All you have to do is contact the CMoH Society and prove he didn’t receive it and then he is punishable under the current law — up to $100,000 fine and up to 1 year in jail. I found a January 15, 2014 obituary for a Gary Alan Etheridge. Appearing in the obituary is a photograph of a man that bears a striking resemblance to the man in the Photoshopped image.

If anyone is interested in order his FOIA I found a newspaper story that provides the approximate date Mr. Etheridge entered the USMC and MOS.
On Page 6 of the August 6, 1965 the “Alice Daily Echo” newspaper, Mr. Etheridge’s name was mentioned. Mr. Etheridge’s name was mentioned in the “Military Round-Up” section of the newspaper; a section of the newspaper that discusses local residents serving or about to serve in the military.
It states: “Allan Ray Holmes, son of Mr. and Mrs. Wilburn R Jr and Gary Alan Etheridge, son of Mr. and Mrs B.M. Etheridge have enlisted in the U.S. Marines Corps under the 120 day delay program and will depart for recruit training at Marine Corps Recruit Depot, San Diego, California on September 2. Privates Holmes and Etheridge were guaranteed aviation upon enlistment and will go an aviation school in Memphis, Tennessee upon completion of Recruit training.”
