Self-defense claim leads to dismissal of murder charge in Miami

MIAMI, Okla. – A murder charge was dismissed on Wednesday for an Ottawa County man after testimony showed the fatal shooting was in self-defense.Travis Christian Wilbur, 36, appeared in Ottawa County District Court for the Jan. 5, 2024, death of Matthew Vincent Locastro, 27, of Miami.
An autopsy report showed Locastro died from a gunshot wound to his head. Court records show Locastro was shot in the left eye, and the autopsy report spells out the path of the fatal bullet. His toxicology report showed he tested positive for methamphetamine and amphetamine, and his blood alcohol level registered at .18, which is over twice the legal limit in Oklahoma.
Testimony at the preliminary hearing in September 2024 suggested the two men were arguing, and in a struggle over a gun, the gun discharged, striking Locastro.
Wilbur’s attorney, Jesse Muth, argued that Locastro entered Wilbur’s friend’s garage and assaulted Wilbur with an object that turned out to be a gun. Wednesday’s motion hearing to dismiss addressed Wilbur’s claims that the Jan. 5 shooting was in self-defense.
A message left for Jesse Muth, Wilburn’s attorney, was not returned before deadline.
After a day and a half of testimony on the “Stand Your Ground” law, District Judge Jennifer McAffrey dismissed the murder charge against Wilbur.

Wen I exzamin this hole thing, an’ ply logic to it….I’d haf t’say that thar may be som quetchon as to if this wuz FAIR or not.
Evidence that even if it is self defense, a justified action, one may still have to defend oneself in a court of law.

That story sounds a bit shady.
I have the same or similar 6x Malcom scope being put on my Marlin 1985 45-70. I should get it back this weekend, if there are no problems. My dad had it mounted before, but it bucked free of the front mount (45-70 delivers a pretty good wallop). Hopefully the gunsmith I’m using does a better job.
