Over staying a visa is a civil issue with no criminal penalty but it does not make one undocumented. The person is undocumented if they never had a visa. The left seems very confused about this.
That’s why undocumented is a weasel word and “undocumented immigrants” is a weasel phrase.
They are illegal immigrants regardless if they crossed the border or overstayed a visa.
Crossing the border without entering through border control (illegal/ unauthorized entry) is a crime. The first offense is a misdemeanor and subsequent offenses are felonies.
Overstaying a visa is not a crime. It isn’t in the criminal code and there is no fine or incarceration associated with it.
Conflating these issues is part of the problem. Please stop doing that.
The Republicans are trying to advance a bill to make over staying a visa a crime but they are running into headwinds. In particular is the problem that most nations have agreements with the US that a visa overstay isn’t a crime to avoid arresting each other citizens for situations that don’t merit it. It is unlikely this will pass and I don’t think it should.
Someone might overstay a visa through no fault of their own, say a cancelled flight or some kind of emergency (personal, local, national) prevents travel. I personally would prefer not to get arrested in Italy because the airline cancelled my return flight due to a strike and I was unable to immediately re-book. There are literally an endless stream of situations that may arise that could prevent travel which is why it is a civil matter.
So? Overstayed a visa through no fault of your own?

Write into the law “overstayed the visa by 6+ months”.
That should take care of transportation “oops”, lost/misplaced paperwork, memory gaps, whatever.

Maybe. Maybe not. Your thinking may be heavy but lacks both imagination and real world knowledge of actual problems that people have.
Suppose one has become pregnant and travel is unsafe for some reason? Maybe they had a child and the child can’t travel for medical reasons? Or some other medical condition that makes travel impossible? What if one gets arrested for another crime (possibly even innocent) and the court orders the suspect not to leave the country? You would arrest a new mother whose premie baby is in an incubator and requires a surgery to survive?
When I say there is an endless stream of reasons why someone might not be able to travel, it is no exaggeration.
Over staying your visa doesn’t mean you can’t be deported. People are deported every day for over staying their visas. People who overstay often also get a temporary or even permanent bar to reentry. These I am in favor of. But putting someone in jail makes little sense. Just send them home.
So simple mistakes, miscues and unforeseen medical issues could be granted a waiver. I can see that, but basic, unapologetic ass-hattery, as is the cause with the vast majority of these turds should NOT be allowed. I don’t claim to know the law but get it into law. I’m with Toxic on this big time.

And that very common happening, is NOT from a cancelled/missed flight, a new war zone on the other end, or any other excuse that is actually out of the visa holders hands.
I understand and agree with working with someone that overstayed their visa at no fault of their own, BUT there are many, many, many, that know, have learned or are learning how to game the system. Somehow, THEY become the victim!!
