Sailor Screwed by Biden’s BATFE. BP Meds first.

“Sailor Sentenced To 20 years In Prison For Selling Illegal Machine Guns In Virginia”

“A 28-year-old Navy master-at-arms was sentenced Tuesday to 20 years in prison for owning and selling unregistered machine guns from his Virginia home…”

Most of the responses were how stupid Tate Adamiak was for selling machine guns…. like the man says, stay tuned for the rest of the story.

Tate Adamiak was an E-6 hoping to become a SEAL officer when he ran afoul of Biden’s BATFE. His crime? He became a top seller of military parts and memorabilia on Gun Broker.

Nothing illegal. None of the  machine guns BATFE  alleged. One replica, that he did not even sell, was manufactured as a TOY and yet the agent, Jeffrey Bodell (who seems to have made Adamiak his Personal Mission in Life to prosecute) lied in court and manipulated evidence to send Mr. Adamiak to federal PMITA prison for 20 years. Think of that – 20 years for a toy…

Bodell went a bit crazy in his testing. He inserted a real machinegun bolt from a real STEN submachinegun and replaced the toy’s fake barrel with a real STEN barrel, which did not fit until the technician “wrapped it with a few layers of electrical tape to make a tight fit, and press fit the machinegun barrel.”

There was another problem: no real magazine would fit into the toy gun.“Due to the fashion in which I improvised a machinegun barrel to fit, a magazine cannot be inserted due to the barrel being too far aft,” Bodell wrote in his report.

Eventually, using the real machinegun bolt and barrel, Bodell was able to load one round by hand and get it to fire.

Among other things, Bodell alleged that semi-automatic guns were machine guns. And that a PPsH barrel shroud was a machine gun! And if you think that wasn’t bad enough –

The ATF’s first indictment charged Adamiak with possessing 33 machineguns. There were no destructive devices mentioned. To counter, Adamiak and his attorneys hired former ATF senior official Dan O’Kelly as a defense witness.

The prosecutors knew that O’Kelly would make mincemeat of their charges, so they reindicted Adamiak, charging him with possession of one machinegun and four destructive devices.

  • Count 5 concerned two inert RPGs, which were missing all of the parts to make them functional and had holes drilled directly into their chambers.

“My lawyers said that they were almost happy that I was charged with these RPGs because it was so ridiculous that it would damage the ATF’s creditability and made the jury question their logic,” Adamiak said. “Unfortunately, the ATF decided to take my inert RPGs to their lab, completely rebuild them with components off one of their own real RPGs and demonstrate that they would work by shooting a .30 caliber training round in a self-contained firing mechanism. They essentially inserted a bolt-action rifle into the tube that looks like a rocket, fired one shot, and then said it’s a destructive device.”

According to the articles, seems the Navy was on his side as well – they put him on leave until it ran out, then gave him an Honorable Discharge. Normally jail gets you UA and bad time, I read.

The US Attorney involved told a few whoppers as well:

  1. She claimed the down payment for Adamiak’s house were profits of illegal gun trafficking. Adamiak bought his house a year before he started his hobby business using his Navy pay.
  2. She claimed Gun broker was the dark web.
  3. She used his military training against him.
  4. She claimed he stole parts from the military, despite the fact that he had detailed records for every single part.
  5. She claimed his honest business strategy of buying low and selling for profit was “greed.”
  6. She attempted to make Adamiak look like a neo-Nazi because he had his grandfather’s WWII war trophies stored in his safe, some of which had German markings on them.

Special Assistant U.S. Attorney Victoria Liu and Former Assistant U.S. Attorney Bill Muhr prosecuted the case.

Historically, while pro-gun folks elected Trump, his actual track record on gun matters is weak. Remember the bump stock ban? That wasn’t under Biden – that was Trump’s BATFE.  Here is a conviction that NEEDS to be overturned. PO3 (hope I got that E-6 Navy stuff right?) Adamiak needs his record cleared and expunged, be reimbursed and receive compensatory damages …and some folks named Liu, Bodell, and Muhr need to be fired,  cuffed and perpwalked.
