Dixie Drive shooting in Leland ruled justified self-defense

LELAND, N.C. (WECT) – A homeowner will not face criminal charges in a shooting death that occurred on Jan. 2 at a residence on Dixie Drive in Leland after investigators determined the use of deadly force was legally justified under self-defense laws.

The District Attorney (DA) Jon David’s office concluded its investigation into the shooting that resulted in the death of Dylan Hennessey.

According to the DA, after reviewing witness statements, photographs, videos, and autopsy reports, in consultation with the Leland Police Department, prosecutors determined the homeowner acted within the law.

The DA reports that around 3:32 a.m. on Jan. 2, the Brunswick County 911 Center received a call from someone at the Dixie Drive residence reporting that a man was dying and first responders needed to hurry. When Leland Police investigators arrived, they found Hennessey dead inside the home from multiple gunshot wounds.

The investigation revealed that Hennessey and his friend Dustin Powers arrived at the residence approximately eight minutes before the shooting. Hennessey was in an on-and-off relationship with a woman who was at the home with a female friend and the male homeowner.

Hennessey learned the three were together at the residence and drove there with Powers to confront them, according to the DA. Hennessey had pending domestic violence charges in New Hanover County involving the same woman.

Upon arrival and seeing his girlfriend with the homeowner, Hennessey and Powers allegedly attacked the homeowner, according to the investigation. The altercation began outside, but the two men allegedly dragged the homeowner into his residence.

The DA states that during the confrontation, the homeowner retrieved a firearm and fired five rounds. Hennessey was shot and killed, Powers was shot in the wrist, and the homeowner was shot in the foot.

The homeowner and both women cooperated with law enforcement and provided detailed interviews, the DA says. The State Bureau of Investigation (SBI) processed the crime scene and collected evidence, including brass knuckles.

Powers faces charges of breaking and entering with intent to terrorize and first-degree kidnapping.

When you are actively in a physical fight with 2 other individuals, you might not be the only one providing input as to the direction of the muzzle. Those involved just might have provided additional direction input to the weapon. One should not assume there was any distance between the combatants at the time the weapon was included.
