The VA governor, Ralphie Northam,  is now impinging on the 1st Amendment right of freedom of speech in the state of Virginia. People  will not be allowed to criticize government officials (meaning him) or say bad things about them/him without penalty.

Wow. He must like being stupid enough to set himself up for a massive federal lawsuit. Someone should tell him he’s riding for a nasty fall when he does these things.  He claimed he was a pediatric neurosurgeon, didn’t he? I want to see some proof of that claim, because I find it very difficult to believe he got through undergrad school, never mind anything higher.

From the article:  In the wake of the Virginia gun rights rally on Monday, Democrats in the Capitol are not slowing down their push for tyranny. They are moving a bill through the legislature that would effectively criminalize dissent against Governor Northam and other state government officials.

House Bill 1627 was introduced by Delegate Jeffrey M. Bourne last week. The legislation “provides that certain crimes relating to threats and harassment may be prosecuted in the City of Richmond if the victim is the Governor, Governor-elect, Lieutenant Governor, Lieutenant Governor-elect, Attorney General, or Attorney General-elect, a member or employee of the General Assembly, a justice of the Supreme Court of Virginia, or a judge of the Court of Appeals of Virginia.”

Language in the bill explicitly criminalizes free speech, in what would constitute a blatant attack on the 1st Amendment of the Constitution. – article.  If you think the rest of the Democrats aren’t watching this, you aren’t paying attention.  Since there is nothing in the 1st Amendment to the US Constitution that criminalizes publicly saying that someone is an ass, this proposed bill violates the law regarding free speech.

Making threats toward someone can be considered prosecutable if taken in context, e.g., an image of some kind of weapon or a noose is included or it is part of a video. That should, indeed, be looked into, however, local law enforcement is mostly busy trying to prevent mayhem as it is, and not get involved in other people’s quarrels unless they turn violent. But making vulgar, snide and derogatory public remarks about someone is not a crime of any kind. It is just bad manners and sometimes an effort to get attention from an audience. Criticizing someone’s actions is not illegal, either. Under that bill’s language, criticism can be considered harassment. Trying to criminalize such speech because it might hurt those precious feelings is a violation of the First Amendment’s clause about freedom of speech.

I know the PR flag as the guillotine blade is just symbolic, but the Puerto Ricanos want that silly bitch and her butt buddies gone. The discovery of disaster relief supplies that were shipped to the PR and warehoused instead of being distributed, two years after Hurricane Maria whacked that lovely island of tropical breezes, is at the root of this anger.  Why weren’t those supplies distributed? Why?

He was a Pediatric Neurologist and did have a practice under a Teaching Hospital in the Hampton Roads Virginia area, i.e. Eastern Virginia Medical School (home of his Famous Yearbook picture) as well as Children’s Hospital of The King’s Daughters in Portsmouth, VA.

I THINK he was practicing while he was LTGOV, but is not practicing now because of his current position as being the WORST Gov of VA.

For the record this is why I give money to the ACLU from time to time, they get a bad rap for some of their stands with those less popular causes but they were the only ones standing against the FEDS when they tried to violate the rights of countless Americans.

They will also litigate this should the law pass because the ACLU is at least consistent in their defense of our civil liberties.

Sorry, but this post is a distortion of the facts. Virginia has laws on the books that deal with harassment and threats against people. Not just government officials, but everyday people like you and me. So if the owners and writers of this blog were getting threats or harassed (which is beyond “free speech”) they would have a remedy in Virginia. This bill does not change what was already on the books. It only amends the law in a specific way. I get the idea that people think the law was expanded to include the Governor, etc, but that is not the case as the law already protected people and the last time we looked, the governor was a person. The law did include a provision for the Governor and their family which read: 18.2-60.1. Threatening the Governor or his immediate family. Any person who shall knowingly and willfully send, deliver or convey, or cause to be sent, delivered or conveyed, to the Governor or his immediate family any threat to take the life of or inflict bodily harm upon the Governor or his immediate family, whether such threat be oral or written, shall be is guilty of a Class 6 felony. What is different about the governor in the law is not the act of harassment or threats, but the penalty. It is the same thing as making a real threat against the president, if convicted, a stiffer penalty than a real threat against a neighbor. Once again, that section of the law is not new. It was on the books and had been on the books for years. (The law also includes protection for teachers, doctors, and medical personnel school buses, school grounds or on duty.) What this bill did was to amend existing state law to state the venue / jurisdiction of where a trial for the law would be held if the threatened or harassed person was a member of the government. Gitarcarver, it would appear that what the black delegate who proposed these changes (who is from Richmond, by the way) is doing is seeking to bring the trials for such violations into a black majority, safely Democrat venue. What with so many counties having declared themselves 2d Amendment sanctuaries, Democrat politicians, especially blacks, are probably fearful of majority white, conservative juries in much of the remainder of the state.

They damned well should be.

I did not mean that to sound as if blacks should be fearful of white juries because of race, but rather because of the prominent role of minority democrats in supporting all the anti-gun legislation. Remember, it was a black delegate who called on the governor to use the National Guard against Virginia citizens.

Liberal blacks pushing for anti-2D Amendment laws would do well to remember that they were kept subjugated for decades after the Civil War by being denied firearm ownership by by Southern Democrats.

My point was only that this was not a bill that deals with the First Amendment or criticism of elected officials, but a bill that deals with the venue.

While you may be correct in the reasoning of some to support the bill, to me there is a practical side to it as well. I can and do see both points of view.

I agree that southern blacks should well remember history.

I would offer that we all should remember current events as well.

By that I mean that data over the past few years has started to show the race related crimes are happening with more frequency in the Northeast and on the West Coast. Rates of the crimes per capita are greater there than in the traditional “racist south.”

Facts don’t matter to some people.

There is indeed a practical side to it that is both politically and geographically advantageous to the liberal Democrats promoting this legislation.

Politically in the sense that liberal Richmond will more likely provide friendly juries willing to convict those from other areas of the state.

Geographically in the sense that state prosecutors will be operating on their home turf with all their prosecutorial resources readily available so that they are not required either to travel or operate from a distance.

It’s clearly stacking the legal deck against offenders from outlying conservative areas of the state.
