‘Use of force was justified’ Johnstown shooting ruled self defense, no charges filed

CAMBRIA COUNTY, Pa. (WTAJ) — After an investigation into an August shooting that left a Johnstown teen dead, the Cambria County District Attorney’s office has announced there will be no charges filed against the alleged shooter.On Aug. 31, police were called to Solomon Homes on reports of a shooting. Aquon Tillman, 17, had been shot multiple times and ultimately died from massive blood loss, with his death being ruled a homicide. Originally, no arrests had been made, and the shooting was under review by the DA’s office for possible justified use of force in self-defense or defense of others.
Cambria County District Attorney Greg Neugebauer announced on Wednesday that, after conducting an investigation into the shooting, including reviewing video evidence, it was clear that Tillman first used deadly force against an unarmed man in relation to a personal property dispute.
More specifically, Neugebauer added that Tillman exited one of the Solomon Homes buildings, encountered the other man, presented a weapon and fired said weapon in the direction of the man. The man never presented a weapon of any kind.
In response, a bystander got out of their vehicle and used deadly force in defense of the other man by firing their weapon at, and ultimately striking, Tillman, according to Neugebauer. The bystander fully cooperated with law enforcement and surrendered their weapon when asked to do so. Tillman’s weapon was never recovered from the scene.
“In this instance, the bystander reasonably believed that the man’s life was in danger, and the facts indicate that he was in actual danger as the man being shot at by Tillman in an open area was unarmed and otherwise unprotected,” Neugebauer said in a release. “The only logical conclusion based on the facts and the law is that the use of force was justified.”

The Good Samaritan (listed as shooter and bystander in the article but not by name) has survived the criminal investigation without being prosecuted. I have no doubt the family of the deceased will be filing a wrongful death suit alleging vigilantism as well as unlawful homicide. I figure they will say he was a gud boi and studying to be a doctor… of something.

It may just be an aesthetic thing, but the lever not fully contacting the frame when the bolt is fully closed looks cheesy. But, I am am no doubt influenced by being a long time Marlin fan…bought my first one 62 years ago (and it’s still in the family in the hands of my eldest grandson.)
