President Trump warns about the use of the Insurrection Act in Minneapolis
President Donald Trump took to Truth Social to give a warning to corrupt Minnesota politicians. If they do not take action to address the agitators interfering with ICE operations, Trump will invoke the Insurrection Act. This comes after a second ICE related shooting that resulted in an illegal alien getting shot in the leg.

“If the corrupt politicians of Minnesota don’t obey the law and stop the professional agitators and insurrectionists from attacking the Patriots of I.C.E., who are only trying to do their job, I will institute the INSURRECTION ACT, which many Presidents have done before me, and quickly put an end to the travesty that is taking place in that once great State,” Trump wrote on Truth Social.
The president’s warning comes after a second ICE-involved shooting in Minneapolis in recent days.
An ICE agent shot an alleged illegal immigrant in the leg on Wednesday during an arrest attempt. The Department of Homeland Security claims the agent fired at the suspect because he was “fearing for his life and safety” after the individual resisted arrest and “violently assaulted the officer.”
The Insurrection Act, an 1807 law, has not been invoked since the 1992 Los Angeles riots.
The order allows the president to deploy the military to suppress rebellions and enforce federal laws. If invoked, it would grant Trump the authority to federalize the National Guard and deploy active duty forces to restore order. It would temporarily override the Posse Comitatus Act, which normally restricts the use of the military for domestic law enforcement.
The suspect in Wednesday’s shooting was reported to be in stable condition and is now in custody, while the ICE agent is allegedly in the hospital.
This comes after an incident last week in Minneapolis, where Renee Nicole Good, a U.S. citizen, was fatally shot by an ICE agent after authorities alleged she tried to ram her vehicle into federal agents during an immigration enforcement operation.

P.S. I saw the mayor whining on TV about having less than 600 police officers and was apologizing there weren’t enough to fight Federal Agents and prevent them from enforcing the law. IIRC, six years ago the city had 750 police officers and then treated them like garbage, defunded them and hundreds of them quit. I suggest he cut pay and resources further and then send a message that this will continue until morale improves.

For decades, immigration authorities put holds on criminal illegal aliens. When they were released from jail/prison, ICE would drive to the jail, pick them up, and deport them. It was safe, easy, and fiscally responsible.
Now we have sanctuary cities that left these criminal aliens out. So now ICE has to go into the community to get them. As with any warrant unit or task force operation that means they go in force. Instead of two local patrolmen arresting the person on the original call, now you’ve got 6-12 ICE agents in several cars going to every arrest.
Along with this, you get collateral arrests. When ICE has to go to a criminal alien’s neighborhood, house, or work to find them, they also come into contact with other illegal aliens.

Each and every time they go out and perform a “raid” they are doing so under the protection of a sworn Warrant that has been presented to a Federal Judge, who has reviewed the evidence, the constitutional reasoning for the officers to reasonably believe that their suspicions are valid, and that they are justified in their belief that they may search, and/or engage in the legal and constitutionally sanctioned act of legal restraint known as “arrest”. None of these men or women wants to jeopardize their careers, livelihoods, family support, or retirement on the weak idea that they may be able to fake the evidence they need to make a solid arrest. For you to suggest that these people could be so unprofessional as to ruin their future over an inconsequential arrest is evidence of someone who has no logical reasoning.

When they issue a citation or make an arrest they are making it for that court or a higher court that their origin court is subject to.
MP/SP etc, follow a slightly different protocol because they are making arrests either for the commander to enforce order and discipline or a separate Federal Court, in the case of arrest of civilians on military bases and property.
Practically all members of the military are not authorized to make arrests or detentions of civilians not on military property, with the exception of those specifically granted that power. They have no court to present the case to either so where would they even take their prisoner?
On the flip side, any commissioned military officer can make an arrest of any military member for violations of the UCMJ. This is rare and most often happens during the commission of a crime. In 16 years of commissioned service I arrested a total of two people. One had just murdered two people and the other had consumed a quantity of narcotics in front of me. While any officer can make an arrest, only a commander can authorize detention.

The military can be used in “domestic affairs”, and it is used this way with regularity, every day and for unusual events.
Domestic affairs is a pretty wide open category that includes disaster relief, search and rescue, Army Corp of Engineers activities, providing intelligence and material support to law enforcement to name a few examples. But again, biding the exceptions I noted above, the military has no powers of arrest and is not allowed to enforce laws unless congress gives them that power by statue.
They lack that capability as they are not officers of a court that has any kind of legal authority.
A good example is that when Mudaro was arrested recently, Federal agents from the DEA and the FBI went on the mission with the military to make the actual arrest and take him (and his wife) into custody. The military couldn’t make the arrest because they had no authority to do so.
The Insurrection Act is an exception to the Posse Comitatus Act. That is why President Kennedy could and did use it to enforce school racial integration in the Southern states who refused to comply with federal law. He used units of the 82nd and 101st Airborne Divisions to force the integration of Old Miss.
It isn’t reasonable for police or federal agents to put down an actual insurrection. They couldn’t do it even if they wanted to due to lack of capability and manpower. Even a poorly trained and equipped militia could easily overwhelm local police.
