Syracuse man was killed with 2 guns in broad daylight. Was it murder or self-defense?

Syracuse, N.Y. ? Josue Pizarro was walking on Sabine Street around noon in April 2024 looking to sell drugs when he made a deadly decision.Pizarro grabbed a community gun, hidden on the side of a home on the 200 block of Sabine, as he was approached by a man he knew had served time for a murder when he was 15 years old.
The man, Jesus Carmona, was confronting Pizarro about a fight he had with Carmona’s friend, Pizarro’s attorney Nicholas DeMartino said.
Carmona had his hand hidden in his jacket as he got closer and closer, DeMartino said. As he began pulling his hand out, Pizarro pulled out the community gun and fired two shots before the community gun jammed, DeMartino said.
Carmona fell and dropped his own gun. Pizarro picked it up and fired around 5 more shots, prosecutor Anthony Copani said. Carmona died from his injuries.
Pizarro is now on trial for second-degree murder.

DeMartino and Pizarro insist he acted in self-defense. Copani says the shooting was an “overkill” that constitutes murder.

There’s kill.
And then there’s overkill.
There’s a definite line between self defense and murder.
Pizarro’s actions were premeditated murder, but so was Carmona’s. They weren’t going to back down and Carmona was going to kill Pizarro if he was shown any mercy.
So, it should be considered self-defense. But he’s a felon with an unregistered firearm. He should do time for that.
It was a community gun, only used in emergencies like when someone be stepping on your territory when you are doing business. That MF’r has a death wish.
It was a community gun most likely meaning that any of his community peeps that are in his circle can use it or lose it if you ain’t fast enough on the draw. Sounds like a 1950’s cigarett comercial on the Jack Benny radio show.
Strange story.
I have always heard that reaction is slower than action. I wonder if the DA is going to make that a part of his case?

Yes, the prosecutor and the jury get to decide how much self defense is allowed.

Pizarro’s problem is that once the other criminal was disabled, he picked up the second gun and fired more shots as “anchor shots”
That is forbidden in all 50 states.
The use of deadly force in self-defense is like a window that opens and shuts.
Once the threat is stopped, the window has shut and you cannot continue shooting.
