Growing pressure to enforce law prohibiting picketing the justices’ homes

Although the left believes that it’s a good idea to picket outside of the homes of the justices, federal law prohibits them from doing so. Merrick Garland is facing pressure to enforce this law. The left sees this as a first amendment issue; however, Bill Barr argues that protests are subject to reasonable restrictions.

From Fox News:

Former Trump administration Attorney General Bill Barr told Fox News Digital that the “law is crystal clear” and that “protests at a judge’s residence to influence a judge is a federal crime, and the law should be enforced.”

“The Administration’s talking point that it supports the First Amendment is a non-answer,” Barr said in an email. “The right to protest has always been subject to reasonable ‘time, place, and manner’ restrictions, like the federal law prohibiting demonstrations outside a judge’s residence.”

“Demonstrations in violation of the statute are not legitimate First Amendment activity,” he continued.

Conservative legal group Judicial Crisis Network concurred with the former attorney general, telling Fox News Digital that the protests are illegal and that picketing outside of justices’ residents can potentially affect the impartiality of the court.

“The relevant federal statute prohibits pickets and parades in front of a judge’s home, including for the purpose of influencing a judge,” Judicial Crisis Network executive director Carrie Severino told Fox News Digital. “I would love to know why Merrick Garland is refusing to enforce this law as protesters continue to gather at the justices’ private residences — especially after the apparent attempted assassination of Justice Kavanaugh.”

The DOJ’s response to the protests at justices’ homes has drawn attention on Capitol Hill as well.

Sen. Tom Cotton, R-Ark., blasted Garland as “a partisan hack who should resign in disgrace for dereliction of duty.”

“A Democratic hitman tried to murder Justice Kavanaugh and his family. On the same day, left-wing street militias announced publicly they would picket his residence and the homes of other conservative justices,” Cotton told Fox News Digital. “This act of intimidation is a clear violation of federal law and Merrick Garland has done nothing.”

I recall seeing an article not too long ago stating that picketing and protesting outside of anyone’s home is illegal in VA, where I understand most of the supremes live. Garland is enforcing federal law exactly the same way that liberal/progressive cities enforce their laws. They don’t.

Correct. If these were crowds of conservative/Republican protesters marching outside the homes of any of the three prog justices, the new American STASI (Fan Belt Inspectors) would already have them rounded up and facing over a year of pre-trial confinement.

Counselor, the primary question in ol’ Poe’s mind is why isn’t our less than esteemed Chief Justice speaking out in defense of his colleagues? Or for that matter, why aren’t the liberal justices defending their conservative brethren as they would expect were the roles reversed?

Taking it a step further, doesn’t the high court possess its own contempt powers that could be employed against DoJ officials, compelling them to enforce the laws? 🤔

Factoid: One does not need to be a licensed attorney or a judge to be appointed to the Supremes. The appointment provision of the Constitution is silent on any qualification requirements.

If he is convicted on all counts, he very well could end up with a sentence of over 40 years, which would be for life for him. But that would require that many sentences be served consecutively, rather than concurrently. He is simply trying to lawer his way out of the offenses that will get him the most prison time. He will likely try for dismissal of all the charges that will get him ten more years in the slammer as a condition to pleas to lesser crimes. The case has been divided into two separate trials. First up in July is the trial of all the crimes committed against his clients where he embezzled their settlement funds. Those include federal mail and wire fraud charges from his lies to clients about where is their money. The second trial is for all his federal tax fraud charges and his defrauding of several banks on loans he obtained. These also include more federal wire and mail fraud charges.

I should add that according to the LA Times, Avenatti’s 36 counts of crimes carry a total of 335 years of incarceration. So, he is terrified he will spend the rest of this life in federal prison, unless he can negotiate a plea deal where he has a hope of getting out of the pound before he turns 80.
