Federal judge dismisses cases against James Comey and Letitia James

Cameron McGowan Currie, a federal district judge, dismissed the criminal cases against James Comey and Letitia James, arguing that the appointment of the U.S. attorney pushing these cases was “illegal.” The charges were dismissed without prejudice, so the administration can press the charges again once they have an attorney who meets Currie’s requirements. The Justice Department plans to appeal this ruling.

A federal judge on Monday dismissed the criminal cases against former FBI Director James Comey and New York Attorney General Letitia James on the grounds that the appointment of the U.S. attorney who brought the indictments was invalid.

The judge dismissed the charges without prejudice, meaning the cases could potentially be refiled by an appropriately appointed U.S. attorney.

U.S. District Judge Cameron McGowan Currie concluded that the appointment of Interim U.S. Attorney Lindsey Halligan was unconstitutional and that her actions bringing the case were “unlawful” and “ineffective.”

“Because Ms. Halligan had no lawful authority to present the indictment, I will grant Mr. Comey’s motion and dismiss the indictment without prejudice,” she wrote.

Halligan, President Donald Trump’s handpicked U.S. attorney for the Eastern District of Virginia, sought the indictment of Comey and James over the objections of career prosecutors after Trump forced out previous U.S. attorney Erik Siebert who sources said had resisted bringing the cases.

Halligan, who had no experience as a prosecutor, sought the indictment after Trump, in a social media post, called on Attorney General Pam Bondi to act “NOW!!!” to prosecute Comey, James and Rep. Adam Schiff.

White House press secretary Karoline Leavitt told reporters following the decision that the Justice Department would be appealing the ruling “very soon.”

“It is our position that Lindsey Halligan is extremely qualified for this position, but more importantly, was legally appointed to it,” Leavitt said.

Comey pleaded not guilty in October to one count of false statements and one count of obstruction of a congressional proceeding related to his testimony before the Senate Judiciary Committee in 2020, amid what critics call Trump’s campaign of retribution against his perceived political foes.

Vice President JD Vance has said any such prosecutions are “driven by law and not by politics.”

Judge Furry probably has no connection to the case, and is only doing this to flex muscles he doesn’t have.
Since when did all of these district judges get all of this control over the DOJ, the Executive Branch, and pretty much all of the will of the people?

You do realize that these cases are all federal, right? Hence federal judges do have the authority to render decisions on motions made in the cases they hear.

I’m only hoping this is part of the 5D chess that is going to out these activist judges all over the country whereas (as to) they can be readily identified and then impeached or dragged out of courts to the gulags for a nice spa and vacation sos they can get their minds straight before being re-deployed in the service of our great Nation as barristas or fries or bus/dish or garbage truck assistants or even RN candy striper bedpan assistant managers in training.

Reading the decision, it is based on a fairly narrow interpretation of the relevant US Code, that Bondi over-stepped her authority on appointing a second temporary prosecutor (should have been done by a District Court.) And since the temporary prosecutor was the ONLY one who presented to the grand jury and had the only name on the indictments, if an illegal appointee the indictments were also illegitimate. Notice however that the judge did NOT bar refiling the indictments, just said that because the temporary prosecutor should not have been appointed, whatever they did should not have happened. Had the administration belt-and-suspendered the case with a second attorney, the indictments would still stand.
That’s just a layman’s reading – if I’m factually wrong anywhere, let me know.

Comey, by his own admissions to the media and in his book, is guilty; he gave classified info to his buddy so he could transmit it to the New Yawk Slimes. Then he lied about it to Congress.

Nothing to see here, please keep moving. Yeah, I knew this was going to happen. Some idiot, left-wing judge would intervene, or they both would get off with extremely light punishment if convicted. But Orange Man Bad, he’s guilty of everything. Hell, climate change is his fault, big time.

A bit of good news for the Orange Man Bad came out today from Georgia. The new prosecutor that replaced Big Fanny, the disqualified DA, determined the election and RICO case against Trump was meritless and too expensive to prosecute. Thus, he moved to have the case dismissed. The judge dismissed the entire case against all the defendants, including Trump’s attorneys, with prejudice. This lawfare atrocity is now dead.
