California sheriff complies with ICE subpoenas on jail records
ICE served the subpoenas on San Diego County Sheriff Bill Gore for the jail records of four Mexicans in the U.S. illegally, according to reports.
A sad state of affairs when compliance with Federal Law Enforcement makes the news. But this is Sanctuary State California where such cooperation is rare indeed, nearly unheard of. In fact, Immigration and Customs Enforcement (ICE) agents have reportedly arrested two people at a Northern California courthouse, ignoring a recently introduced state law barring immigration agents from making arrests at such facilities.
So a California Sheriff working with ICE to turn over the jail records is a breath air. From the article:
A California sheriff is refusing to ignore subpoenas for information from the U.S. Immigration and Customs Enforcement.
ICE served the subpoenas on San Diego County Sheriff Bill Gore for the jail records of four Mexicans in the U.S. illegally, according to reports.
Gore issued a statement Thursday announcing that he was complying with the demands.
“A truly authorized federal administrative subpoena has to be honored,” Gore said, according to NBC 7 San Diego.
Similar administrative subpoenas have been issued to law enforcement agencies in Denver, Connecticut, New York City and Oregon.
Gore is the first to comply, ICE spokeswoman Lauren Mack said.
The subpoenas are among several recent moves by the Trump administration against what it considers “sanctuary” jurisdictions, which adopt laws and policies to limit cooperation with immigration authorities.
In his statement, Gore said a subpoena trumps California’s sanctuary law.

The four Mexicans targeted in the subpoenas were arrested for charges such as sexual assault of a child, robbery, battery, and drug possession, NBC 7 reported.
Each man, ranging from ages 28 to 42, was arrested in the last few months by the San Diego Police Department, according to the station. Two remain in county jail and two have been released, according to ICE.
Of course the Libs are outraged, dragging out tho old trope that “ICE’s issuance of subpoenas, and Sheriff’s Office’s potential compliance, endanger public safety and community trust.”
Except it doesn’t.
Sanctuary policies aren’t necessary to report crimes without fear of deportation. Section 101(a)(15)(U) of the Immigration and Nationality Act provides legal authority for a non-citizen who reports a qualifying crime to local authorities, and assists, or may be of assistance, in the prosecution of the crime, to become eligible to apply for authorization to remain in the U.S.

I thought that Federal Agents were charged with enforcing Federal Law, and that Federal Law

This is right wing propaganda nonsense. It is conflating “sanctuary policies” with honoring subpoenas. Sanctuary policies are based on the constitutional FACT that states have ZERO authority to enforce immigration law or our borders, that is an undisputed FACT. Border enforcement and immigration enforcement is ENTIRELY federal jurisdiction and it CANNOT be delegated to states. Unlike most of you armchair keyboard warrior border enforcement militiamen I actually have apprehended border crossers, drug smugglers, and human traffickers and turned them over to Border Patrol or Federal officials. When I was a deputy along the US-Mexico border and I detained a suspected undocumented immigrant I was doing so ENTIRELY as a private citizen, I had ZERO legal authority to hold them for longer than the laws I had jurisdiction to enforce allowed. That means I could detain them only for violating a state, county or local law, and hold them only as long as it took to enforce that law. And I could only ask them questions related to things for which I had jurisdiction unless it was a voluntary interaction. When I pulled a vehicle over it was a DETENTION and thus the interaction was never voluntary.. I and other deputies were putting ourselves, our department, and our county on the hook for potential lawsuits since we were acting beyond our jurisdictional authority if we detained them for anything outside our jurisdiction or if we detain3d them for longer so the Border patrol could get to us. Sanctuary cities simply refuse to act outside their jurisdictional authority. They do it for generally ideological reasons but they are actually acting far more in compliance of the constitution than those that honor federal REQUESTS to detain and turn over suspected undocumented immigrants. Sanctuary cities also prevent entire communities from being potentially victimized because they cannot safely call, cooperate with, comply with, or rely on local law enforcement. Zero legal authority? Isn’t illegally crossing the border a crime? Now, simply BEING here is only a civil offense. But now you are saying you were detaining them a) because you pulled them over for some other offense or b) had no reason to, so you were just harassing them?
It is not a crime state and local authorities have the legal or constitutional jurisdiction to enforce.
