Why so many incidents happening on Martin Luther King Blvd? You’d think it was in a bad part of town, or somethin’.
“Stand Your Ground”, and “Castle Doctrine” laws are very misunderstood, and misreported.
All they have done is removed the requirement of the “Duty To Retreat”, and the need to prove that in a court of law.
Duty To Retreat is on the books in most states, and simply means that a person is required to retreat from a threat, no matter where that threat is [in public, or in the home] if it is safe to do so. In other words, if it is not possible to retreat, then you are justified to use deadly force to resist an assault that you reasonably believe will cause you death or great bodily harm.
Stand Your Ground simply states that, if you have a right to be where you are, and you have not instigated the confrontation, you do not have a duty to retreat, and a failure to do so cannot be used against you in court.
