California hires Holder to do battle with Trump
For some reason, the State of California announced today that they hired former US Attorney General Eric Holder “Girding for four years of potential battles with President-elect Donald J. Trump” says the New York Times.
[Kevin de León, the Democratic leader of the Senate] said he expected California to challenge Washington — and defend itself from policies instituted in Washington — on issues including the environment, immigration and criminal justice. He said California Democrats decided to turn to Mr. Holder as they watched Mr. Trump assemble his cabinet and begin to set the tone for his presidency.
“It was very clear that it wasn’t just campaign rhetoric,” Mr. de León said of Mr. Trump’s proposals over the past year. “He was surrounding himself with people who are a very clear and present danger to the economic prosperity of California.”
I wonder how he got the phrase “the economic prosperity of California” out of his mouth without a chortle.
The Legislature has an ample stable of lawyers on staff, but officials said Mr. Holder and his firm brought specific litigation and political skills that could be needed in the coming years. Mr. de León said the final compensation for the firm had not been set, but would be publicly disclosed once it was.
“The cost will be very minimal compared to the billions of dollars at stake if California doesn’t adequately make its case,” he said.
Yeah, California has quite a surplus to toss around to fund extra lawyers. According to the California Debt Clock, they’re already more than $450 billion in the hole, so throwing a few billion at Holder won’t hurt much. In case Mr Deleon, hadn’t noticed, Holder worked for Obama and Obama is leaving town in 2017 taking with him any influence that Holder might have. Unless California wants to get into the gun-running business, like Leland Yee, former California State Senator, current Federal prisoner, Holder won’t be of much help.

Both the NYT story and one from the WaPo fail to answer critical questions:
In the first place, how can Kevin de Leon and a group of political insiders apparently get away with hiring expensive DC legal talent without any public discussion or review? A lack of competitive bidding, for example, might make sense if Holder offered specialist skills in a certain legal area, but this isn’t what’s going on.
The comment that they don’t know how much Holder is going to cost yet is either disingenuous or idiotic. It might not always be possible to know what the eventual tally is going to be for extended litigation, but law firms typically make no secret of what they charge. Or is de Leon saying that Holder should get a blank check and charge whatever he wants for as long as he wants?
Giving Holder a blank check is also ironic if you consider that the reason they want to hire him in the first place is because of a perceived “clear and present danger to the economic prosperity of California.” Neither newspaper story makes an attempt to flesh out in what way the danger is presented– or if in fact it’s actually presented at all. It’s simply something taken on faith because de Leon said it.
It has been a very long time since facts or reason had anything to do with the output of Sacramento.

In addition, the Obama administration lost more cases unanimously than the Clinton and Bush administrations by almost 50% suffering a whopping 44 losses without a supporting vote from any Supreme Court Justice.
This year alone, in the Obama administration argued 10 cases in front of the Supreme Court and did not garner a single supporting vote from anyone wearing a robe. Even Obama’s own appointees ruled against him.
Holder himself was a big part of the losing of cases.
I suspect that the Trump people are laughing at this move by California. I know I would. Wait until the people of California start to get the bills for losing litigation and find out they are paying both sides of the stick.
