The lawsuit strategy to end phony SEALs outbreak

Our buddy, Don Shipley, phony-SEAL clubber and a former SEAL himself, thinks he’s struck on the perfect legal weapon with which to put an end to the phonies which have multiplied over the past few years. Shipley owns “Extreme SEAL Experience“. Shipley and his lawyer, Gene Odom have filed their first law suit against Barry “Bear” Silverman, who runs a business called “Tactical Deterrence”, Apparently, Silverman is a phony SEAL according to POW Network and uses that lie as part of his business model. Shipley says the fake SEAL is hurting his business;

Shipley, a 24-year Navy veteran, spent 19 years as a SEAL before retiring in 2003 as a senior chief petty officer. The suit says his business is being harmed by men falsely claiming to be SEALs; it also claims Silverman is using the likeness of the SEAL trident without permission.

“The number of new customers has decreased as a result of prospective customers associating the quality of plaintiff’s business with the Defendant’s illegitimate knockoff,” the suit claims.

So whether the Stolen Valor Act passes muster or not at the Supreme Court is irrelevant – the phonies will get their comeuppance either way. By the way, the Tactical Deterrence website is down, so the lawsuit is having the desired effect.

Maybe Silverman’s course is the one Tiger Woods took back when he was thinking about quiting golf and joining the Teams.

Along similar lines, has anyone ever contacted the Institute of Heraldry out of Fort Belvoir? I haven’t looked into this in a long time, but I think part of their mission is to enforce the use of military heraldry by people involved in commercial endeavors. So if a poser tries to make money by displaying images of units, etc without permission of the institute, then they can go after them. In fact, there may even be some exceptions in trademark law offering more recourse.

I remember when everybody was or had been a Green Beret. Then there were more Delta Force people than were actually in Delta Force, because of Blackhawk down. SEALS are the A-number one bad asses now, so everybody is/was a SEAL. It all depends on which group is most well known or popular at the time.
A good one I heard recently was some kid told a friend he was gonna be a SEAL. The only problem was he is in AF basic training and I ain’t real sure he can do that.

I would NOT want Don Shipley or any other real SEAL on my case over anything, let alone SEAL creds. I once actually saw some clown try to get in a urinating contest with Steve Robinson on Facebook about his SEAL credentials. No, REALLY. “Hmm, I think I will tell one of the men who literally wrote the book on SV that I really am a SEAL. Nevermind he is a SEAL. I will just appeal to his dislike of paperpushers. It is the Navy who has it wrong”. Crush, Kill, Destroy Mr. Shipley!

Seems to me his deck is short a card or two. But that’s just me, I guess.
