End of an era

The Florida Record has noticed the legal wrangling that we experienced with Mr Daniel Bernath calling it “a bizarre case”. They don’t know the half of it.

In 2015, Bernath filed a copyright-infringement suit against Mark Cameron Seavey, later amending the complaint to include the infliction of emotional distress. Seavey, an inactive attorney and media specialist, blogger and reporter for the American Legion, answered that suit by filing a claim against Bernath alleging libel and defamation.

The American Legion interceded and filed a cross-complaint.

Bernath alleged that a blog run by Seavey illegally published photos belonging to him and that Seavey was part of a terrorist plot that tortured veterans and hosted child pornography on his blog.

Allegations against Bernath included making false claims about being a former U.S. Navy SEAL, posing as a U.S. Navy chief petty officer and engaging in a harassment campaign against Navy SEAL veterans who exposed him, including cyberstalking.

On Dec. 27, the U.S. District Court for the Middle District of Florida awarded Seavey $500,000, special damages of $135,000 and attorney fees of $195,000. The American Legion was awarded $300,000 in general and punitive damages. The total amount was approximately $1.3 million.

I don’t know who this Mark Cameron Seavey is, or what blog he runs, but I’d like to be his friend when Bernath’s estate settles with him.

I have observed the “fortunes” of disbarred attorneys for over 30 years. None of the ones I know about ended up well off after they had been disbarred for several years. One I am familiar with ended up dying in prison because drug dealing was the only way he could make a living after being disbarred. I doubt Birdbath left much of an estate. It is interesting that they mention the debris field as being 750ft long. The RV-12 is not a fast aircraft, so such an extended debris field seems to point to an in flight breakup.

After reading through some on the sport pilot blogs where he mentions ‘fixing’ control cable issues (to the horror of those in attendance), using his iPad to read back his landing speed, or bitching that his propeller was just sitting there and done cracked itself for no good reason, It would not surprise me in the least if something that he ‘fixed’ fell off in flight and that is what caused him to auger in.

I’m not a pilot but common sense and also having studied a few aircraft crashes, not to mention, being on a “bag and tag” (mortuary affairs additional duty) team for a B-1B crash in La Junta Colorado in 1987, it would seem that Danni boy probably didn’t auger in at a high angle and if he was flying “normally”, from the stats below, he was probably cruising about 120 mph.
If he was pretty straight and level and he decided to cut the engine or whatever, he’s going to start hitting the tops of those pines and other trees, it’s a pretty dense forest and that could/should/may explain the disintegration of the aircraft over a wide area.
I can only imagine that the wings go and then the rest of the tail and fuselage etc

Not sure about an in-flight breakup. From the linked NTSB report:

‘Flight control continuity was confirmed from all flight control surfaces to the cockpit controls.’

This wouldn’t be necessarily be true in the case of an in-flight breakup; flight control continuity would almost certainly be broken/disrupted.

It’s also significant to note that there was no reported post-crash fire.

According to Van’s Aircraft RV-12 Specifications (https://www.vansaircraft.com/public/rv12specs.htm), the RV-12 has a fuel capacity of 20 U.S. gallons. The linked NTSB report states that the aircraft was only airborne for approximately 14 minutes (1200 – 1214 EST), so assuming that the aircraft’s fuel tank was full at take-off, there’s no way that the full 20 gallons of fuel on board would have been consumed in only 14 minutes of flight (that is unless the aircraft had a massive fuel leak in flight). In an aircraft mishap of this nature, it’s highly likely that 20 gallons of relatively low flashpoint AVGAS splashed around the crash site would have ignited and led to a post-crash fire. The fact that no post-crash fire was reported may indicate that the aircraft’s fuel tank did not contain enough fuel to meet the requirements of the intended duration of flight, and subsequent engine fuel starvation due to inadequate fuel on board may have been a causal factor.

In addition, witnesses to the crash also reported in subsequent news reports that they didn’t hear the engine running; they only heard the impact of the aircraft into the trees.

It’s going to be interesting to see what the final NTSB report will say, but from my perspective there may already be some indicators as to what actually happened here.

I think I was reading the 750 foot debris field (for an aircraft with 117KPH Vne according the the POH) and thought it was a bit excessive. Maybe the cockpit was filled up with new subpoenas and court orders that just kind of blew around when he went in.

I suspect that the propeller just up and fell off the plane, unexpectedly, spinner hub, everything. Turned him into a glider pilot. If it was just a fuel issue you would have heard he chattering about it on the radio, quite a lit. The radar pings from the pre-mayday suggest an altitude increase, and then a heave up and a lurch down and then a cleat linear progression to the ground. It is also suggestive of a suicide, a event with much foreshadowing. If terms of the media, to get the correct data in circulation a multi-source timeline needs to be compiled and published on TAH, starting is some of the backgrounds of his service, where he grew up, domestic life and refusal to pay child support, and so on. Create an outline, the first entry is the day and place of his birth, then his military time, school time, and the various placed on Earth he shows up, not including his stolen valor shit, or various lawsuits, basically start with the bones first. Then hand on these be the work he did in various placed and at various points of his life, and list how it ended in terms of employment. Then go into his being blocked or disbarred an attorney, his attempt to take over his VFW post, the doctored up pictures both o the VFW website and other webstites, then hook to this the various CRIMINAL cases brought against him for stalking and for violating a protective order and flesh out the criminal cases with lots of links to PDF files of the actual case files. Then as the next to last step add in all of his lunatic, hairbrained civil lawsuits, and as the final step draw the read through, slowly stepping them through the jungle that was his life and his mind. Go slowly, take your time, but also post the basics upright way and add to it over time. On the map, east of Bonita Springs, it reads “CREW Flint Pen Strand”. Just right of that is an aircraft icon. Click on it and you’ll see that it’s N262WS. You’ll also see the airspeed and altitude fluctuating. Now zoom in on that icon.

In the upper right corner when the time gets to 12:14:20, you’ll see the airspeed drop to almost 0 and then increase to 362 MPH.

At 12:15:21 his icon drops off the screen.

To my extremely limited aviation experience, it looks like he stalled the plane and then augered in.

Interesting stuff. I had to open a 2nd screen and toggle to follow the instructions. The a/c he was flying (and parked abruptly) has a stall speed of 47 and a top speed of 135. How, if at all, do you splain the webtrak figures, then?

The way his altitude kept cycling, I’m going to guess that he pulled the nose up, went into a stall (the near 0 MPH). Then the plane goes into a dive (the 362 MPH) and he runs out of altitude before he can straighten things out.

Again, that’s just a guess on my part. I ASS-U-ME that the NTSB investigation will look at the radar data and have accurate speed/altitude information.

ChipNASA posted somewhere above that the top speed for the plane is 135MPH.

If he actually hit that 362 MPH, then he exceeded the speed rating for the plane by a lot.

I seriously doubt that aircraft could reach 362 mph. The Vne (the never exceed airspeed) for that aircraft would likely be less than 200 mph. Airspeeds exceeding 200 mph would likely cause structural breakup of the aircraft. The above airspeed info comes from radar returns which I doubt are reliable for a stalled aircraft falling out of the sky.

I’d like to know more about flying helicopters but it’s very costly to learn.

If the doc said I only had a few months to live, I might get a helicopter rating, just to have done it while I could.

This is called phugoid oscillations. My plane is rated for +6 and -5 G forces and while cruising speed is none to fast if handles aerobatics just fine. However, in a spin, you have to keep the control yoke pulled as far as it will travel to remain a stalled configuration.

When recovering from a spin and the incipient dive, you have come out quickly as it will leap from 90 to 190 in a matter of seconds.

In a phugoid oscillation, the extremes of the aircraft performance become more dramatic.

I have no doubt that Bernath never received instruction in stall/spin recovery and the plane ate his lunch. That is what I meant, earlier, when I said that the RV-12 was too much airplane for his experience. It has a fast wing and will be very responsive to control inputs… unlike Cessna 150/152/172/182/210 and the similar range of Piper aircraft, Cherokee 140/160/180/260/300 which are all designed with inherent stability

So what you’re saying, Tallywhagger, is that when my brother gave me a -0- G demo ride in his 1946 Taylorcraft and came out of it without an “event” but rather, very smoothly, my brother was a better pilot at 18 with one year on his license than this bozo was at any time in his life. My brother still has that old Taylorcraft, still flies it, and still overhauls the engine and still puts a new cover on it on a regular basis. He has other planes, too, but still has that old plane.

I have never flown a Taylorcraft but have seen them flying. My first airplane ride was in a wood & canvas Piper Cub.

My brother built two Pietenpol Air Campers from plans, asked me to come get ‘first flight’ photos for him, which I did.

I think he flew at least one of those to Oshkosh’s EAA fly-in one year.

I took glider lessons to learn how to land a plane with a “dead pilot” and no power. Takes the panic out of flying if you know you can control the aircraft.

I may go back to that some day soon. There is a training group near me that takes you all the way through to testing and licensing. It’s the reason I rattle on about gliders on a regular basis. The Horsa, Hamilcar and Waco CG4A were used as troop and equipment carriers in WWII.

The ultralights are appealing but I am really steeped in the stick and rudder stuff.

On another topic, my paint mare came down with a case of strangles. That was around Jan 20th, she’s starting to show some recovery, abscessed glands are starting to heal.

I had not planned to spend so much on horses in January so I’ll be like Mustang Sally and keep my flat feet on the ground, for a few months.

No, I had to give up horse-related stuff some time back when my back gave out. Too many times picking up more weight in grain bags and hay bales than I should have been doing. Now I’m paying for it.

Hiking the trails is good. Take camera along, get many photos of bugs and birds. I am looking forward to birder hikes starting in the spring. Hoping for one at a nearby decommissioned base that is now part of the forest preserve in my county.

Our stable is a real hoot, young girls, horse girls, trying to offset their boarding lesson expenses by doing daily maintenance.

I kid you not, these girls can pick up 80 lbs with their 100 – 110 lb frames.

Until they see it, folks have no idea just how strong kids are when they’re doing something they want to do.

For unknown reasons, there aren’t any boys in the lesson programs.

I like both Topaz and OnOne filters. Their raw programs are replacing the Adobe Photoshop era.

I have no issue with CS5 but the fee part, beyond that, was more than I needed.

There is a lot of info in that radar data even to a non-aviation person. Go back and look click by click for each data point and look at the altitude, speed and direction through to the end.

I’m just glad he didn’t take out the SWA plane landing. I wonder if that triggered any NTSB report for a close call?

I glanced through some of the trash he posted. There was always the hint of his plane being sabotaged and pending lawsuits,, he even dropped the name Jonn in a few posts.
One post that stuck out was that one of the cables that connected to the rudder had come undone and retracted back into the fuselage. He was asking all sorts of advice to get it out to reattach it.
He managed to pull it out on his own using some shade tree mechanic shit (magnet and hanger).
The people on the page all but begged him to get a real mechanic to give the plane a professional inspection. Of course he ignored them.
They told him that their was a chance of that cable being guided between other control cables and it was a disaster waiting to happen.
Id not be surprised if his jury-rigging ended up snapping the control cables and sent him on the way to mother earth and straight to hell.
