James Grazioplene reduced from major general to second lieutenant

James Grazioplene pleaded guilty to charges, in a civilian court, for sexually assaulting his daughter while he was serving in the Army. The Secretary of Defense subsequently reduced Grazioplene’s rank from major general to second lieutenant. He will maintain his retirement benefits as if he retired as a second lieutenant.

From the Army Times:

Grazioplene, 71, started his military career with a commission at that same rank out of West Point in 1972. He rose to the rank of two-star general before retiring in 2005.

But his daughter, Jennifer Elmore, later brought allegations that through her entire childhood and at various posts both abroad and in the United States, her father had raped and molested her.

Army Times has a policy of not identifying by name survivors of sex crimes. Elmore agreed to be interviewed on multiple occasions and to be identified publicly in articles about Grazioplene.

The allegations were raised within the family in the years after she left home in the late 1980s, but came to the attention of military officials when Elmore reported the conduct to the Army CID agents at Fort Bragg, North Carolina, in 2015.

weirdly, this doesn’t affect his actual retirement pay…his high 3 is unchanged.

Isn’t there something about highest rank you successfully served…this would be a case of him not successfully serving in any of those ranks. Did he also get prison time?…my work is blocking the Army Times website.

He first took an oath of office prior to 1980, so he comes under what is commonly called the “final pay” retirement system.
In short, his pension is based on:
2 1/2 % x
years of service x
the monthly base pay of highest grade ever held, even for single day.

(NOTE: “The highest grade ever held” need NOT be the final grade. More than a few Viet Nam Captains, Majors, and even LTC’s released during the reductions in force after 10 or more years of active duty in the early 1970’s, reverted to prior enlisted ranks / or enlisted, perhaps as SGT or SSG, to rack up 20 years of active duty. Their retirement pay was as a Captain / Major / LTC over 20 years).

My question would be:

Now that his departure rank is 2LT, does he have to give back the accouterments of a General Officer? the red flags, license plates, the .45 caliber pistol serially numbered and assigned to him?

In Vermont he had a E5 retire at 62.5, highest rank held was LTC, should be a nice retirement check.

BCD – Officers cannot receive this discharge.
Dismissal
When you are an officer you can be dismissed from military service. This discharge can be imposed by a special or general court and is often enforced alongside the maximum punishment as listed by the Manual for Courts Martial. It is an officer version of a bad conduct discharge. (OK)
Dishonorable Discharge
This type of discharge is the worst anyone in the military can receive. It can only be given by a general court-martial for the highest of offenses which are often accompanied by a prison sentence in a military prison. (Yes but this doesn’t say enlisted vice officer.)

What, besides the reduction in rank did Grab-azz-ophile receive?

I did go back and read the article and the military case shit the bed and then the civilians took over and he at least did some time in PMITAP.
So, he gets nothing but a change in his retirement benefits based on the civilian conviction to the last best satisfactory rank and then see ya?!?!?
and then he gets a “deal” and does like, a year and a half?
Well at least I can dream his 18 months wasn’t pleasant based on what I hear of the social hierarchy in jail.

I’ve heard/read enough Tales of Terror about a female getting pissed off at boyfriend/husband/uncle/father/etc male, and throwing sexual abuse accusations.
(Many Years?) Later, the female recants her accusation, but by then, it’s too late for the hapless male who was the target.
SO……did this REALLY happen? If so, Orificer Grazioplene deserves everything he’s gotten, and more.
If not, if it comes down to an unproven case of “he said, she said”, then I hope “Lt” G can find someplace to escape to live out his remaining years in “relative” peace, far from the madding crowd.

If you had read the article you would have noticed that the key pieces of evidence were letters that the wife had written to relatives describing the General’s errr Second Lieutenant’s activities back when they were occurring 35 years ago.

Such evidence, produced decades later with corroboration from the victim, makes introduction of reasonable doubt quite difficult.

Tox, like you, I usually don’t put a whole lot into the whole she said/he said thing. If I wasn’t there and I didn’t see it, I rolled on. I have been a “victim” of false accusations from wimmins (2 occasions where I turned down their advances) and as a Father, cannot imagine any man molesting their daughter…or anyone else, but as we all know there are a lot of sick mofos out there. And as 5JC pointed out, I read the entire article, including the embedded link on her story, giving the additional info that pretty proved that this sick bastard did what she claimed and his wife covered/enabled him.
