Legal experts weigh in after armed customer kills suspected thief in Murfreesboro

MURFREESBORO, Tenn. (WKRN) — A suspected thief is dead and two others are on the run following an attempted ATM theft at a Murfreesboro gas station Friday morning.

The Murfreesboro Police Department revealed the unidentified man was killed by an armed civilian at the 7-Eleven Exxon on East Northfield Boulevard on Friday, Aug. 1.

Authorities said the three suspects backed a stolen pickup truck to the store around 5 a.m. and used a sledgehammer to smash a window before trying to pull the ATM from its base with a guy wire. A customer inside the store reportedly opened fire, hitting one of the would-be thieves.

“It’s crazy. I mean, people are just nuts anymore. You don’t know what to expect,” Murfreesboro resident Karen Laakkonen said.

Police said they interviewed the armed civilian and released him. Investigators will now work to determine if the deadly shooting was justified.

“They went there with what appears to be a pretty clear plan. They just didn’t count on the citizen having a gun,” criminal defense attorney Ben Powers said.

The other two suspects fled the scene, abandoned the stolen truck at a nearby apartment complex, and escaped in a separate getaway vehicle, according to law enforcement.

The ATM gang was out of Texas and were all arrested on their way back there, including two more accomplices.

The shooter and the gang members will likely all face murder charges. Convicting the shooter in court will be tough row to hoe in Tennessee.

But one never can tell with Soros-DAs all over the place. He may never get convicted, but get persecuted (in the guise of prosecution) nonetheless.

Given the situation that is called jugging, I no longer use ATMs. There was a story on the news last month about a woman who got money from an ATM then was followed home and robbed. There is no problem doing what we called going to the bank of walmart. We’d shop then get cash to go for misc stuff later on while we were RVing full time.

I have an account at a local credit union as well as a major bank. The CU provide far better interest than the chain bank so the savings goes there. If I need to deposit a check or withdraw money I go inside.

I don’t even have an ATM card. I only use credit cards. ATM cards are too risky. Its like handing someone (or some random computer/ scanner/ whatever) the key to your bank account every time you use it.

We were Doing a cassette replenish/repair inside a kiisk out on Long Island NY Plus a fine count on the $20.00 cassette where each bill is counted by hand so next thing you know, the guy says Jeff, check this out and shows me a $10.00 dollar bill between the stack of 20’s. will a bank believe you if you told a bank teller????

We don’t do any hand counting that I’m aware of these days. A 7-11 ATM would seem like a huge risk vs. reward to me. I won’t go into specifics, but most store ATMs are replenished with five-digit amounts. By the time you break into the store, tear out the machine, and break into it, is it really worth the hassle? Hell, if it’s been busy since the last replenishment, you might get a few $20s in reject cash and some empty cassettes. Some of the bank ATMs have $1/4M or more. Between the alarms, cameras, and other security, they aren’t worth it either.

The fine count wasn’t done every day, mgt. wanted it done on this particle cassette for a reason i wasn’t aware of. when we replenished cassettes, the old bills were sandwiched in between 2 blocks of plywood the same size as the bill then rubberbanded to keep the blocks together.and put in a canvas bag.

It is a volume game with the ATM gang bandits (and most other organized crime burglar types such car burglars, motorcycle thieves and a few others).

They will rarely, if ever burgle anything in their home state. They will work in a different areas every night of the week. The FBI pays no attention to these as the dollar amounts are low and they can’t figure out the pattern. The local police are mystified because they normally know who did what right away based on past history, and they don’t know these people.

It is cash so there is no conversion, just split up between the guys. If they only average $3000 a night that works out to $90,000 a month if they work every day, or $70,000 a month if they take a couple of nights a week off, all tax free. Split that five ways and you are clearing $14-18K a month or $170K per person, per year.

The odds of getting caught are close to zero. They failed here because they went too late in the morning. If they had gone at 0300, the store probably would have been empty.
