Couple Charged With Defacing Black Lives Matter Mural

A resident received a permit from the local government to paint a temporary “Black Lives Matter” on the street in Contra Costa County. After the resident completed the task, a couple came up and placed black paint over their work. The county district attorney is bringing up charges against the couple. These charges include a violation of civil rights.

Both defendants have been charged with the following alleged offenses:

Violation of Civil Rights
Vandalism Under $400
Possession of Tools to Commit Vandalism or Graffiti

There have been additional incidents at the site of the mural since the vandalism. On Sunday evening, a 30-year-old Martinez man was arrested on suspicion of brandishing a loaded firearm and possession of a loaded and concealed weapon after an argument with another person at the downtown mural, police said.

Witnesses told police the suspect Joseph Osuna yelled, “All lives matter” as he drove past the mural. Police said Osuna then stopped, got out of his vehicle and started arguing with one person in a group at the mural site. During the argument, police said, Osuna brandished a .22 caliber revolver at that person. Police later found that revolver to be loaded.

If convicted, the two defendants charged Tuesday face up to a year in county jail. The alleged offenses are exempt from a specific bail amount due to the current county bail schedule in light of the COVID-19 pandemic.

So there appears to be good vandalism and bad vandalism. And before someone jumps on Hack saying the people who painted the BLM slogan had a permit, the people painting over were making their own political statement, and even though they did not have a permit, let’s just file it under civil disobedience.

Hmmm, painting over a yellow letter with black paint is a hate crime, but spray painting a War Memorial, burning down building, looting stores, and attacking white folks is not?

Many references to the incident refer to the BLM paint as “a mural.” That makes it more legal than “Letters painted on a street.”

Technically, I do agree that defacing a permitted display should be prosecuted. That principle should also apply to everybody who does so.

Seriously – this is NOT complicated. Arson should be prosecuted, as should all the assorted vandalism we have been forced to observe in the past couple of months. Doesn’t matter your “cause,” your ethnicity, your age or anything else other than you violated the law. Prosecute them all.

You can’t have equal justice until you have equal accountability.

I agree that if it was a permitted display then they need to be prosecuted for vandalism just like everybody else should be prosecuted for vandalism but a hate crime? I think not… I don’t even agree with the term hate speech there is idiotic speech but unfortunately and also quite fortunately it’s protected by the 1st amendment even when it’s stupid.

Dunno, they list three fairly specific charges and say “in addition” to the hate crimes. Given modern jounalistic accuracy, who knows… to me that street looks like it needs a new coat of sealer.

How was permission obtained? To alter PUBLIC PROPERTY, requires a formal request before the city council, public discussion hearings, and a vote on use of public property. Likely, would even demand an EIR from the paints/solvents used, street closure, chemical access of drainage to water sources, and cost of materials and personnel.

Otherwise, it is known as “graffiti”.
