remember something about him refusing to deploy due to ‘moral disagreements’ with the war or something.
I strongly feel that anyone who has the complete disrespect for their soldiers and NCO’s as to actually strike one of them needs to be out on their ass, BCD. No appeals, no nothing.

I was always taught from the time I was a butterbar, that the men come first. Eat first, sleep first, R&R first. Make sure you’re the first in the field and the last to leave. Give em a task and the tools to do it and get the hell out of their way, and my personal favorite, “LT, if you don’t know what’s going on, as your enlisted leadership, that’s what they are there for, to guide your decision making”

It matters not one’s political persuasion or anything else – whoever defiles the uniform should be “rewarded” appropriately for it. Not being allowed to reenlist is a no brainer. No conspiracy needed.

What rights are being violated? He committed assault while in the military and then proceeded to wear a uniform improperly while committing a crime in Washington DC and was arrested while doing so.
It sounds like he is getting the right of due process because he will now have his day in court to explain the high degree of asshattery he initiated.
Disgraceful actions in violation of the law result in legal difficulties. The individual created his own problems and has apparently refused to deal with them in an appropriate manner, now he can reap the benefits of those actions through the legal system.
This is not a sterling example of character. His being gay is irrelevant, we are not allowed to strike those we don’t like in the military, nor are we allowed to chain ourselves to fences in front of the white house. Officers are supposed to have the necessary intelligence to understand these things and the self discipline to follow the appropriate course. Choi has neither, and deserves no more respect than any other common petty criminal.
