Woman fired based on questionable racial profiling complaint

A woman decided to move a rack at her employment. Utilizing Composite Risk Management (CRM), she looked to make sure that she was not going to hit anybody. She saw someone, who asked her if she needed help. When she responded that she didn’t need help, the individual informed her that she was going to file a corporate complaint against her.

Here’s a transcript of the transaction:

So I normally don’t do this on Tic Tok but today I am livid. So I want your opinion to see if this kind of thing is justified.

So I work at a retail store and I’ve worked there now for like a year and a half. Well, I’m moving these racks and I didn’t want to hit anyone. So I kind of looked to each side to see if anyone’s on the other side to see if I can move it.

Well, I look this way and I end up seeing someone. So I stop and I don’t move it. Well, she instantly looks at me and says, “Can I help you with something?” And I’m like, “Oh, no, I’m sorry, I was just going to move the rack and I want to make sure I didn’t hit anyone.”

Well, then, she says, “I want to put a corporate complaint against you for racial profiling,” because apparently I looked at her the wrong way and was assuming she didn’t have money.

I would never just assume someone doesn’t have money by what they look like. That is stupid. Well, I had to give a whole statement about the thing and overall they called me up today and fired me due to me looking at someone and being racist.

So, do you think that’s justified or do you think that’s wrongful termination? Because I’m pissed.

So, what you guys think? Wrongful termination?

File complaints and file suits based on those complaints.

results in immediate settlement of all issues. Then they get cancelled.

Was the complainant REALLY mad because she had positioned herself to be hit by the moving rack, which the (former) employee thwarted with her diligence? That, or something equally ridiculous?

Anybody can file a lawsuit for just about anything. Doesn’t mean the case has merit. Complaints work similarly. Wasn’t there – don’t know what happened, but this sure sounds nuts. Could well be more to it than we have heard so far.

Too many folks out there looking for something to grumble about. What a way to live.

I got fired once for ‘inappropriate communication’ because I was talking about 2 people at the end of our table when a coworker asked me who the director was. I told him it was the Black gentleman on the left. I was told that was racist and fired that week.

I thought for sure this was going to be a Union complain, that the other individual was upset because she did not use her to assist in the work and therefore denied her the ability to help!
Or maybe it was a Union complaint that this individual was not “qualified” to move Racks and due to her lack of understanding of the union initiated safety code, she did not have four people to do the job (one to supervise, two to ensure no one is able to block the path, and one to do the work), notify the store employees at least two weeks in advance to ensure no one wanted to suggest a different orientation for the rack, and to properly place the safety cones that prevent customers from accidently stepping in to your work space (may need additional workers to place these). Oh, and don’t forget about the environmental impact study!

Heaven forbid an employee just move a rack (to help customers access merchandise)!

Is there any evidence that this “Tik Tok” Post is from:

1 – A Real Person.
2 – Who work(ed) at a retail store.
3 – Was terminated from her job.
4 – Because she looked at a “person of color”* with an incorrect facial expression.

As opposed to a “troll bait” posting what could anger/incite a reader, some of whom would call for shutting down such a store / encourage her to file suit / take the position of the *POC,…,

while said troll looks at the responses and says … truthfully …

Not sure if the story is based on fact or not, and I’m certain this isn’t the whole story.

But even if the situation is exactly as claimed, while the alleged firing would in that case appear to be obviously unfair it’s IMO almost certainly legal. If the individual featured here works in an “at will” employment state and isn’t included in some type of employment contract (individual or collectively-bargained), I’m pretty sure she’s SOL regarding any wrongful termination suit. Her conduct doesn’t seem to fall into any of the legal exception categories identified in the linked articles below that would make it wrongful termination. And per the second linked article, the only state in the US that isn’t an “at will” state is Montana.
