PENNY ACQUITTED
Despite the best efforts of the Manhattan DA to try and make any charges stick to Marine vet Daniel Penny, the jury took less than a morning’s deliberation to acquit Penny.
Jurors acquitted Penny of criminally negligent homicide, which could have put him behind bars for up to four years, in Neely’s chokehold death aboard a crowded uptown F train in May 2023, The New York Post reported.
Manslaughter, the top charge against Penny, was tossed on Friday after jurors twice said they couldn’t reach a unanimous verdict. NY Post
The prosecutor’s move Friday to drop the more serious murder charge was widely seen as a strong-arm, and possibly unConstitutional, attempt to coerce the jury into accepting the lesser charge – and it didn’t work.
As the jury foreperson read the “not guilty” verdict, some observers in the courtroom applauded. Others began to audibly sob and yell, and were escorted out.
“This is America. That is the sound of Black pain,” one person said outside of the courtroom in Lower Manhattan to the reaction.

As someone who lived in NJ and worked in NYC, but moved to the Free State of Florida 25+ years ago, your first mistake is being in NYC for any reason. Second would be riding the Subway. In the 90’s it smelled like piss, and you always stood in the middle of the platform in fear of some nut/asshole/inattentive rider would push you on tracks. Now that he has his freedom, Mr. Penny needs a fresh start away from that sewer.
I’m a native of NYC – born and raised in Queens – and lived there the first 27 years of my life. Finally moved out when I joined the Navy. My last visit was roughly 10 years ago and I have no intention of ever going back if I can help it.
Mrs. GB and I went to NYC once – some decades ago – while visiting our goddaughter in Connecticut.
It was during better times – but I have no desire to return to either Connecticut or New York in this lifetime.
My family’s from there. The city’s smaller and less cool than it seems on Law and Order. Suffolk County out on the island– “Joey Buttafuoco-land” as they call it– is much the same but less nasty.
The lesson here is never talk to the police without a (competent) lawer representing your interests. The cops may be on your side and seem it justifiable, but if the jurisdiction has a George Soros District Attorney installed, he will make it his/her mission to destroy you.
