El Salvador’s president will not be returning illegal alien to the US
Abrego Garcia, illegal alien, was recently deported back to El Salvador. Garcia was subsequently sent to El Salvador’s gang prison. The court handling this case called on the Trump administration to return the man to the US and even asked the administration to provide information on how they would accomplish this. However, El Salvador’s president, Nayib Bukele, ended all doubts by stating that Garcia would not be returned to the United States.

Trump administration officials emphasized that Abrego Garcia, who was sent to a notorious gang prison in El Salvador, was a citizen of that country and that the U.S. has no say in his future. And Bukele, who has been a vital partner for the Trump administration in its deportation efforts, said “of course” he would not release him back to U.S. soil.
“The question is preposterous. How can I smuggle a terrorist into the United States?” Bukele, seated alongside Trump, told reporters in the Oval Office Monday. “I don’t have the power to return him to the United States.”
Should El Salvador want to return Abrego Garcia, the U.S. would “facilitate it, meaning provide a plane,” Attorney General Pam Bondi said.
But “first and foremost, he was illegally in our country, and he had been illegally in our country,” she said. “That’s up to El Salvador if they want to return him. That’s not up to us.”
The refusal of both countries to allow the return of Abrego Garcia, who had an immigration court order preventing his deportation over fears of gang persecution, is intensifying the battle over the Maryland resident’s future. It has also played out in contentious court filings, with repeated refusals from the government to tell a judge what it plans to do, if anything, to repatriate him.
The judge handling the case, Paula Xinis, is now considering whether to grant a request from the man’s legal team to compel the government to explain why it should not be held in contempt.

What is the scope of an Immigration Courts dominion? Why would a court have jurisdiction over illegal aliens that would thwart their deportation?
Cherry picking which “rights and entitlements” illegal immigrants have is a fool’s errand, he could just as well have been deported to Mexico, I suppose.
For that matter, he could have been deported to Langley Park but still not have been able to avoid the usual gang cultures.

It has already been stated by government officials that – had they followed the initial court order saying he could not be returned to his native country – he would have gone to GITMO instead. He is a recognized member of MS-13 (a fact the media is conveniently ignoring) which has been designated a terrorist organization.

Compounding the problem is that the Government filed a brief earlier that said he was deported in error and he wasn’t in MS-13. The lawyer that filed that brief has been fired and was believed to be (and accused of being) a deep state mole and that the brief was false.
If that is true then the lawyer needs to be disbarred (or at least censured) for knowingly filing a false brief.
The only error in his deportation was that he wasn’t supposed to back to El Salvador. Oops. El Salvador has elected to keep him. It’s still a win. He was their criminal then, he’s their criminal now.

To be honest, at the moment the only option within the law would be for the US Government to diplomatically request the El Salvadoran prisoner be released to the custody of US officials and immediately loaed on a plane from El Salvador directly to GITMO. Do not pass Go, do not collect $200.
Yup. All the US Government can do is ask nicely. If El Salvador says “NO”, it’s game over and the judge can go and have herself a nice day.
Just to settle this, for the left, I hope that Pam Bondi files a request with the government of El Salvador, asking for the return of the wife-beating gang banger. Where upon, the government of El Salavador says, “Nope, he stays here”.

One of the things that is not being mentioned is the impact that Bukele has had on his own country. The murder rate in El Salvador has plummeted by 98.3% in ten years. They went from the worst homicide rate in the world to almost the lowest. He literally locked up nearly 2% of the country and held some without trial, most without bail. So if they think he is in a gang he isn’t coming back to the states, ever.
There is a great good news story underneath all that and Pam Bondi’s relationship with Bukele proceeds current events. Bukele was reelected with 85% of the vote after that performance in 2024.
The real lesson here is that yes, 98% of the violent crime in the world is caused by 2% of the population.
As a collary to the above, two years ago the El Salvador Congress legalized the ownership of illegal firearms by private citizens.
Firearm laws were hugely strict in a failed effort to combat crime but everyone owned a gun anyway because the country was so dangerous. Citizens who now self report their “illegal guns” can now keep them, provided they aren’t stolen from the military or police.
