Two people shot in attempted Glens Falls break-in<\/strong><\/p>\n

Two people were shot in Glens Falls, following what police are calling an attempted home invasion.<\/p>\n

The two people shot were breaking into the home when a third person who lived there shot them, a city spokesperson said. The two remained at Albany Medical Center Thursday night, with one in critical condition.<\/p>\n

A part of Cherry Street was also taped off as part of the investigation.<\/p>\n

Glens Falls Police and New York State Police were interviewing the alleged shooter and trying to determine what crimes were committed.<\/p>\n

All three of the people involved are from the Glens Falls and Hudson Falls area, police said.<\/p>\n

Local attorney Tucker Stanclift is representing the person suspected of firing the gun. He described a case of self defense as the break-in unfolded.<\/p><\/blockquote>\n

\nCiting a self-defense statute, Flathead County Attorney Travis Ahner chose not to charge the shooter who allegedly killed 36-year-old Jeremy McKenzie last April<\/em><\/p>\n

\nAlmost a year after an April 2022 shooting at the Snowslip Inn in Essex that left 36-year-old Jeremy McKenzie dead in the parking lot, Flathead County Attorney Travis Ahner has chosen not to charge the shooter following an investigation that raised \u201cissues of self-defense.\u201d<\/p>\n

\u201cWe didn\u2019t think it would be a successful prosecution based on self-defense,\u201d Ahner told the Beacon.<\/p>\n

Following an investigation by the Flathead County Sheriff\u2019s Office, Ahner said information from search warrants, subpoenas, witness accounts and a physical exam of the scene indicated prosecutors would not likely win the case.<\/p>\n

Flathead County Sheriff Brian Heino concurred with the county attorney\u2019s decision and said the \u201ccomplexities\u201d in the case would have made it difficult to prosecute, while statutes associated with self-defense presented additional challenges.<\/p><\/blockquote>\n
