Navy makes posting private nude photos a crime

| April 20, 2017

In response to the recent scandal regarding the posting of nude photos on various social media platforms, the Navy and the Marine Corps announced that practice is now a crime, according to the Navy Times;

An interim revision to Navy regulations prohibits Navy and Marine Corps personnel from posting intimate photos “if the person making the distribution or broadcast does so without legal justification or excuse,” the regulation reads.

The statute details three conditions that will be considered a violation of Navy regulations, including if images are broadcast or transmitted: “with the intent to realize personal gain; with the intent to humiliate, harm, harass, intimidate, threaten, or coerce the depicted person; or with reckless disregard as to whether the depicted person would be humiliated, harmed, intimidated, threatened, or coerced,” the regs read.

[…]

“The addition of Article 1168 ‘Nonconsensual distribution or broadcasting of an image’ to Navy Regulations serves to underscore leadership’s commitment to eliminating degrading behaviors that erode trust and weaken the Navy and Marine Corps Team,” said Rear Adm. Dawn Cutler in statement Wednesday evening. “It provides commanders another tool to maintain good order and discipline by holding Sailors and Marines accountable for inappropriate conduct in the nonconsensual sharing of intimate imagery.

“This article adds the potential charge of Article 92 ‘Failure to obey [an] order or regulation’ to the possible charges that can be used against an alleged perpetrator. Each case of alleged misconduct will be evaluated on its own facts and circumstances.”

So, if somewhere in your tiny brain, you thought it would be OK to post nude pictures of other people in a public forum, maybe this will convince you otherwise. Or maybe it will just inspire the sociopaths to find a way around the law.

So Senior Chief Busta Nutt is now SOL

Considering everything, including the obnoxious behavior of someone whom I thoroughly despise, I do think that the best prevention method is to notify the women who are on the receiving end of this infantile crap that the perp is So-and-So, and let the women beat the living shit out of the perps.

After that, add the military’s punishment.

“Much of the language in the new regs would be very difficult to prove in court, said Brian Bouffard, a former Navy JAG and now private defense attorney.” No shit. First thing I thought when I read the quoted language of the new reg is, “Huh? This won’t work.” And it won’t. The language sucks, terribly. Aside from being overly broad (sending an image from your cell phone to your email would satisfy the reg, there is apparently only one private part to a human’s body. I’m not sure what it is. I haven’t pored over the language, but, at first blush from what I did read, the reg is DOA when it it is challenged.

MSG Eric

Probably because they are still in a “Do something now!” mode and haven’t fixed that yet, from the previous administration.

The first time someone gets busted for it, I’m sure they’ll get a civilian lawyer to help push back and destroy it.

Sapper3307

Is it nude (under UCMJ) if you are only wearing a hat?

Ex-PH2

Depends on the location and size of the hat.

timactual

Ten gallon, of course.

MSG Eric

We all have ten gallon hats in fact. We’re men, manly men!

GR_ATC

As Jerry Clower said, “You can be naked with your socks on.”

IDC SARC

if I recall…according to Lewis Grizzard there’s a difference between naked and nekkid.

Naked means you aren’t wearing any clothes. Nekkid means you aren’t wearing any clothes and you’re up to something.

ejazzyjeff

I think you also have to wear corafram shoes just to make sure you are covered.

USMCMSgt (Ret)

…and a reflective belt.

Gotta have the reflective belt.

Bobo

They were all a bunch of morons to post the stuff on a Facebook page, but, honestly, what would motivate someone to in this day and age to pose for nude pictures and believe that they weren’t going to end up somewhere.

We have a generation that let “sexting” run rampant, and this is part of the result.

2/17 Air Cav

Zactly. I look at it as I do gawdy tattoos on women. It seemed like a good idea at the time. Seemed like everyone was doing it. But the, “Oh shit, what was I thinking?” is coming sooner or later.

David

Has there EVER been a response to “Tell me about that tattoo?” that doesn’t start with “I got really drunk one night…”?

“Yes, Mommy has an old tattoo on her breast. No, it’s not supposed to be a giraffe – it’s a pony.”

CC Senor

Yeah, and over time the cute dolphin morphs into Moby Dick.

HMC Ret

The (mostly) men who post these pictures are pigs who are betraying their fellow troops, most of whom are women.

The (mostly) women are stupid for posing. No, lady, he’s not ‘the one’. He won’t love you forever. You won’t get a picket fence, 2 puppies, 2.6 kids and a 30 year mortgage by hooking up with him. If you’re lucky, he might remember your name in ten years. But he probably WILL still have your pictures.

There is enough immaturity to go around. Stop it, both of you. Hey, guys, remember that respect for your fellow troops thing you heard repeatedly in boot, in which you have their back at all times? Posting those pictures is a betrayal of that trust and commitment to respect the women and have their back. Hey, ladies, remember what mom and dad told you about what not to do and that men are pigs?

This is a generalization. No one size fits all. Some will get the picket fence. Most won’t, at least not from this guy. Any guy who would pass around pictures of you in a compromising position probably does not want a lasting relationship. If he doesn’t respect you now, what makes you believe he will do so in 30 years?

AND, if the pictures were taken w/o the knowledge and consent of the lady, we’re talking a whole new scenario.

Again, generalizations b/c no one size fits all. I find this disgusting.

Mike

Not defending the people who posted the pictures, but why do we automatically assume they do respect these women as fellow servicemembers? Because the former SECDEF or SECNAV or whomever (I intentionally forget their names) said so?

I’m not saying women can’t do the job, several have already proven they can hold their own with those of us who can pee standing up. However, I highly doubt the women posing for these photos fall into that category (obviously, this doesn’t apply to those whose photos were taken candidly).

HMC Ret

Mike: I understand your point. My opinion is that military personnel should respect each other. I realize that’s the best case scenario and some will not respect others. The disrespect flows both ways: male to female and female to male. To them, regarding the posting of these images, perhaps it’s little more than a lark w/o regard for the long-term consequences of their actions. My contention is that (mostly) men should not be posting these pictures under any circumstances. I realize I can’t speak for everyone and I was primarily speaking for myself b/c I simply don’t believe it is the honorable thing to do. I believe we should have each other’s back and posting these images is a betrayal of trust. I understand your opinion. Yes, I also forgot their names. I feel they believed their primary function was to ditto O’s opinion.

Mike

HMC Ret: I agree that the (mostly) men involved in the scandal were not acting honorably, but I also know that addressing any problem begins with properly analyzing the issue – assuming these Marines considered those women to be equals or peers in the profession of arms is a flawed approach.

GIVE THAT MAN A CEEGAR!!! You hit it on the head, Bobo…

Grunt

@Bobo-

It’s not a generational thing. It’s a “people are fucking cocksuckers” thing.

Sexting is a use of a communication medium. Hormone-driven interaction between young people was not invented by the Facebook generation.

Sparks

Grunt…I was sexting back, and I mean way back in high school. Using notes folded like the triangles we played desktop football with and then thumped 4 seats up and 2 rows over to Jane. Had Jane’s name on it at least, so Sally didn’t think it was for her. God Sally was ugly! 😀

I work with a NROTC and trust me, it doesn’t take a lot for these kids to do stupid things. Don’t get me wrong, these are very smart kids and they are doing the exact thing that every kid does at that age, except they need to post it for all to see and incriminate themselves (mostly deal with underage drinking). The old adage of the Good Conduct Medal – doesn’t mean I was good, it means I wasn’t caught!

The Other Whitey

Even the smartest youngster learns by fucking up.

USAF E-5

My biggest problem with the change is this: It’s unnecessary. Conduct contrary to good order and discipline doesn’t need to be spelled out. The number of incidents of blackmail and coercion in the history of just the US Military has an abundance of evidence to prove you cannot take nude pictures and send them. Really, taking them is enough for conviction. What we lack is “Leadership.”

2/17 Air Cav

True, but they did SOMETHING and that’s the message. We are responsive. So what if it’s bullshit? The point is made: we did SOMETHING.

MSG Eric

The Navy’s upper ranks haven’t fully realized yet that this isn’t Barry and Ray’s Navy anymore. There’s a new sheriff in town.

HMC Ret

Yep, doing SOMETHING is its own reward. It doesn’t much matter the outcome. Don’t just stand there, do SOMETHING.

Sparks

USAF E-5…In my day military blackmail was a big deal due to those of us who had a Top Secret/Crypto clearance and the like. But there was no social media. It was more likely the honey traps catching you in the No-Tell Motel.

JimV

The number one way to prevent a naked photo being posted online? Don’t pose for one. Even if it’s your spouse asking for the snapshot. Boyfriend or girlfriend asking? Hey, you’re not married yet. They should not see your unclothed body until after the “I do’s.”

Problem solved.

Green Thumb

Yep.

Sparks

Word.

Keep those privates…private.

MSG Eric

I’ve even told my past couple girlfriends not to send me pictures of them naked, didn’t need them. And I didn’t want to deal with them being found in public or hacked or whatever by someone else and used against them later in their lives.

Granted, I had a few girls I knew send me naked pics that they’d sent to a few others. I didn’t mind that so much because we weren’t in a relationship, so their choice I guess. But, I still told them they should be careful about who they do that for.

When the internet naked pics craze started, many women were just as apt to be naked as men. It still happens and some people are too open because the access is there.

During WW2 guys were showing off that one “naughty” picture they had of their sweetheart back home because it was a pride thing. Should we go back and do retroactive punishment against all the people who have nude pictures of someone else?

IDC SARC

I’m always wearing tattoos…bullet dodged

Sparks

The generational problem I see with this is the same one I see in other issues. Some will cry foul but many will give you the generation’s big fuck off, which is “What-EVER!” I agree it is unbecoming for a young man or woman to do this stuff even in agreement. Says a lot about their character. But there are the ones who will agree and then when it hits the World Wide Webs cry victim. The same ones who send every thought in their little heads across Twitter. Just don’t do it. Common sense is indeed in short supply these days and maybe it’s just me, but especially in this generation. I lay it on parenting a great deal.

Ex-PH2

It’s lack of common sense, Sparks, AND a lack of good manners, too.

Some of these younger people don’t know how to use a knife and a fork, or pick up after themselves.

2/17 Air Cav

I blame both Kodak and Polaroid for their self-developing film. That’s where the real trouble started. Up until then, you had to draw her pic or just remember what she looked like naked.

Forest Green

Well, here’s one for consideration. I was President of a Warrant Officer Selection Board back in the day. One of the requirements of an individual’s application was the inclusion of a picture(s) of any tattoo(s) the individuals may have stupidly procured during their enlisted festivities; I mean enlistment.

I not only saw some interesting tattoos, but also some very interesting PLACEMENT of said tattoos. Eye bleaching was of no avail and every now and then a cold chill works its way down my spine as I think about getting one or two of those tattoos.

I wonder if these pictures will be covered under this new regulation. Or maybe they won’t require them anymore. LOL

2banana

Does this cover SEALs making porn movies?

Or does that count as art?

The Other Whitey

I thought the consensus on that was “good work if you can get it.”

HMC Ret

It’s a tough job but someone has to do it.

The Other Whitey

The hardest-working CPO in the Navy, right?

11b-mailclerk

Can’t work clandestine. Been blown.

MSG Eric

I imagine at the lest he’ll be grandfathered in because he’s already been naked? Oh and more importantly, his wife is smokin’ hot.

The Other Whitey

She’s certainly maintained quite a few lads’ morale.

Dave Hardin

More bullshit that will do nothing but cause more problems for those serving.

The pictures posted in the FB groups that started all of this were nothing to get worked up about. Those that get all pissy and high minded about it have never seen the pictures everyone is pissed about.

With a very few exceptions, the pictures were all posted online by the women in some place on the web. The few exceptions were sent to men by them.

The people who were posting them in a PRIVATE group are almost entirely veterans that are no longer on active duty or severing in any capacity.

All a bunch of nonsense because you know “women in the military are equal” except they have to have all kinds of special rules, limitations, safe spaces and a private potty.

Pictures of women in yoga pants doing squats at the local gym with their tits hanging out may not be posted by active duty people. Big fucking deal.

Its not the pictures that pissed off one single woman who was on that site. It is what was being said and yes they were being pigs. They were being pigs with an expectation of privacy…in a private group.

I need some “Pig Spaces” set up so I can relax when I am out and about.

Oh, I am not active duty so the Department of the Navy can kiss my civilian ass.

MSG Eric

Some pictures of women in uniform give me a chubby, so should women not have pictures taken of them at all? Only if they are super gorgeous? Only if 4 out of 5 board members get a chubby looking at them?

This is definitely a “do something!” response which they are using to try to get the public and media to stop talking about it. We shall see what happens.

The author of the blog “America’s Sergeant Major” (USMC) has a rather direct and refreshing perspective on this topic.

WTF, Over? was this something thought out and planned or was it some Shaft (*OOPS*, Staff) Officer’s sudden bright idea he ran up the shaft (*OOPS*, flagpole!) thinking it would get him either a ribbon, medal or a shiny doohickey on his, her or its next OER?
