New York surrenders to emotion

So, the New York legislature is expected to shoved their new gun ban through the legislative process today, turning some New Yorkers into criminals overnight. Why the rush? Well, the governor, the legacy Cuomo, said it’s because he wanted to beat the panic buying of legal stuff – well, stuff that is legal today, but not tomorrow. From Huffington Post, some highlights of the legislation;

Under current state law, assault weapons are defined by having two “military rifle” features, such as folding stock, muzzle flash suppressor or bayonet mount. The proposal would reduce that to one feature, including the popular pistol grip. The language specifically targeted the military-style rifle used in the Newtown shootings.

Current owners of those guns will have to register them.

None of those things make a weapon more lethal, just more scary-looking to hand-wringing liberal do-gooders.

Private sales of assault weapons to someone other than an immediate family would be subject to a background check through a dealer. New Yorkers also would be barred from buying assault weapons over the Internet, and failing to safely store a weapon could lead to a misdemeanor charge.

I’m sure the criminals will only sell their guns on the street after a thorough background check. the background checks that are in effect now didn’t stop Dawn Nygun from buying the weapon that she gave to William Spengler in Webster, NY.

Ammunition magazines would be restricted to seven bullets, from the current 10, and current owners of higher-capacity magazines would have a year to sell them out of state. An owner caught at home with eight or more bullets in a magazine could face a misdemeanor charge.

So, I guess now the police can search your house for a magazine with more than seven rounds capability. And a rifle that still fires from a seven round magazine can kill just as easily as one that has ten rounds.

Stores that sell ammunition will have to register with the state, run background checks on buyers of bullets and keep an electronic database of bullet sales.

So, since there are no serial numbers on bullets, we can reasonably expect that this is just to keep track of people who buy a large quantity of ammunition. And what magic number will trigger an investigation? 100? 101?

In another provision, a therapist who believes a mental health patient made a credible threat to use a gun illegally would be required to report it to a mental health director who would have to notify the state. A patient’s gun could be taken from him or her.

Has there ever been a crazed murderer who made a credible threat to a mental health professional who wasn’t reported and later went on a killing spree? Even crazed murderers have enough sense to keep their mouths shut.

The legislation also increases sentences for gun crimes including the shooting of a first responder that Cuomo called the “Webster provision.”

Yeah, there was an increased sentence imposed in 1995. Killing a first responder was in New York’s death sentence provisions signed by Governor Pataki. Seven people were sentenced to death in New York since then and none of them were put to death. Cuomo’s predecessor dismantled New York’s death chamber.

My cousin, who lives in New York emailed this morning that he’s sorry that he didn’t leave New York when I left nearly 15 years ago. Well, Scott, there’s still time. He can leave with the Remington Arms Company, currently headquartered in Ilion, New York, just down the Hudson River from Albany. It’s been there since 1816, but maybe not much longer. from the Herkimer Telegram;

The factory directly employs more than 1,200 residents and their production supports more than 1,500 full-time jobs….

How much does Governor Cuomo care about those overnearly 3,000 people who depends on those scare paychecks in Upstate New York? From YNN;

“I think if the companies are worried about future sales of assault weapons, they’re gonna have to worry about a lot of other things besides the State of New York and the State of New York’s market,” Governor Andrew Cuomo said.

Because emotional knee-jerk reactions are more important than jobs to the Cuomo family.

One thing here amongst the garbage that caught my eye in particular was the therapist reporting you as dangerous I guess and having your guns taken. I went out with a psycho therapist once and I do mean psycho. I met a number of her colleagues in a couple of states. Such a bunch of leftest crazies i have never met outside of a Che Convention. When we ended our relationship she threatened to have me involuntarily committed for 72hrs and have my firearms seized to “keep me safe” which is a favorite tactic of these manipulative freaks. I said “great, then you have 3 days to catch a ship to the fucking moon because there will be no place on Earth you can hide from me when I get out.” Giving these pseudo shrinks the right to take away a Constitutional Right is way way dangerous.

@41: I hear ya barking, big dog. That’s why I want to know what the “experts”, who claim they aren’t taking away 2nd Amendment rights, have to say. Illinois still hasn’t complied with the courts order in removing a gun law there that goes against the Constitution. They were given a few months to comply and so far, they haven’t. The politicians are counting on a populace that isn’t interested enough in the Constitution to bother seeing how their freedoms are being eroded, until it’s something that they care about and by then, it will be too late.

I read that Ed Meese has stated that if Obama tries to circumvent congress involving the 2nd Amendment, that he can be impeached. Yeah, like THAT will ever go anywhere with Dingy Harry as senate majority leader.

@52. The decision was issued last month (11 December) and the 7th Circuit Court of Appeals gave Illinois six months to comply. That compliance is to be a new gun law that imposes reasonable restrictions and limitations on carrying a weapon outside one’s home. If the state does not craft a new law, then there will be NO RESTRICTIONS because the 7th Circuit ruled the blanket prohibition to be unconstitutional. So, you can bet Illinois will comply. Woof! Woof!

So, it seems the bill passed.
I own a Remington 7600. It’s a pump-action rifle with a five-round magazine chambered for 30-06. Because mine was modified previously to my purchase from the gun store, it has a pistol grip and a folding metal stock that turns it into the best little trail rifle I’ve ever used.

Thanks to the New York bill, my pump-action rifle is now a scary “assault rifle”.

New York can go screw themselves.

@54: LOL!! Yeah, the last I read on it, Illinois was talking about appealing the decision (to who, I have no idea, since the SCOTUS will probably not be their friend). I think they will stall as long as possible and then craft some other nonsense and have that go through the courts as well, wasting more time and money.

New York didn’t surrender to emotion. Andrew Cuomo made a political maneuver to position himself as Progressive while retaining the loyalty of traditional Democrats.

This was done to ensure Governor O’Malley of Maryland was second – a Martin-come-lately.

This is about the Presidential campaign of 2016, and getting Bloomberg’s guarantee to fund the primary.

Old Trooper, I believe Illinois is appealing to the full panel of the 7th Circuit Court of Appeals. I do believe that the libs in Illinois think they can run out the clock, and that Owebowma will issue enough EO’s to negate whatever the courts will say. It will be very interesting to see whether the number of street shootings and robberies w/ firearm plummet during the full period that the blanket prohibtion against carrying is in effect. Similarly, it will be interesting to see whether the number of incidents of self-defense using firearms drops. Of course, the numbers depend on honest reporting of these things and, when it comes to looking for honesty from Chicago city government, it’s probably easier to find a virgin working in a whorehouse.

Tell Remington to relocate to Michigan. The old GM Willow Run plant (formerly Ford, at one time made B-24 Liberators) is for sale here in Ypsilanti, and I am sure folks would love the work. Not to mention, my property value might actually increase…

I’m wondering what hoops the reloaders will have to jump through – the downstate legislative yahoos may not even know what that is. Amazingly enough all of the politicians in my area (R and D) voted against the new law. Oh well, PA is looking mighty good now and is only about 10 minutes away. I always thought the folks that wanted to cut off the top 2/3 of the state and form a new one were a little nuts, but now I’m not so sure…

“We need to pass the law before we can read it.” Yet again, the only applicable law is the one dealing with unintended consequences. As it currently stands, the recently passed New York weapons legislation includes law enforcement in the seven round magazine ban legislation. One of the comments in the linked article asks why if a seven round magazine is all that a civilian needs, why would the police need a fifteen round magazine. Check, mate!
