Charleston, WV — West Virginia US Sen., Joe Manchin, spoke with Fox News on Monday evening that the move by House Democrats to impeach President Donald Trump was “ill-advised.” Moreover, Manchin said the votes to convict and remove the president in the Senate are not there.

During the interview, Bret Bair asked Manchin whether there were the votes in the Senate to convict and remove Trump for allegedly inciting a riot that resulted in people storming into the US Capital Wednesday of last week.

“I don’t see any of that, because there will be 48, still 48 Democrats, until we seat Warnock and Sen. Ossoff,” Manchin said. “So, until that happens, you need 67 votes. I think, my arithmetic, that means we have 19 Republicans. I don’t see that. And I think the House should know that also. We have been trying to send that message over. They know the votes aren’t there. You would think that they would do that.”

“I think this is so ill-advised for Joe Biden to be coming in, trying to heal the country, trying to be the president of all the people, when we’re going to be so divided and fighting again. Let the judicial system do its job,” he continued. “And then, we’re a country of the rule of law. That’s the bedrock of who we are. Let that take its place. Let the investigations go on. Let the evidence come forth, and then we will go forward from there. There’s no rush to do this impeachment now. We can do it later if they think it’s necessary.”

So the impeachment of Trump is, in the Senator’s mind rather like an assault weapons ban. Another approach he can’t support “…right now.” Manchin opposes assault weapons ban

The short answer is maybe, the Constitution does not explicitly spell out a time frame impeachment may occur in. The only outcome would be he would no longer be able to hold any elected office.

Minor quibble: while disqualification from holding any future Federal office is a potential penalty for someone impeached by the House who has been convicted by the Senate, disqualification from holding future Federal office is not mandatory. It is only imposed if the Senate elects to do so in addition to removing the convicted individual from office.

For an example, see Alcee Hastings. He was a Federal Judge who was impeached, tried, and removed from office for bribery and racketeering in 1989. However, while the Senate removed him from office, it did not bar him from holding Federal office in the future. Hastings was later elected to the House of Representatives in 1992.

Sidebar: Hastings had been acquitted in a 1983 criminal trial preceding his impeachment when his co-conspirator refused to testify against him, opting to go to prison instead. Clintoon pardoned the co-conspirator on his last day in office.

First of all, Trump has a 100% chance of being impeached if he does not resign in the next few hours. The impeachment vote happens today and it will pass the house.

Second, Trump also has a 100% chance of being removed from office within a week if he does not resign or choke on a cheeseburger first.

Third, the best thing that could possibly happen for Trump right now is a negotiated resignation with a Pence pardon.

Fourth, the second best thing that could happen to him is an almost immediate impeachment vote in the Senate.

Here is why: Republicans would control the process. There would be no time to call witnesses. No time for democrats to methodically lay out the case. No time to investigate the behind the scenes communications. No for a parade of witness testimony. No time to incorporate evidence being gathered from 100s of current investigations into January 6th and the events that led up to it. And a vote to remove would be seen as a betrayal of a sitting president by his MAGAts (still the republicans base),…

He would likely not be removed and it would be interpreted as a acquittal, a “not guilty” vote by his cult of Q d’eTwats.

However, An impeachment trial after he leaves offices is going to be Democrat controlled,, methodical, thorough, have plenty of witnesses, plenty of evidence, and would have much less political cost for republicans voting “yes“ since the only result would be Trump being banned from future office which most republican politicians and almost all their corporate donors want.

So people thinking that McConnell delaying the senate trial is a “win” for a Trump are idiots.

Those acts included suborning perjury on the part of prospective witnesses, concealing evidence, attempts at witness tampering, and knowingly filing/allowing to be filed false and/or misleading depositions to prevent relevant questioning. Those are all classic obstruction of justice acts.
