The administration has pledged to appeal to the US Court of appeals in DC. If congress wins there the case will go to SCOTUS. A tie there will be the same as a win for Congress. Of course it will be late 2017 befor this plays out. Another case of Obama slow walking to get his way.

I am witness of fact (I think that’s the term) in a civil case that has lasted eight years. Neither party in the case is willing to concede, and their lawyers gleefully continue the tennis match that is this case because, in the end, the lawyers WIN!!
Obamacare is A TAX. I ask you, when is the last time our federal government repealed a TAX??

Yeah, at this point you do have to wonder if both parties to the civil suit didn’t previously p!ss off both law firms involved – and this is the way the law firms have chosen to get even. And since the judge is allowing it, I’m guessing maybe they both p!ssed off the judge previously too.

No. As the law is written it is decidedly not a tax. It is an IRS penalty or fee, and is explicitly identified as such in the law implementing “ObamaCare”. The problem with that is that it was imposed in contravention of other existing Federal laws regarding penalties and fees.
Imposing it as a tax would have been within Congress’ authority, and there are any number of ways that could have been done lawfully. However, the law was so incompetently written that with respect to the ObamaCare penalty, Congress fornicated Fido.
What Roberts did was say, “Well, it’s within Congress’ authority, so it doesn’t matter that they screwed up writing the law. It’s against existing Federal law, but we’ll let it stand anyway.” That, sir, is BULLSH!T.
The job of the courts is not to make new law or correct defective law, which is precisely what Roberts did here; that is the job of Congress, not the courts. Further, a revised law implementing the unlawful ObamaCare fee properly as a tax didn’t stand a snowball’s chance in hell – because if I recall correctly the GOP controlled both houses of Congress when Roberts unilateral decision was handed down. Roberts knew that full well.
Roberts betrayed his profession, the Constitution, and the nation through willfully refusing to do his professional duty. He deserves all the scorn he gets on that score.
“Bleak House” by Charles Dickens is a novel about a lawsuit over a rocking horse, which ran on for at least two generations, maybe longer but for so long that the original character had grown up and moved away and some of the plaintiffs were dead.
I know the law is flawed in some parts. I want the excise tax repealed, and I’m not quite sure what the PCORI is actually doing or has done. However, a full repeal means that millions of people will have their policies canceled, including some family members of mine (one of whom is a veteran and the other a retired firefighter). What happens to them? is there an alternative that gets rid of the bad and keeps the good, so to speak?
Probably not. ObamaCare is based on three principles, each of which is antithetical to either basic economics or the concept of limited government/personal responsibility. And as a famous man once said: “You can’t fix stupid.”
The first is the requirement that insurers insure preexisting conditions without a waiting period. That is economic absurdity. What we’ve seen is precisely what was predicted: those preexisting conditions are costing the insurers so much that many are dropping out of the ObamaCare market, and have caused premiums to rise sharply. Look for even more insurance companies dropping out of ObamaCare exchanges and hugely higher future premiums – and thus hugely higher cost to the taxpayer in the form of ObamaCare subsidies.
The other two are the concepts that (1) the government can assess a tax penalty on an individual for essentially breathing if they refuse to voluntarily purchase a product for which they have no need, and (2) that healthcare is some kind of “right”. Both are antithetical to the concepts of personal freedom and personal responsibility for one’s actions. The late POTUS Gerald Ford said it best: “A government big enough to give you everything you need is also big enough to take everything you have.”
Bottom line: the entire act is flawed, and is based on idiocy. It cannot be salvaged, and should be scrapped. Otherwise, it will do precisely what Medicare and Social Security threaten to do even now: bankrupt our descendants by causing a future national economic meltdown.
If someone wants socialized medicine, I suggest they pack up and move to Canada or Europe. If either will have them.
When the idiocy that is howbadismycare was summarized by bodaprez, it took him a brief 15 minutes to discuss it. It sounded okay in his little speech, but I wondered what the reality would be. Several years later, after enormous subterfuge, unnecessary secrecy, and power-tripping antics, it was announced to the world, and was, in fact, the biggest mess ever conceived anywhere on this planet.
It was as if a committee of blind elephants decided to put a large animal vet curriculum together to benefit the herd.
Now, what do we have? Unaffordable coverage and insurance carriers that are withdrawing from a labyrinth of idiocy that would confuse the Minotaur.
If you planned to destroy a thriving business that actually does – er, DID provide coverage for people (and this included catastrophic coverage) and employed a lot of people, no one could have done a better job than puglosi, her cronies, and bodaprez.
Congratulations to all of them! May their names be written in the annals of history as the idiots who cost this country and its people more than we can afford.

Interesting comment by a columnist this morning talking abut how few Berniebots actually understand anything real about Socialism. While they are all over ‘Socialism’ and ‘getting together for the common good’ etc. they are NOT happy when it is suggested the government take over Amazon, Facebook etc. To which the columnist observed – so if you don’t think the government could run Amazon, why in the hell are you letting them run medical insurance?
