The Trump administration received good news in the form of the US Supreme Court’s issuing a temporary stay on national injunctions. The Supreme Court is currently considering a challenge against President Donald Trump’s executive order regarding birthright citizenship. The ruling does not take away from those involved in the birthright citizenship related lawsuit. Those who support these nationwide injunctions claim that they are a necessary step against potentially unlawful actions and to prevent harm.

Friday’s decision is a boost for Trump in his crusade against nationwide injunctions that have blocked some of the executive actions he’s taken so far in his second term.

Supporters of nationwide injunctions say they serve as an essential check to potentially unlawful conduct and prevent widespread harm. Critics say they give too much authority to individual judges and incentivize plaintiffs to try to evade random assignment and file in jurisdictions with judges who may be sympathetic to their point of view.

Justice Sonia Sotomayor read her dissent aloud from the bench, criticizing the court’s majority.

“No right is safe in the new legal regime the Court creates,” Sotomayor wrote. “Today, the threat is to birthright citizenship. Tomorrow, a different administration may try to seize firearms from lawabiding citizens or prevent people of certain faiths from gathering to worship.”

“The majority holds that, absent cumbersome class-action litigation, courts cannot completely enjoin even such plainly unlawful policies unless doing so is necessary to afford the formal parties complete relief,” she added. “That holding renders constitutional guarantees meaningful in name only for any individuals who are not parties to a lawsuit. Because I will not be complicit in so grave an attack on our system of law, I dissent.”

He is ruling by decree like a king despite having a Congressional majority because he does not believe in three coequal branches of government and has explicitly said so multiple times. He also does not support due process for American citizens. He said that as well. Saying “I’m not a lawyer.”

He also has explicitly said he doesn’t support or defend the constitution.

It was in his fucking oath. And he doesn’t know.

He also doesn’t support the second Amendment. He said that early on as well and proved that again this month. He only pretends to support it because he got backlash when he said he didn’t early on.

He’ll cite some illegal alien that was subject to a deportation order, ignoring the fact that person was subject to an immigration judge’s deportation order. That judge’s review is all the due process an illegal gets under the federal immigration statutes.

You obviously didn’t read the whole opinion and wrote your comment based on whatever inaccurate interpretation the left is putting out there.

The blue states who brought this to the attention of the SCOTUS got slapped down because (1) they don’t understand how the Constitution and the laws derived from it work and (2) liberals don’t understand that Congress has never granted the judiciary broad authority to issue injunctions or decisions that are as broad as the ones challenged in the case brought before the court.

The term “stayed” refers to a court order that temporarily halts a legal proceeding or the enforcement of a judgment, so your notion that Trump’s decrees will be “stayed” in blue states but not red ones isn’t only preposterous, it’s out of context.

Also that quote is out of context and a misquote. Trump was asked about illegals and their rights under the Constitution in reference to the question. He said he didn’t know about it but would do whatever the SCOTUS ruled.

I am uncertain of the situation at the moment, but it seems to me it was a question of how to enforce a particular portion of immigration law. As I recall I wasn’t sure MYSELF about how to interpret the law in question, and I took an oath to defend the Constitution long before Mr Trump did.
What he said was the honest truth…he wasn’t quite sure in that situation and needed clarification. I find that to be refreshing coming from a President, rather than the usual bad tap-dancing we get from presidents of the democrat or Republican party.
So, if you are going to offer evidence, PLEASE make sure it’s not so easily refuted.

What this means is when Trump rules be decree, which he has been doing by issuing executive orders (more executive orders in four months than Biden or Obama issued in four years)…the only places that his rulings will be stayed are in places fighting back. Overwhelmingly blue states.

So blue states will be holding the line on basic constitutional rights like birthright citizenship, or DHS raiding you homes without a warrant, or Deputized contractors in civilian clothes and masks wearing Amazon bought tactical gear and no agency identification detaining civilians with no probable cause or even reasonable disposals…

There will often be stays on this kind of behavior in blue states. But in red states it will keep happening.

Because red states will just accept whatever the federal government dictates. While blue states will sue.

And Trump has repeatedly made us explicitly clear he does not need to follow the constitution. Or even defend it. He has even literally said so many times.

He also doesn’t respect the 2nd Amendment.

He has made that clear and only backed off and pretended to be pro2A to win elections.

This is not accurate. Blue States won’t be able to stay, nor Red States just go along. The ruling is Judges are no longer able to have nationwide jurisdiction. Judges are only able to rule on the matter before them for that individual. The fact is judicial shopping on both sides is done, and nationwide injunctions are invalid.

This article reads slightly weird. SCOTUS has banned nation-wide injunctions, not temporarily stayed them. The ruling considering birthright citizenship is still being considered. Judges from now on can only impact those they have jurisdiction over and have filed a petition with the court.
