Supreme Court Allows Public Charge Immigration Restriction

The Trump Administration implemented a public charge restriction on immigration. If the US government felt that someone seeking to immigrate would take advantage of assistance funding, they could be denied immigration.

Democrats and other “progressive” groups opposed this move. They pushed this to the court system and managed to get trial judges to halt the government from enforcing this policy. The “progressive” justices wanted to support the block. The conservative justices argued against using wide-ranging injunctions for the whole nation when such was outside of their lane.

While a “public charge” inadmissibility standard has long been part of U.S. immigration law, it had not been formally defined by statute. The rule, announced by U.S. Citizenship and Immigration Services in August, defines a “public charge” as an immigrant who received one or more designated benefits for more than 12 months within a 36-month period.

“The principle driving it is an old American value, and that’s self-sufficiency,” USCIS Acting Director Ken Cuccinelli told Fox News in an interview last year. “It’s a core principle — the American Dream itself — and it’s one of the things that distinguishes us, and it’s central to the legal history in the U.S. back into the 1800s.”

Those benefits that would be designated included Supplemental Security Income (SSI), Temporary Assistance for Needy Families (TANF), as well as most forms of Medicaid and the Supplemental Nutrition Assistance Program (SNAP), commonly known as food stamps. The rule expands the number of benefits that can be considered from interim guidance issued in 1999.

The public charge rule has faced fierce opposition from immigrant activists, as well as many Democrats — who have opposed measures to limit welfare for immigrants, while also calling for the extension of various forms of government aid to illegal immigrants as well.

Good! I’m all for some social safety net stuff like SS disability, food stamps, and unemployment. Those things are for our people though and should have some reasonable limits on them. What right does anyone have to walk into my house and start taking food from the fridge?

Or get you a job, pay you some taxes, and apply for citizenship in the legal accepted manor. You left out an adjective that goes with “buying votes.” They are buying “illegal votes,” as illegal aliens, in fact all aliens, even the legal resident ones, are not entitled to vote in our federal elections, period. That was the principal impetus for the D-rats efforts to give drivers’ licenses to illegals and use motor voter laws to give them an easy opportunity to register to vote. They are only one motor-voter form check box away from getting a ballot, once they get a license.

The interesting thing about this entire subject is the Democrat’s previous position that all these people come to do jobs no Americans want. If that’s true why do they need public assistance?

If they are coming to fill jobs, let them work and fill those jobs. If they are coming to free load that’s a different issue.

The law still allows for public assistance to true refugees to help them resettle and become acclimated, which I think represents a positive undertaking for true refugees.

As I understand this, it does not apply to illegal aliens since it concerns people applying for legal entry or bumping up their citizenship status; ie. from visa to green card. They have to provide some indication that they will not be a public charge, which hopefully would catch some who want only to emigrate and live off governmental largesse. I don’t think this has any effect on illegals who bypass the system (and then try to live off governmental largesse, but that is a different argument.)
