NYC to confiscate guns
I goofed. A few weeks back a very good friend sent me a copy of the letter that New York City sent to 500 residents ordering them to turn-in, alter or move out of the city their rifles which could have more than five rounds ready to fire. I thought it was a bogus story, because I’d never heard of any such law, and I knew that NYS’ SAFE Act limited guns to seven rounds. But according to Fox News, New York City has had that law on the books since 2010 and just now decided to enforce it;
The demand came in the form of some 500 letters mailed out to owners of registered long guns that are in violation of a 2010 city ordinance. The first option for the letter’s recipient is to, “Immediately surrender your Rifle and/or Shotgun to your local police precinct, and notify this office of the invoice number. The firearm may be sold or permanently removed from the City of New York thereafter.”
The notices, mailed Nov. 18, also give owners the options of demonstrating the gun has been moved out of NYPD jurisdiction or modified by a licensed gunsmith to comply with the law.
Although an NYPD spokeswoman told FoxNews.com the law has been on the books since 2010, critics say this year is the first time the notices were so widely dispersed.
But, you know, gun registration should never be construed as a means to come for your guns…until it happens. Here’s the letter;

“Except as is otherwise provided in sections 10-302 and 10-303.1, violation of sections 10-301 through 10-309 and of rules and regulations issued by the commissioner pursuant thereto shall be a misdemeanor punishable by a fine of not more than one thousand dollars or imprisonment of not more than one year or both, provided that the first violation of such sections involving possession of an unregistered rifle or shotgun or rifle or shotgun ammunition or an ammunition feeding device which is designed for use in a rifle or shotgun and which is capable of holding no more than five rounds of rifle or shotgun ammunition shall be an offense punishable by a fine of not more than three hundred dollars or imprisonment of not more than fifteen days, or both on condition that (a) the first violation of possession of an unregistered rifle and shotgun or rifle or shotgun ammunition or an ammunition feeding device which is designed for use in a rifle or shotgun and which is capable of holding no more than five rounds of rifle or shotgun ammunition is not in conjunction with the commission of a crime and (b) the possessor has not been previously convicted of a felony or a serious offense and (c) the possessor has not previously applied for and been denied a permit for such possession.”

You should also note 2 of those rifles listed (Izhmash and Marlin) are BOLT actions, those terrible evil NYC Sniper rifles. They did the same thing when Dinkins was Mayor. NYPD Came to my buddies house looking for his brothers Garand and M1 Carbine which Dinky decided were assault weapons. he was supposed to turn them in for destruction. Lucky for him he had moved a week before to Mississippi as a School teacher. NYPD told him to bring them in and he told NYPD to get fucked, come get them. IIRC the NYC law pretty much ANY lever action winchester is now outlawed as well as the British SMLE enfield rifle.

I moved everything out when I heard this was going to happen. In NYC every long arm must be registered. The 500 is only the tip of the iceberg.
There will be some very pissed citizens when war throphies and the like are included. I say 10,000 or more in attics and basements around the city (short estimate).

Dual award for time in the Korean AO covered by the AFEM (1966-1974, called by some the “Second Korean War” period) IS in fact authorized as an exception to normal DoD policy. See DoDM 1348.33, vol 2, para 11, pages 49-51.
Bernath may be a POS and falsely claiming honorary CPO status, but if he got an AFEM for service in the Korean AO on the USS Yorktown after the USS Pueblo incident his KDSM is legit.

FYI. The violation ordinance criminalizes and provides the penalty for multiple sections of the code. Thus, if one has an unregistered firearm in NYC, that’s a stand-alone violation. And if one has a firearm that is capable of holding more than five rounds or shells, that’s a separate violation.
This is breaking at least 2 amendments. No fair price for the illegal sizure of personal property. The 2nd amendment to keep and bear arms. Us rednecks do not look so drumb now. My big problem is whenter to pay for a 2 or 10 year CCW. Joe

Just An Old Dog: agreed. Even if the local law declares it contraband, seizure is still confiscation of private property without just compensation. I’d agree with you that that’s effectively an additional punishment.
Illicit property that is seized is not compensable. Just look at the forfeiture laws that allow property used in a crime to be taken. The property is not illicit in itself but is taken w/o compensation.
Some say some such thing as this would be the straw that broke the camel’s back.

On the road? How, Azygos? Are you aware of gun/weapons ownership legislation in each state in this country? This is not the UK, where everything comes down from on high. The ‘road show’ on which you speculate violates states’ rights as well as the US Constitution.
Look at it this way: Scotland is moving toward independent government, separate from the UK. That means Scotland sets up its own laws and rules, and a constitution. How will the Brit government enforce Brit laws in a country that no longer belongs to the Crown?
@37. NY’s gun laws are insane and will, at some point in time, be challenged in light of Heller’s pronouncement that the right to bear arms is a right that belongs to the individual. The import of the court’s recognizing the 2nd Amendment as a fundamental individual right is that the standard of review for a court hearing a challenge is strict scrutiny. In simplest terms, that means that the burden is on the gov’t to justify any restriction imposed that curtails the individual’s right to, in this instance, possess a firearm. That standard has killed many a statute over the decades. Someone could help the matter along by telling NYC that his gun violates the NYC ordinance and he will not transfer the gun, dispose of it, or surrender it.

It will take years and years for any case to wend it’s way through the various federal levels, with the activist judges throwing up roadblock after roadblock. Who could afford to fight something like this for years?

I’m simply saying that it’s an exaggerated assumption that everyone everywhere is going to knuckle under. Have you not seen the most recent movement for more than half of Colorado to separate itself from Yuppieville the Fearful? That is not the only place this is going on. I see nothing wrong with anticipating the possibility, but the probability is different.
There are a lot of changes going on now, and they will continue to happen for some time to come. So we should be aware of what is going on, rather than complacent, but not live in fear and trembling all the time.
