Editor’s Note: Apparently someone has broken into TAH past our multiple levels of defense. I assume it is satire, but we are looking into it. I only know that none of us did this. And Satire is apparently an absolute defense to all libels and slanders. One of the greatest legal minds of any generation told us that, so it must be true.

We’ll work on finding out who it is.

White, USN (Ret), who is the President of the National Association of Naval Photography, you know the group that Bernath claims bestowed upon him an “Honorable” Chief Petty Officer rank. Therefore, we would have no official records substantiating Mr. Bernath’s claim concerning the title. Gee, there was a full moon last night. I fully expected to hear howls of anguish coming to me on the western winds, but nothing.

I am a disabled United States Navy veteran of the Vietnam War and the Cold War. I am rated at 90% disabled by the US Department of Veterans Affairs. I suffer from PTSD, Depression and neuropathy, to name a few because of my service during the Vietnam War and during the capture of the USS Pueblo by the North Korea Communists/show of force by the US Navy thereafter and other encounters with the Soviet Navy and Air Force in the Cold War, serving in both the Atlantic Fleet and Pacific Fleet of the US Navy. http://www.yorktownsailor.com/yorktown/pueblo.htm

Because of my war times service and injuries I move much more slowly than before. I use one to two crutches at all times because if I do not I will fall over into a wall or onto the floor. My handwriting has deteriorated to the point where I can barely read it. Working on the flight deck of two aircraft carriers with screaming jet engines and no ear protection has affected my hearing, among other things.

Umm…please correct me if I am mistaken, but since when did VA disable anyone at 90%? Isn’t 80% or 100% depending on injuries?

I ask because I was rated 100% a few years ago but before that it was 80% as I still had all my limbs, eyes and hearing…

Can someone please explain to me?

Here’s a little bit of info about the DoD’s programs related to hearing conservation:

The introduction of the jet engine to the military in the late 1940s and early 1950s raised new concerns about noise hazards and helped motivate the development of military hearing conservation programs (Nixon, 1998). The Air Force, the Navy (which also has responsibility for the Marine Corps hearing conservation program), and the Army issued regulations or guidelines on hearing conservation in 1948, 1955, and 1956, respectively (Department of the Air Force, 1948; Department of the Navy, 1955; Department of the Army, 1956).

Note the dates: all post-WWII.

Don’t you have to have an extensive physical to get a pilot’s license?

When did he get his last license before he ran out of gas and crashed?

Would the FAA have that physical on file?

Who would have given him the physical? A regular doctor or someone at the VA?

Would the FAA give a license to someone who is rated disabled with the VA?

If would be interesting if the FAA subpeonaed his VA medical records.

The VA OIG and the FAA might want to have lunch.

Clams, I believe that the FAA requires a specific flight physical by and FAA-approved physician. OWB did bring that up on the original thread, http://valorguardians.com/blog/?p=38816

What’s worse is that bernastypantsman interfered with the FAA/NTSB investigation into the crash of his CT plane. Now, that could mean that he may have been hiding insurance fraud, too, which is a felony in most states. That has to be investigated.

But the ‘tangible benefit’ phrase in the 2013 SV Act is one thing that comes to my mind, as some people claiming Purple Hearts, for example, are given PH license plates in some states at no charge (meaning loss of revenue for the state) and they are also given handicapped placards for parking in handicapped-designated parking, when in fact, they are not handicapped at all. Those are two ‘tangible benefits’ that I can think of.

@75 Clamsgotlegs (I love that name), I don’t think a rigorous physical is required for the Sport Pilot license as it is for others. I don’t believe the FAA keeps a copy of the physicals, I could be wrong about that though. Whether one gets a license is dependent on the disability and whether the person can show that they can safely operate an aircraft within the regs. I knew an old WW2 pilot, legally blind, who rebuilt an old Stearman from the ground up. He took his check ride with an examiner and was issued (reissued actually) a restricted license stating he must fly with another able bodied pilot. It was one of the happiest days of his life when he took that old bird up with his wife.

For a flight physical it would be a specific doctor who is authorized to give flight physicals by the FAA.

@63 – TC, a person’s overall VA rating moves in increments of 10%. Depending on a person’s individual disabilities, and the rating given to each, it is possible to have an overall rating of 90%. Now, saying it is possible to have an overall 90% rating is not the same as saying that Bernath is telling the truth when he says that HE has a 90% rating.

In my opinion, Bernath is due less deference than President Reagan gave the Soviet Union, when he applied the maxim “trust, but verify.” With Bernath, in my opinion, it should be DON’T trust UNLESS and UNTIL you verify.

Anonymous Yelp Users Face Identity Disclosure

(CN) – Yelp must identify seven anonymous reviewers who left negative reviews for a carpet-cleaning business, a Virginia appeals court ruled.
With approximately 102 million unique visitors every month, the Yelp website allows users to post and read reviews of local businesses. Anyone who posts a review is required to have actually been a customer of the business in question, pursuant to Yelp’s Terms of Service.
To review a business on Yelp, a user must register and provide Yelp with a valid email address. While Yelp does not require users to register with their real name, it records the IP address of every user who posts.
In July 2012, Yelp displayed 75 reviews of Hadeed Carpet Cleaning in Alexandria, Va., a number of which were negative.
After finding no record that the reviewers were actual Hadeed customers from a review of its customer database, Hadeed claimed that the negative reviews were false and defamatory.
The business sued the John Doe authors of seven critical reviews and subpoenaed Yelp to learn the identities of the anonymous reviewers. Yelp repeatedly refused to respond to it, however, leading the trial court to hold Yelp in contempt.
On Tuesday, the Virginia Court of Appeals agreed, 2-1, that Yelp must identify the users accused of defamation.
While “an internet user does not shed his free speech rights at the log-in screen,” the right to speak with anonymity is not absolute, Judge William Petty said for the majority.

Re: flight physicals – a 3rd class flight physical (the lowest class of physical) is little more than a test to be sure you’re breathing, can stay upright for at least a short period of time without falling over, and are using corrective lenses if you need them (I exaggerate, but not by much). It’s such a joke that there’s now a bill in Congress to eliminate them for recreational pilots who fly visual flight rules and don’t fly for hire.

Yeah, it’s late, got home at 2 AM from work and had to shovel six inches of more white *$%&@&*!!!! off the driveway. Grrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrrr.

According to the “Anonymous Yelp Users Face Identity Disclosure” article attached to post #90, the people posting negative reviews of Hadeed’s business were not customers and were, therefore, making bonafide false statements. I wonder who has been making false statements in regard to Dan’s case/career? The article is a non sequitur:

1. Negative comments re Hadeed were false
2. Hadeed’s business was hurt because of comments
3. Therefore TAH negative comments about Dan are false

@TAH legal-eagle, question: when does discovery come into the legal process; id est: when does Dan have to prove his bona fides are, in fact, bonafide?
