A federal court blocks CDL restrictions for illegal aliens
A federal court prevented the Trump administration from keeping illegal aliens from getting commercial driver’s licenses. The court argued that the administration did not abide by proper procedures when it came to creating these restrictions. The court also argued that the Trump administration did not explain how these restrictions would promote safety.

Duffy’s remarks come after a federal appeals court in Washington, D.C., ruled last Thursday that the Department of Transportation’s (DOT) restrictions on immigrants obtaining commercial driver’s licenses cannot be enforced.
Such restrictions were announced in September, after illegal immigrant truck driver Harjinder Singh was accused of causing a tractor-trailer crash that killed three people in Fort Pierce, Florida.
The court found that the federal government did not follow proper procedure when creating the new rule, or explain how the rule would promote safety. They also noted that Federal Motor Carrier Safety Administration data shows about 5% of all commercial driver’s licenses belong to immigrants, though they only account for about 0.2% of fatal crashes.
Duffy attributed much of the blame to the Biden administration, which he said allowed millions of illegal immigrants to enter, granted them work authorizations and then let them seek CDLs.
“People are dying,” he said.
“And we thought it was appropriate to protect Americans and we should have an emergency rule, not to go through the month-long process. We did that. The court has rolled us back and said, ‘Well, we’re not quite sure this is an emergency. We want to see more data.’ And I’m like… ‘Watch any show on television, and you’ll see the risk to the American people.'”

Even if the “only five percent of CDLs are immigrants”(assuming illegal here) or only constitute 0.02 percent of fatal crashes, neither of those should be happening at all and both are entirely preventable. So prevent them, judge.
How can the judge not see how a dude who can’t read, write, or speak English and doesn’t understand street signs is inherently unsafe?
Next time a loss of life happens on the road, how about arresting said Judge. The judge should be charged with what the truck driver is charged with. Same as a holdup perp kills someone in a robbery, his/hers partner gets the same charges. What do you retired LEO’s think…
Or add him to the list of folks getting the pants sued off of them. For a small reduction in settlement monies, have him turn in his law license, resign his position from any bench or circuit, and permanent ban from anything law related.
If he refuses the above, spend him into oblivion defending himself.

The big difference is that you do not have a constitutionally protected right to a drivers’ license.
Sure, I am contending that nobody in America should die from being hit by an illegal alien with a CDL. That’s a far cry from saying no American should have a CDL to prevent illegals from killing Americans, which is the actual equivalent to the gun controllers’ logic. Not at all similar.
I think I didn’t express myself well here, as I wasn’t disagreeing with your post.
What I was trying to say was that for D.C. judicial logical consistency, the same logic used to deny rights en masse to gun owners should be used to deny CDLs to immigrants, even if only one life is saved.
Or put another way, blanket federal restrictions are the cat’s ass when they’re in support of leftist causes but government overreach when the Trump admin supports them. Even when said “government overreach” is actually fully within the authority of the executive branch.

49 CFR Section 391.11(b)(2) stipulates that commercial motor vehicle drivers must read and speak English sufficiently to converse, understand highway traffic signs and signals in English, respond to official inquiries, and make entries on reports and records.
The FMCSA reported that Singh failed an English language proficiency assessment after the crash, and he identified only one of 4 highway traffic signs.

I don’t care if you’re a citizen or not. If you can’t read, write, or speak English, you do not get a driver’s license, let alone a CDL.
Active duty military and family members in Japan had to go to a class and take a written test before we were allowed to drive. As I recall, the test was mostly about reading traffic signs. I didn’t drive in Korea so I have no idea as to the requirements. In Bahrain, Saudi Arabia, and Surinam no one asked, so we drove. It was understood that fluency was not required; however, get into a collision, crash, or speed trap, it was your ass.
I have heard folks here in the PR of California proclaim denying immigrants CDL’s is racist. Perhaps, if the DMV and CHiP required judges to ride along with the immigrants it wouldn’t be racist. Just as we GI’s in Asia would dare each other to get in the front seat of the taxi, I would dare the judges to get in the front seat of a tractor-trailer. I-5 in CA reminds me of the figure eight race track at the county fair.
I had to take those tests in Korea and Germany. Denying a CDL to an immigrant who cannot pass the test is no more racist than denying it to a white American citizen who cannot pass the test. Race card denied.

An illegal aliens has no right to a driver’s license, period. An illegal alien has no right to employment. The illegal must be denied the DL as well as employment and deported. The appeals court is ignoring the law that is inconvenient to it’s political leanings.

The demonrats who run the PR of California have said granting illegals drivers’ licenses make things safer. The demonrats determined the illegals couldn’t get insurance without a driver’s license, so to their logic, a license means insurance which means safer roads. So to that logic, the reason I spent almost a week in the hospital wasn’t because the other driver ran the stop sign; it was because she didn’t have insurance.

When I was a kid you couldn’t enroll your kid in school or get a driver’s license if you were here illegally because you’d get found out and deported. Left/libtards think that needed to be changed.
In most states, all the illegals have to do is check or not check a box attesting to their citizenship and they are automatically registered to vote with motor-voter. Then in states with mail in ballots for all like Commiefornia, every name on the voter roll gets mailed a ballot. Ballot harvesters then go to the D-rat registered residences and collect the ballots. They fill out any blank ones so the D-rats get the votes. This is why they license illegals.

Part of the problem is that some of these third-party CDL driving test examiners are pretty close to the employer’s of these guys taking the driving test. No concrete evidence to prove it, just from what I’ve heard from my organization’s CDL training coordinator.

Exactly! There’s no way they memorized all of the English words for what you have to inspect on the pre-trip checklist (i.e., tie rod, air compressor bolts, etc)
For God’s sake, if the Libs are going to keep allowing this crap at least put huge placards fore and aft of the vehicle stating something like this, “I’m a DEI hire, can’t speak or read English and have not been properly trained, so stay back a minimum of 500 feet.”
