Captain Dylan Blaha criticized President Trump’s use of the military in cities

A captain of the Illinois Army National Guard posted a video on social media calling on service members to abide by the Posse Comitatus Act. He denounced the recent call to deploy troops to Portland, Oregon, and argued that this was authoritarianism and fascism. He further reminded military servicemembers that “I was just following orders” is not a valid defense against war crimes.

My name is Captain Dylan Blaha and this message is for all US military service members, especially every general and admiral meeting with Pete Hegseth on Tuesday. I am a 13 year US Army veteran who served in Afghanistan and wrote war plans while stationed at US Army Europe.

This morning Donald Trump directed Pete Hegseth to deploy the US military to Portland, Oregon. This is the latest illegal attempts to normalize the use of the military in US cities. He authorizes the military to use “full force”. This is authoritarianism. This is fascism.

The US military is not a law enforcement force and all federalized service members must abide by the Posse Comitatus Act. All members of the United States military must disobey illegal orders. “I was just following orders” is not a valid defense against war crimes.

Grow a spine and stand up for your fellow Americans. Otherwise, you are complicit in this fascist takeover. We’re running out of time.

I think we can both agree that he was engaged in a bit of “puffery”. “Writing war plans” sounds so much more macho than “writing the medical portion of paragraph 4 (Administration and Logistics) of a five paragraph field order”. After all, the mess officer can make the same claim.

According to his LI page he was a BN TF medical platoon leader. This is pretty normal for a 2LT. They don’t leave the wire much. I haven’t seen a picture of him at his current rank. In fact he won reserve medical officer of the year in 2024 as a captain and it his 2LT picture on the board. I haven’t seen a CMB or CAB so this seems unlikely.

Also being undergrad research assistant four years ago does not a scientist make.

Captain, you have evidently not studied history.
The United States military has been deployed on a number of occasions to assist local law enforcement, and federal law enforcement to do their jobs. The USMC was actually used to protect the U.S. Mail. As long as these troops are not actually performing law enforcement duties, but are being used as a protective force for the law enforcement units in the area there is no violation of the Constitution.
But you just had to open that hole under your nose and question the CIC. That, my young friend, is basically insubordination. You should have learned that in Captain School.

Well, once. I ordered a “curry wurst” in a bar the last time I was there. Very disappointing (reminiscent of British “cuisine”), but I suspect it was the “cook’s” preparation, not the item itself.

Well, I learned something because of this soon to be ex military guy. I’ve wondered how the War Department squares up an order to deploy troops domestically when at face value it’s contrary to the Posse Comitatus act.

Turns out there’s the Insurrection Act of 1807 which allows the president to use the military to suppress insurrection or enforce laws when civilian law enforcement is overwhelmed. Wikipedia says it was used by President Kennedy in 1962 at the Univ. of Mississippi to put down a riot which erupted when the federal government was enforcing integration of the university. 30,000 troops were deployed after the mob had injured 168 US Marshalls, 28 by gunfire. There’s a number of other articles about this act on the web.

Advising, counseling, or urging military members to disobey orders is punishable under federal law (18 USC Sec. 2387), which includes penalties up to 10 years in prison. 

Tack on whatever other punitive articles under the UCMJ that are applicable and charge him with all of them.

If there is any justice left, his political aspirations and future military career opportunities should be cut short.

I cut a set on a 2LT that told the General to get fucked and would have been out at 2400 hrs. that evening. He Got Court Marshalled. The General sent me a box of Cigars. I cut the order after everyone had left on a Friday evening and had to copy paste from the system!!!
