Jerry Foster; the phony Navy Commander, Demented Magician
AverageNCO found this guy, Jerry Foster in the news in Simi Valley, California. He calls himself “The Demented Magician” and he entertains in the area with his little magic show. Magic is what his military career was. He claims to have spent 22 years in the Navy, retiring as a Navy Commander because of injuries he claims that he sustained in the Persian Gulf War and again in the war against terror;
Two articles at the Simi Valley Acorn have disappeared from the internet since AverageNCO talked to the journalist about Foster;
Foster put in 22 years, retiring as a commander in 2002 due to injuries he sustained during tours in the Gulf War and Desert Storm. The master EOD (explosive ordnance disposal) technician—a special operations job—has two Purple Hearts: one from a bullet wound and one from a land mine.
“The second one was the one that tore me up. That was a mine that I lost an EOD man to. He was ahead, I was behind,” Foster said. “It tore my legs to pieces.”
During his 22-year military career, Foster served several tours in the Gulf War and Desert Storm, where he earned two Purple Hearts—one from a bullet wound and the other from a land mine explosion—and a number of other medals and commendations.
When a mine check mission went awry in 2002, Foster’s dreams of becoming a naval captain, a position attained after 25 years of service, were shattered.
After spending three months in a coma, the veteran said, he felt lost and had no idea what to do with his life. On top of that, he had PTSD, a mental illness that can be triggered by experiencing a terrifying event like war.
First of all, the Navy EOD Warrior online Memorial doesn’t list any Navy EOD folks killed in 2002.
The National Personnel Records Center disagrees with his version of his career trajectory;
The Navy says that he was an E-5 Hull Technician – “HT’s do the metal work necessary to keep all types of shipboard structures and surfaces in good condition. They also maintain shipboard plumbing and marine sanitation systems, repair small boats, operate and maintain ballast control systems.” Nothing about explosives. His only award was a Good Conduct Medal – no Bronze Stars, no Purple Hearts. I don’t know how he squeezed in three tours of the Gulf War, it only lasted a few weeks – three years after he got out of the Navy. And if you don’t believe his records, he has a certificate for the war against terror;

The editor of the newspaper that did the articles about him says that Foster admitted that he couldn’t prove any of his narrative, so they pulled the stories. And, in case you’re wondering, The Demented Magician is planning on taking his stolen valor to the grave;
Added 5-16-2016; Foster admitted to DAV that he was deceitful in the wearing of unauthorized awards and rank and he’s promised them that he won’t do it again. He hasn’t admitted it to us, but here;

National DAV and State DAV was contacted. they would not give me all the info I wanted. He is confirmed special ops for about 15 years and again 7 years as a serviceman when he started his career. Also I want to let you know, this gentleman spends countless hours at the VA doing magic for the veterans. Companies supply him with cards and indeed, he will entertain a vet and then gives them the deck of cards.He is very funny and makes these homelss veterans happy. I saw on his board where he went and donated 50 decks of cards to homeless vets. He is always there feeding the veterans and makes them laugh. I have been following this thread and one of the writers said show a photo of his legs. I have seen this man you question. His legs arms are all full of scars and rip marks. It is very noticeable in the hot parts of the year. Scar tissue does not tan and he is pretty badly ripped up. Of coarse this could have been a regular accident. I do not really know what a person looks like when that happens, but he is loaded with scars and has a lot of trouble walking. He is also through the VA system ( I work there) and shows that he is a Vietnam Veteran on those records. I never heard him talk about Vietnam, but he is too young. He is showing clearly 22 years, but the 15 years missing is no where to be found on any type of paperwork. He also is showing 0-5 on our records, His first seven years are enlisted. It strange as they have him down for 22 years and only 7 show. I am just passing this info as I work at the same clinic he reports to. None of what you said has anything that proves his claims of Vietnam service, or any of his other claims of military awards. So, are you willing to risk your job by posting proof?

I realize that Wikipedia is not 100% accurate, but I would be willing to bet that it is probably correct regarding the deployment of the USS Compte de Grasse, but it shows no deployment in support of Desert Shield/Desert Storm.

Perhaps Jerry could provide the names of some of his teammates from his days with EOD, and they could verify his service claims. Here is a tip, though. If they all post from the same IP address coincidentally located in Jerry’s home, that may be a tad suspicious.

I failed to mention that he is also on soma and many medications for the psychiatric end of it. By count on the pc he is on about 24 meds. He attends a PTSD group and a group for his wife he lost from cancer. One thing I do want to say. I saw where he was made fun of as he had a baggy uniform. Five years ago he gave his wife eight months of constant care. She contracted Cancer and after she died he turned into a very thin stick. He took it very hard when she died, he went from 180 to 120. and that would be a reason it was loose. I am giving info as it seems a lot of information has been left out. What you show and what we see are like night and day. I have not told him about me writing in, but he is always in the VA with many health issues. Also there are x rays and his legs are loaded with hardware. He also has a very bad limp. I am giving information you folks do not seem to have. The hippa laws are strict so it cannot be sent out…….I do not know what happened, but his records are a mess on the medical end of it. But he does show overseas. I am not supposed to even do this.

According to records he is showing service connected and he is at 60 percent. Due to the fact they show him in Vietnam he cannot get his 100. They put him out of Desert Storm and Gulf War, and his records in the VA show as I said Vietnam.

There’s a very logical reason that his records at the VA aren’t supported by what’s in the official copy on-file at NPRC, “Ms. Feigenbaum” – and why they say he served in Vietnam when he’s too young to have done so and has no military campaign medals for doing so.
The VA pretty much accepts whatever a vet gives them as accurate. Sometimes . . . it isn’t. Several people in the state of Maryland got busted, along with a Maryland State DVA official, for conspiracy to defraud the VA through using forged or altered documents within the past couple of years.

Okay Edith a few things. 1. I’m the guy who started this whole thing. The only reason I won’t use my real name on here is because of one certain individual who likes to sue people. But I used my real name when I worked with the Acorn folks on regarding their articles. Just a question here. This guy is ingesting some pretty strong drugs, e.g., morphine, oxycodone, acetominophen and others not mentioned above. Does he still have a working liver?

I can’t speak to his internal pharmacy, but before he pulled all his Facebook stuff he had some of his magic videos posted. He’s not a fake magician, he had some good tricks.

It’s just the disconnect between the CLAIM of a long list of drugs that are quite likely to have serious side effects, including tremors and dizziness, and the IDEA that he’s still able to do magic tricks that require a steady hand, extreme quickness, and extreme attention to detail.

Then there’s the claim of his taking clonazepam. With all those medications that he’s allegedly taking, whether a doctor would prescribe clonazepam or not is questionable.

Yes I am his Mother and very much alive. Average NCO please call me Edith and I thank you for explaining to me what is going on. I have been reading everything and he has been at the VA all day, and I can promise you I have been home all day watching the dog and he is still not home, but he did not attempt to call anyone on here and my number is not blocked it would have shown up. My son never called anyone.has taken any money from me and if he wanted to he could, it is all in his name in case I am placed in a nursing home one day. They will take all the money in California, but he has not touched a dime. I am worried about all the narcotics the VA has him on and it was said he may not have a liver although he is constantly checked. He has just been removed from 240 Tylenol three a month which he was placed on a year after his retirement in 2002.I am not the enemy here, just his Mom. Regarding his magic and photography. There are a few holes in your story, “Ms. Feigenbaum”.
1. You claim to be a longtime VA employee. Yet you apparently do not know what a DD214 looks like. What’s posted above is NOT a DD214. It’s a summary of service prepared from official archived records by officials at the National Personnel Records Center. I find that . . . curious.
2. Your name does not come up on the publicly-searchable database of Federal employees to which I linked above. However, that public record database (1) includes the VA, (2) covers at least 2009-2014, with 2015 data pending, and (3) only requires a last name for a “hit”. It shows 27 entries for people named “Feigenbaum” (there are different entries for different years). None of them have the first name “Edith”, and none are in California. Yet you claim to have worked at the VA for “24 years” and implied above you still work for them.
The fact that your number “isn’t blocked” means very little – you can almost certainly still place blocked calls from it. Most phone systems will allow you to block calls on a per-call basis by dialing a specific code. You don’t necessarily need to pay to have that done for all outgoing calls by your local TELCO.

See the contradiction? He has an internet presence, so he’s capable of accessing this site. If he didn’t, then this wouldn’t be something that stopped him from doing what he does. But, here you are claiming that he has stopped doing this because of what’s going on here.

Doctors would prescribe three times daily (TID) on something like that. We’re talking about Tylenol 240, something that you could purchase over the counter to take as needed (PRN). I mean, that must be some strong Tylenol to last one third of the month. 🙄
thebesig: I think the reference was to Tylenol 3 (each tablet has 300mg acetomenophen and 30mg codeine). Normal dosage is 1 or 2 tablets every 4 hrs. 240 tablets in a month is a reasonable quantity – that’s 8 tablets daily, or somewhat less than 2 every 4 hrs.
Happen to have been prescribed that stuff a couple of times post-surgery and also know someone who takes them for long-term chronic pain management. For me, it worked – but made me sleepy as hell. Doesn’t do that to everyone.
I’m looking at it the way it’s written above, something that wouldn’t have been done had this person been in the know. From a medication aid standpoint, when someone says, “240 X three times a month”, I see similar to this:
“Take 3 tablets three times monthly as needed for pain”. The way you described it would read: “Take 2 tab every 8 hours as needed for pain”. That would be followed by “X of 3 refills” left.
If your interpretation is what’s meant, then there’s some truth, regarding medical issues, being told by “Edith” albeit biased to support Jerry Foster’s claims.
The person taking the medication would be real familiar with how that worked, and this would be reflected in their statement.
The fact that this confusion exists may indicate that the above person is who they say they are, or it’s Jerry Foster who’d indeed has legitimate medical issues, although not related to what he claims they relate to.
The “retired” in his FOIA request above may hint on something happening that caused him to be medically retired. That’s assuming there is something else that the initial search didn’t turn up.

I have an update for you all. I received a letter from the California DAV Adjutant, Mr Daniel Contreras, stating that Jerry Foster made an admission to his deceit. He is not to wear any military decorations that he did not earn while representing the DAV. All photos of him wearing unearned decorations on the Chapter 55 DAV’s Facebook page are to be removed. That has not happened yet and I still don’t see anything on the Chapter 55 Facebook page owning up to any of this. I’m not holding my breath either.
Jonn, as soon as I can, I will scan the letter and send it to you in case you want to add it to the record. I will also send this to the reporter that he deceived to close that loop.

DAV Chapter 55 should publish a statement regarding this matter in the local newspaper and on their website to be transparent and make clear that this behavior will not be tolerated by its members. Many military and non military people mistrust veteran organizations expecting a scam, which many turn out to be. A reputable veteran organization such as the DAV, should desire to be above reproach.

Foster is almost certainly eligible for DAV membership.
DAV membership is open to “any veteran wounded, gassed, injured or disabled in the line of duty during time of war and to persons who have been awarded expeditionary or campaign medals.” DAV also defines the period 4 November 1979 through 31 January 1990 to be a “time of war” that they call the “Iranian Crisis, Lebanon Crisis, Invasion of Grenada, Invasion of Panama and other engagements” period.

Foster was retired in 1987 with far less than 20 years service – which means it’s almost certainly a medical retirement due to disability. Since his discharge date falls in one of the DAV’s defined “times of war”, that in turn makes it a virtual certainty that he is eligible for DAV membership.
Addendum: the DAV has seriously relaxed its membership criteria by very liberally defining what it considers a “time of war”. Those periods formerly were much more narrowly defined by DAV than they are today.
Per the document linked in my previous comment, the DAV now considers almost all service since 16 Sep 1940 to have occurred during a “time of war”. In fact, by the DAV’s reckoning the only periods since 16 Sep 1940 that are not “times of war” are (1) the period of slightly more than 3 years starting on 15 Oct 1976 and ending on 3 Nov 1979, and (2) the period of slightly more than 6 months beginning on 1 Feb 1990 and ending on 1 Aug 1990. For membership purposes, DAV considers all other military service since 16 Sep 1940 to be service during a “time of war”.
Draw your own conclusions as to why they’ve so broadly defined “time of war”.
IMO the DAV really should dispense with that “time of war” fiction and just make all disabled vets eligible to join. They’ve damn near done that anyway, and their definition of “time of war” is so ridiculously broad that it’s absurd.
I’m a Life Member of DAV and no one ever asked me for proof of my service.

DAV rep had worked with my VA mediocal package in 2007 and 2008 so I’m pretty confident they knew.
I got my first disability check in 2010 I think, the first payment went to the DAV for lifetime membership.
They went to bat for me for 2 1/2 years to get me 30%.
I wasn’t deaf enough but the VA said, come back later when you’re older because at some time, you *will* hit the minimum threshold for another 10%.
I can only imagine showing up at the VA some years from now.
