If you haven’t heard, and even if you have heard, Daniel Bernath was killed in an airplane crash on January 22, 2018 in the afternoon. About 15 minutes after taking off from Page Field in Fort Myers, Florida, the tower received a Mayday call and Mr Bernath went down with his craft in the woods near a golf course in Bonita Springs, Florida. According to reports, the area was so overgrown, rescuers needed a bulldozer and machetes to reach the crash site.

Mr Bernath was the sole occupant of the airplane at the time.

The incident is being investigated by the National Transportation Safety Board and basically, I’m going to avoid commenting until that investigation has been completed. I ask that you do the same.

As you may be aware, Mr Bernath has accused us of sabotaging his aircraft in the past. Of course, that wasn’t true. No one I know would stoop to that level of stupidity. I wouldn’t know how to even begin to sabotage an airplane and the fact that I’m wheelchair-bound doesn’t make me stealthy enough to pull it off, if I did. I’m sure his accusations will be part of the investigation, though. For that reason, I will not comment publicly until the investigation has ended.

It’s certainly plausible that he being disbarred, disgraced, convicted, and imprisoned, he just decided to end it all. Or maybe it was an attempt at a phony sabotage setup on his part that got out of hand. Or given his apparent confusion just before the crash, maybe he was having a medical episode. Or given his history as a pilot, maybe it was simple pilot error. Regardless of what the cause is finally determined to be, it’s a sad yet somehow fitting end.

That radio transmission didn’t sound like medically-induced altered mental status to me. More like he had no clue how to talk on the radio. I wouldn’t rule out the staging of a setup that went awry, though. Interesting that he was very much off course when he crashed.

It is sad that someone has passed away and I’m sure his family is grieving. I can only extend my sincerest condolences to them on the loss of their friend or family member. However, it sounds like he was at odds with a lot of things in his life. I’m reminded of something that Bette Davis said when she heard of the passing of her rival Joan Crawford: “My mother said that you should never speak ill of the dead, you should only say good…Joan Crawford is dead. Good.”

A couple of strange things in the News-Press story:

Bernath wasn’t identified as the pilot, but apparently there was a flight plan filed or intent indicated for Immokalee as a destination from Ft. Myer. Since Immokalee is about 50 miles to the southeast of Ft. Meyer, why did the aircraft end up going down in Bonita Springs which is around 35 miles directly south. Why not a direct route?

Lee County Undersheriff Carmine Marceno was quoted as saying no foul play was suspected “at this time.” What’s up with that? When you hear the sound of hoof-beats, you look for horses and not zebras. Most crashes are due to either mechanical failure or pilot error.

Marceno saying such a thing might mean somebody either whispered in Marceno’s ear, or Bernath’s recent jail release raised flags. Otherwise, saying “no foul play is suspected” is about as goofy as saying: “We have no reason to believe duct-taped dogs got loose and seized control of the airplane.”

Interesting. A the father of a friend of mine was killed in Indianapolis in August 2017 in a Vans RV-12. He had over 50 years flying experience I believe. Makes me question the plane? I’m not a flyer.

I own and fly an RV-8 that I built 13 years ago. Van’s makes incredible kit airplanes. Don’t know the quality of the build on his but the Van’s series is one of the safest flying today all over the world. There are more RV’s flying than single engine cessnas. As for Bernath, see you in hell!!!

In my estimation, the RV-12 was too much airplane for his ability. I wondered how the aircraft made its way to Florida. My recollection is that he boasted of having flown it there, himself. It certainly is a doable thing for an ordinary pilot. I do not believe that DAB did ANY of the work that is typically associated with construction of a kit plane and something else I read lead me to believe that he payed Van’s or a capable builder to provide a ready-to-fly aircraft. From information on the local news outlets in Florida, it does not appear that it was stall/spin event. That the wreckage path is 250 feet long and that the remains of the aircraft look to reduced to small sections I wonder if he wasn’t already deceased before the aircraft made “landed”. Van’s produces very high quality kit planes and makes it possible for people with various degrees of mechanical ability to assemble a reliable and airworthy craft. Cloud cover in Florida is a fact of life and pretty predictable. That the “pilot” was asking for an assigned altitude of 8,000 feet, to fly about 50 nm is pretty bizarre! As you probably know, ATC does not assign altitudes for flight following, particularly not for VFR operations. In the back of my mind is the matter that the decedent had taken up aviation in a mountainous area, Oregon, where 8,000 feet may not afford much clearance above ground level! The runway in Flagstaff, AZ is over 7,000 feet. When I delivered a single engine plane from Lake Havasu City, AZ to Boston, I went for the service ceiling just to cross the Rockies and still had to pick and dodge a path to maintain adequate height about ground level. Hehe, 13,500 was supposed to be the service ceiling. By catching updrafts and thermals I managed to get damned close to it. My intuition is that Dan was dead before he hit the ground. IIRC, there was an incident a few years ago when DAB was atempting to land at another FL airport – on a CLOSED runway. After he landed, he was confronted about his actions and walked away.

Bernath did not build that plane from the kit. He bought it from a retired Air Force fighter pilot’s family. The USAF pilot had bought the kit from Vans and built the plane. The pilot had flown many missions in Vietnam. In the November 262 Sierra Whiskey tail number, the S & W are the original owner’s initials. Can’t remember his name.

The Continental O-200 engine is valuable. To the extent that the engine had not failed and that it was not operating at the time of impact, it may remain serviceable in whole or for salvage.

From the aerial video of the crash site, there does not appear to be much left of the airframe.

Regardless of my personal feelings about this particular individual, I wouldn’t have wished this ending for him.
I don’t think any of us can fully understand his thinking process or why he did what he did….My personal suspicions lean in the direction of dementia/organic brain disorder; Or, he was simply an asshole.
Whatever the case, wherever DAB is now, I hope his family at least finds some measure of peace.
