BOOM: ICE Throws Down the Gauntlet, Arresting Two Illegal Aliens in a California Courthouse

An addendum to the San Diego Sheriff’s post, mentioned were ICE agents reportedly arrested two people at a Northern California courthouse, ignoring a recently introduced state law barring immigration agents from making arrests at such facilities.

ICE agents arrested two illegal aliens in a courthouse in Northern California, defying a state law that says they needed a warrant from a judge to do so.

ICE flouted a new state law that requires the warrant before arresting an illegal on courthouse grounds. After the predictable outcry from courthouse officials and others, ICE calmly gave their rationale.

Los Angeles Times:

ICE said in a statement that California’s law doesn’t supersede federal law and “will not govern the conduct of federal officers acting pursuant to duly enacted laws passed by Congress that provide the authority to make administrative arrests of removable aliens inside the United States.”
“Our officers will not have their hands tied by sanctuary rules when enforcing immigration laws to remove criminal aliens from our communities,” David Jennings, ICE’s field office director in San Francisco, said in the statement.

In other words, ICE is telling critics to go piss up a rope.

ICE’s actions follow the deployment of Customs and Border Patrol agents to sanctuary cities and states. The state government of California bitterly criticized that move, but find themselves unable to do anything to prevent it. The Department of Homeland Security, the agency under which ICE and CBP operate, can send its personnel anywhere they see fit to send them.

Again critics of the arrests dragged out the usual trope: illegals will now hesitate before helping the police or participating in the legal system. Good for them. If California doesn’t want to abide by the laws of these United States, they can try to secede. Didn’t work so well for the states that tried that before, but California isn’t one to let a little knowledge of history interfere with plans for the future.

Note the use of the word “flout” in the piece. Are they likely to use flout when referring to the “sanctuary” jurisdictions who ignore US law? Didn’t Arizona get its pee-pee whacked by SCotUS a few years ago, based on the interpretation of the Constitution bein’ that immigration was the sole responsibility of the Federal government?

They can in school board elections in the city of San Francisco.

That’s blatantly false. The investigative task force was stonewalled by the state governments that didn’t produce the data requested/required. Don’t know why, but they just gave up. Probably because anyone who has voted in the US can see the obvious and myriad flaws in our system that will allow pretty much anyone that wants to to vote.

Being that I live ( and vote) in California I can tell you there is absolutely no desire for them to check to see who is voting illegally.
You can register to vote when you get your Drivers Licence or Ca ID simply by checking a box saying you are a citizen.. they even conveniently print the form in several languages.
My wife ( who is not a US citizen) gets bombarded every year asking her to register. All she would have to do is lie on the form and send it back.

Wrong answer dude. The motor voter law is specifically intended to allow wetbacks to register when getting a drivers license, which they also should not have. Last year almost a half million people refused jury duty by saying they were not citizens, and California gets their jury pool from voter rolls.

This could be really interesting since the 9th Circuit has a few new members that are more supportive of the Constitution – and it’s a sure bet that California will file an appeal that will go to them for a hearing. They might just find themselves in a cold dark place all of a sudden (and I don’t mean ICE)!

Was actually just looking at the makeup of the 9th Circus yesterday. Trump’s got ten active judges now to Zero’s six. Clinton’s still got nine active with six in senior status. GW has three active, four senior. Amazingly, Nixon still has two judges there (both in senior status obviously). Carter’s got four, Reagan three, and GHW Bush two each in senior status.

Crazy to think that there are judges hearing cases who were nominated by fucking Nixon almost 50 years ago. With Trump putting a lot of young people on the bench, he’ll be felt for at least that long.

So if California seceded it would be California cutting of aid to the emerald government and all the more than a dozen third world red states that take more than they contribute.

California is the 1/6th of the US GDP while only 1/8th of the US population.

So are we back to enjoying over arching federal government tactics today?

Most days I look at what the Feds are doing and I don’t see a whole lot of effort put into actual meaningful programs designed to make life better I simply see another administrative action designed to reinforce the notion that the Federal Government is in complete and total control whether anyone likes it or not.

If this were a second amendment consideration I wonder if we would all be so happy to see Federal intervention against state wishes….I suspect not.

I realize that the second amendment is a constitutional right as opposed to federal immigration law, but ICE grabbing people in courtrooms? What’s next the DEA arresting recreational dispensary owners against state wishes?

The Feds thinking they always know what’s best for local LEOs is a large part of the problem with cooperation on a variety of things well beyond immigration.

If your state has a large non-criminal illegal population (Reagan and Bush both tried to offer paths to citizenship for those in that situation), how does this help utilize that population to combat local gang problems? If testifying against a gang means being deported by ICE while you attend court…guess who’s no longer going to help local LEOs fight gang intrusions?

This nonsensical showboating solves nothing long term. It’s a reality TV move designed to get the base excited, because it works for that end. It doesn’t matter if it’s doing anything at all useful in the larger picture.

VOV, I rather suspect that “ICE grabbing people in courtrooms” was a carefully planned demonstration of the Trump Administration’s intent to put and end to this state sanctuary business as regards illegal immigration.

In the case of the 2d Amendment sanctuary movement, it is not self-serving, Democrat-controlled state governments seeking to evade Congressionally-promulgated federal statutes for political gain, but the citizenry within such states seeking to preserve a Constitutionally-imposed prohibition against these states’ interference with their citizens’ keeping and bearing of firearms.

These are not just different issues–they are two vastly different issues.

Grabbing dispensary owners would not be an entirely different issue though as I did note the 2nd amendment issue was not quite the same at all.

Federal DEA agents could arrest a dispensary owner using the ICE tactics as well, and for me that would be just as wrong as this is.

Setting the Feds against locals is simply bad policy, what was gained by this? Does anyone think that California is suddenly afraid of the Trump administration?

All this did was to make sure that local LEOs won’t get any cooperation with local illegal crime issues now, to the detriment of all their citizens.

I’m not at all a fan of illegal immigration, but I was never a fan of Federal Government displays of power simply for the purpose of display.

Most likely? I’d venture a legal challenge by California which will first be appealed to Trump’s remodeled Ninth Circuit by whichever side loses in federal district court, then to Trump’s remodeled Supreme Court by whichever side loses in the Ninth.

NO, what we are up to is Federal agents enforcing Federal law as they are supposed to, in the face of criminal behavior on the part of the state of California. And the illegals are not doing a thing to aid law enforcement. In just about every case, they are there as criminal defendants. It isn’t really complicated. I don’t really care why they are here, or what they are doing in the court, I want them GONE. They should not be here, they don’t belong here, and they can go back where they came from and DO IT RIGHT.
