Soldier indicted on multiple charges in protester Garrett Foster’s death

Last year Garrett Foster, an Austin, TX Black Lives Matter rioter, was shot and killed. Now, the alleged shooter has been indicted.

A Travis County grand jury has decided to charge U.S. Army Sgt. Daniel Perry with murder, deadly conduct and aggravated assault in the shooting death of Foster on 25 July, 2020. He turned himself in to the Travis County Jail and posted a $300,000 bond, according to his attorney.

Perry, an active-duty U.S. Army sergeant was working as a rideshare driver at the time of the deadly shooting.

According to his lawyer, Perry dropped off a rideshare customer near Congress Avenue before turning onto Congress Avenue near Fourth Street. Perry, who said he did not know protests were happening that night, found himself surrounded by a group of protesters. Several of the protesters allegedly beat on Perry’s car.

AUSTIN, Texas (AP) — An Army soldier who shot and killed an armed protester after driving into a crowd demonstrating against police violence in the Texas capital last summer has been indicted on a murder charge, authorities said Thursday.
Sgt. Daniel Perry, who was stationed at Fort Hood, was booked and released on $300,000 bail, said Kristen Dark, a spokeswoman for the Travis County Sheriff’s Office.

Perry’s attorney, Clint Broden, has said the soldier was working for a ride-sharing company and acted in self-defense after Foster pointed a gun at him. Broden issued a statement Thursday expressing disappointment in the indictment and confidence that Perry would be acquitted.

“It is important to note that the standard of proof required for an indictment is significantly less than the standard of proof required for a conviction,” the statement said.

Travis County District Attorney Jose Garza said his office planned to request that Perry surrender his firearms, in addition to other conditions, for his release.

Foster, the soon to be room temperature rioter, was carrying what has been described as an assault weapon when he was shot.

Well it’s Austin.

First thing his lawyer should do is request a change of venue.

As for Perry surrendering his firearms, he should store them in the unit arms room. That way he knows he’ll get them back when he’s acquitted. The most the DA could reasonably ask for is the firearm used in the incident.

Sergeant Perry will never be convicted, and District Attorney Jose Garza knows it. He just wants to fuck with this individual who was legally defending himself, draining him if any money that he may have to show those on the other side of the political spectrum that the Left is in charge, and they can do what they want with impunity.

DA Jose Garza must have missed that interview shortly before the shooting where mostly peaceful rioter Garrett Foster was strutting around with his “assault rifle” and said that those who were not supporting BLM were “pussies”. It is intuitively obvious to the even the most casual of observer that Garrett Foster was the aggressor, along with fellow protesters, when they surrounded the vehicle and prevented Sergeant Perry from lawfully travel public roads.

This is one of those unfortunate moments where someone finds themselves in a situation that requires lethal force in self-defense but due to the politics surrounding the situation they are later charged with a murder by a dipshit prosecutor looking to establish a name for themselves at the expense of someone who should never have been charged in the first place.

Here’s hoping the good sergeant is able to afford some actual justice.

For those keeping score on the sidelines this is one of those moments where considering litigation insurance is a wise idea.

I never had to use mine to defend this type of situation but I was sued four times(the whole board of directors was named) as a volunteer for a youth organization over parents pissed off about rules…it’s rather comforting when you get served to make a call and have an attorney get right back to you without spending a nickel out of pocket beyond your premiums.
