Retired Flags Support Kelly in Amicus Brief

Former military leaders sign legal document supporting Sen. Mark Kelly

Over 40 retired generals, admirals and other former senior military officers signed an amicus brief on Tuesday in support of Sen. Mark Kelly, D-Ariz., as he faces an investigation from the Pentagon over alleged sedition.
The accoladed list of individuals, which includes two recent secretaries of the Army and Navy, said that the Pentagon’s escalating attacks against Kelly could negatively impact veterans who want to publicly speak out about subjects important to them and the American public.
“To chill the speech of retired military service members would not only infringe on their individual First Amendment rights, but also impoverish public debate on critical issues relating to our military and its role in domestic and foreign affairs,” the amicus brief read.
Kelly and several other Democratic representatives released a video on Nov. 18 pleading with military personnel to refuse illegal orders amid ongoing U.S. military strikes against alleged drug-carrying vessels in the Caribbean and eastern Pacific Ocean.
Spinning Kelly’s seditious messaging intending to undermine good order and discipline as a First Amendment issue is an entirely predictable and baseless argument. Retired officers retain influence tied to their rank and therefore are still subject to the UCMJ, in this case Articles 133 and 134. Also retirement grade determinations are administrative, not criminal. This letter is analogous to a herd of Arctic musk-ox drawing into a circle with their horns out, protecting their own in response to a threat. Where were these worthies after Joe’s Generals fled Afghanistan with disastrous results, or the arguably treasonous Mark Milley’s collaborating with his Chinese Communist Party military counterparts during Trump-1?
Rhetorical question, of course. They were the silent Perfumed Princes in their DEI world, overseeing the demise of our military in real time. Their amicus brief is as worthless as they were.

You got your dates mixed up. Kelly attempted to purchase the guns the day before they were shot. The whole story is weird and his explanations non-sensical.
He also tried to buy the guns without ID the week prior, which of course the shop refused.

I had forgotten about Kelly’s blatant lies about gunshow and internet purchases of firearms without the mandatory federal background checks. As we here all know, both sources require background checks. For internet purchases, the firearm must be shipped to a FFL dealer in the purchaser’s state, who then does the 4473 and the background check. The same applies to vendors who sell at gunshows. The only exception is if one buys a gun from a private party attending the show selling to another person. Occasionally, you see a guy wandering around with a rifle with a note advertising it for sale. But in some states, such a sale still requires the background check through an FFL dealer, plus any waiting period.
Yeah we have sellers/tables at our gunshows that are Private sellers and they don’t have to conduct a background check.
Then there are the C&R holders that are thinning their herd, that aren’t required to conduct a background check either.
They do however get your drivers license number to fill out a form for their records that they have you sign.
I always check those tables for interesting military surplus weapons. In fact this weekend I bought a Siamese Mauser still in 8x50R from one of those vendors. First one I had seen in the wild since I started collecting in Jan 2011.

But don’t the C&R holders with a table have to sell only to other C&R holders? Also, don’t the firearms have to be on the C&R list?
No a C&R holder can sell to anyone. Yes C&R weapons are on a list.
A C&R license is to allow the holder to have C&R weapons shipped directly to them. But is not a license to sell. But they are allowed to sell to enhance their collection, dispose of duplicates etc. There is more to it, but this is the gest of it.

In my state, and a few others, a gun dealer may sell from his personal collection without a background check or all the accompanying paper work. I think this bad practice and will likely tun into tax man problems. But should not be illegal.
In my state, and most others, the state allows a private party to rent a table and sell guns at a gun show. Federal Law only proscribes this if it is done “regularly” . I think this is good practice and allows private individuals to dispose of unwanted or unneeded firearms for a minimum expense.
If I ever wanted to clean out my entire “collection” of a single shot top break .410 and my Thompson Center Contender with three barrels, I could save 20% over the local pawn shop, less table rental fees.

Oh that was a stunt he intended to show that it was easy to pass a background check and buy guns. His premise was it is far too easy since he accomplished it in one visit to the shop. He made a facebook post trying to build support for his antigun position. he got massively flamed in the comments. Lets face it, why would anyone think a retired Military Officer and astronaut with top secret clearances NOT pass a background check.
It got so bad he abandoned the page and refused to answer any of his critics.
As far as Gabby is concerned, IMO she just proved that brain damage leads to gun control opinions. Prior to that she was perfectly fine shooting an AR at a target with a kid pictured on it.

That’s a pretty fair statement I lived in her district when all of that happened. She was fairly moderate. What happened after was terrible for the people that district. We went without representation for an extreme amount of time while most people beelive that Mark Kelly was representing the district (unelected) and then procceded to ride her coattails and tragedy into offce.

I’ve even been wondering where they have been lately; expected “these ICE policies are not what I fought for” weeks ago. I find it extremely interesting that folks like McRaven, MacCrystal, Mattis don’t show up, nor do many of the reliably anti-Trump names I would expect.
Only one I really remember from this list is LGEN Kennedy, whom you may remember for torpedoing the nomination of the Army IG a while back on sexual harassment claims. As an officer when I knew her, I would describe her as a major oxygen waste. And even an IG couldn’t be THAT desperate.
I worked for one of those Generals on the first list. Weird because he didn’t seem that way at the time. Met him when he was a newly minted Major and saw him raise to the rank of Major General.
He had a nickname he went by, and when he ended up visiting the place my USMC son happened to be at, he addressed my son by his first name and insisted my son address him by his nickname. Because that was what my son had always known him as since he was a young kid.
In fact he officiated my retirement. When I introduced him to my dad (Retired AF) by name and rank, he butted in and said call me nickname.
In fact he said my retirement certificate might be valuable due to the signature, as it was for Dec 2008, so before Biden took office the following month.

I’d bet many of them are the same worthless jackasses who wrote that letter endorsing Biden back in September of 2020.
They concluded that letter with…

I have heard rumors that many have been seeking re-employment some time after January 2025. Somehow the 2020 letter fell into the hole of forgotten memories on the internet.

When the Iowa class battleships were recommissioned in the 80’s a slew of retired sailors were recalled, as no one else knew how to run the engines or fire the guns. As for a recall for punitive reasons, no idea.

If one takes the military retired pay, that subjects one to the UCMJ. For senior officers, that can be as much as 3/4ths of their active duty pay, a sizable chunk of change each month for the rest of their lives. FAFO

Many retired officers have shown little respect for the UCMJ. USMC Gen Kelly, for example, attempted to bring contempt upon the NCA, by insulting Trump, and should have been prosecuted. Many others have done similar things. Kelly was implying that orders coming from Trump were illegal and should be ignored. He should be recalled, put in front of a court martial and be dismissed from the service. That “over 40” retired officers signed an amicus brief is irrelevant.
