Navy SEAL accused of murder to be moved to less restrictive confinement

We’ve all heard of SOC Gallagher, placed in pretrial confinement at Miramar- he has been there since September 11, 2018. He has been charged with war crimes stemming from a May 3, 2017 incident in which an ISIS fighter was stabbed in the body and neck until he died. Gallagher also faces aggravated assault charges from separate incidents, abuse of drugs, possession of steroids, and obstruction of justice.

Relatives and lawmakers have protested the SEAL’s confinement. On Capitol Hill, Rep. Ralph Norman, South Carolina Republican, said on Friday that Mr. Trump told him he had intervened.

“As I’ve said from the start, I believe Chief Gallagher will soon have a fair and impartial trial,” said Mr. Norman. “But until proven otherwise, it’s appropriate that he be treated as a decorated soldier who still has the presumption of innocence.”

By Andrew Blake
In a letter sent earlier in the week to Navy Rear Admiral Yancy Lindsey, 40 members of Congress including Mr. Norman asked that the Pentagon reconsider its decision to place the SEAL in pre-trial confinement “and analyze whether a less severe form of restraint would be appropriate as his trial approaches.”

“We ask you weigh this decision, given the terrible message Chief Gallagher’s confinement sends to our warfighters, that they can be confined behind bars away from their family, legal defense and community for nine months before their day in court,” they wrote Thursday. “To confine any service member for that duration of time, regardless the authority to do so, sends a chilling message to those who fight for our freedoms.”

Mr. Trump mentioned Mr. Norman in his tweet Saturday, as well as “Fox and Friends,” the Fox News television program where the Republican publicly pleaded earlier in the week for reprieve.

“In honor of his past service to our Country, Navy Seal #EddieGallagher will soon be moved to less restrictive confinement while he awaits his day in court. Process should move quickly! @foxandfriends @RepRalphNorman,” Mr. Trump tweeted.

Fox News Sunday reports Eddie Gallagher has indeed be move to less restrictive confinement, allowing him to better prepare his defense before facing an Article 32 hearing and a potential court-martial.

Something does not make sense about the allegations. Navy SEALS are trained killers and it seems very unusual one would stab someone in the body and neck to kill them rather than just slit their throat. Messier for sure but quicker and more effective. I believe this was the SEAL I previously posted deserved mental health help not jail. Regardless, once again President Trump provided leadership from the front not the rear.

And the team says he took the best candy bars for himself.

Were they all Baby Ruth because his Pay Day was good n plenty? Did they Snicker when the Kiss of death sent the Taliban to become the Hershey highway? Did Mr. Goodbar show the Milky Way how to get to a Mars Bar? Did they get in a Twix and spill the contents of their Reecee Cup?

My apologies to any one offended by my making light of a very serious case. We weren’t there and we really don’t know what all happened. We do know that this Warrior had multiple deployments down range into Injun Country. We know that he was doing a thankless crappy job, in an area of the world we need to extract ourselves from, against an enemy that would not have hesitated to perform all types of atrocities to his troops in turn…and not bat an eye doing it.

Had he been there and done that so many times that he hit a breaking point? Very good chance. Does he have psychological problems? Don’t know. If he doesn’t, he probably should have. If he needs that type or any other type of help, give it to him.

My personal opinion, when it comes to our enemies, bring every weapon to bear….Kill them all and let Satan eat their souls. YMMV

I think the bad paper work on the young pups would have prevented them from those nice 6 figure contract jobs, so they went after him with every rumor they could come up with. But the snack thieving was hilarious..

Ya got me beat 5th/77th FA on your first paragraph and I candidly give you credit on those nuggets of yokes.

I don’t think the pretrial confinement has anything to do with the killing of the Muj. When we discussed this case before, I mentioned that Gallagher’s team mates were on high alert because he had gone off the deep end and not only threatened to attack them but also members of their families. That is behavior beyond the pale and guaranteed to get someone killed in a lethal community like spec ops. It is indicative of either mental health issues or that Gallagher is one very dangerous human being.

It appears to me that Gallagher is confined because of those threats and the potential for harm that he poses to his fellow sailors but the Navy doesn’t want to reveal that because of the disastrous PR it would entail.

First off drugs, assault and steroids that is a total no go zero tolerance !!

I’ll wait until the courts give their verdict. Until then a guess is just a guess.

When I read this article it makes me wonder about an action in the past that I have never heard of any repeal of that action. In 1966 McNamara lowered the IQ levels required for the draft in order to get 100,000 more troops for Vietnam. The end result was the induction of 354,000 troops of which 5,478 were KIA and among this group was LT Calley who was given a commission despite having flunked out of a JR college with 2 C’s a D and 4 F’s but was taken by the Army because no one else was available. He couldn’t use a compass or read a map and the general consensus by many at his trial was his lower IQ did not warrant his being Commissioned. Personally in a war under any circumstances one can easily be pushed beyond their limits. Granted killing civilians is wrong but in war as we know it from Vietnam and since, how does one tell the enemy from the civilian. Before you try to correct me as to that judgement, explain to me how we did not kill any innocent civilians during WWII especially at Hiroshima and Nagasaki. Any way you try to think as to things, War Is Hell and there will always be innocent (?) causalities.

From what I have read and perceived from people in the teams is this all started when a new AOIC showed up. If your review Chief Gallagher’s record – you don’t become #1 without making a few enemies along the way. This guys record is amazing. To me the whole thing stinks of manipulation. I do pray that the Chief is exonerated but with pressure from outside the community to clean up some bad behavior he may fall as the scapegoat of all things bad in the teams.

I’m not trying to excuse the Chief’s actions – I wasn’t there, I don’t know what happened. I just wonder how many trials we would have held if WWII Marines were held to this standard. I have great appreciation for dispatching bad guys and those who do it, and wish SOC Gallagher the best.

Anyone who uses illicit drugs on active duty can get fucked. Throw him in the brig for life just for that.
