Hasan wants death penalty off table
The Fort Hood murderer, Nidal Hasan says he wants to plead guilty to 13 counts of murder, but Army rules don’t allow a judge to accept a guilty plea in a capital case, so his lawyers want the newest judge to consider removing the death penalty from her little bag of tools, according to the Associated Press;
If the death sentence is removed, Hasan’s punishment would be life without parole – which he already faces if convicted of the 32 counts of attempted premeditated murder in the 2009 attack on the Texas Army post.
The date for his long-delayed trial has not been set, but pretrial hearings are scheduled Wednesday through Friday so the new military judge, Col. Tara Osborn, can reconsider several defense requests previously rejected by the former judge.
Although I oppose the death penalty mostly, Hasan certainly deserves it more than most criminals. However, the Army hasn’t put anyone to death since John Bennet was hanged in 1961 for the rape and attempted murder of an 11-year-old Austrian girl. The last soldier who was ordered executed was Ronald Gray who was convicted of two murders, his death warrant was signed by President GW Bush, but his sentence was stayed. There are five other people currently on death row, and it’s not very likely that Hasan will join them anyway, and he certainly won’t live long enough to execute him. I say throw out the death penalty and let him rot in his adult diapers in a cell somewhere – he ain’t going no where.

Have to disagree, Jonn. What Hassan did is far worse than what any of the other 5 awaiting execution did (with the possible exception of Akbar). He richly deserves an early opportunity to meet Shaytan.
I don’t see the additional cost being significantly greater if we try him with the death penalty on the table, either. And I really hate the idea of giving in to terrorists in any way. Taking the death penalty off the table would IMO be doing that.
Don’t suppose the SCOTUS would approve an air-drop w/o parachute into the Kilauea crater as an acceptable method of execution, though.

While I, too, am not a big proponent of the death penalty, for many reasons, in this case i think it should most definitely be not only on the table, but slapping him in the mug. Some people just need killin’.
Political correctness has consumed the military judicial system as well as the civilian courts. These bed wetters will give him life without parole. Waste of time, waste of resources and waste of money.

Because of his condition, someone has to feed him, wash him, and wipe his nasty ass for the rest of the time he wastes air. I don’t care what Hasan wants; the people who have to look that slime in the face every day need to be relieved of that indignity, that insult forced upon them by their current duty. Where’s the doubt about his crime? This has taken way too long and justice for the victims has been completely denied.

Now, having said that, I well appreciate that he deserved to be punished here and for etenity for what he did. The question is whether death exacts that punishment. If he pleaded to die, would you all agree that he should? Or would you say, “Screw him. Make him suffer locked away in prison.” The worst punishment on earth is being isolated from fellow human beings and isolated he would be. Yes, it would cost large sums to keep him but sometimes it’s worth it. Hell, look at the imprisonment of Nazi war criminals following WW II. What did they end up with? One guy in an entire prison.

Fair question. My answer might well be “Screw him. Make him suffer locked away in prison.” I don’t see any real contradiction in that. I just don’t think he should ever get anything he wants again.
However, if he does serve life, he should be on a strict diet of bacon, pork loins, pork sausage, etc for the duration of his incarceration.
I’d rather he be hanged but, if not, put him in a cell with Manning and make Manning wipe his ass for the rest of their lives.

I’m for death as well. If they give in to his demand, what else will they give in to as time goes by? Will he eventually request certain rights for “good behavior?” Access to a computer, for example? Or perhaps he’ll want to write a book about his decision to kill innocents? You know some publishing agency would nab that in a heartbeat for its sensational content. Hasan is a dedicated coward. If he weren’t, he would not want the death penalty eliminated. A true jihadist would beg for it. It is martyrdom.
Since he doesn’t want it, the sentence could be something much more creative, such as: life without parole, beans w/mystery meat three times a day, and no one to feed him, clean up after him, talk to him, or even see him for as long as he manages to stay alive (complete solitary, no human contact, no TV, radio, or music). Nothing to read except the document with his sentence printed on it.

To have a sentence there has to be a trial, and I’ll be shocked if we get even that much. It’s pretty obvious that nobody wants to end up holding this political/religious hot potato. A death penalty would be that much worse, because it will bring every activist with an agenda out of the woodwork.

It has been three years, two months, and 13 days since the initial charge was filed against Hasan. The wheels of justice turn slowly but they are likely to rot before the SOB is ever tried.

My knee jerk reaction is simple: if he wants it, deny it. On the other hand, this could just be another legal manuever. If delaying is what the defense was aiming for, so far it’s working.
